I was rear ended 5-11-08. I don’t want a lawyer! what is fair compensation for my back injury?
I was diagnosed with whiplash, left tibial nerve damage, a slipped vertabrae, and a bulging disk. I did nerve testing, x-rays, and a mri. I have to see an ortho-specialist this week. I have been off work since the accident. I want to know excluding the medical bills and lost wages, what is fair compensation. Also, am I being unrealistic, do I need a lawyer?

I was in a wreck in 2005, messed my back and my neck up bad. I hired a lawyer, he got 10% of my pay out. I will tell you this, I am still suffering. Make sure you get all you can for your health, I dont mean money. I mean for your injuries. The insurance company has to take care of everything. Get a lawyer. Also, you can call Crime Victims Reparations. They can also help you in this. More than anything, get a Personal Injury Lawyer. No amount of money can EVER take care of the pain you must be going through. Also, if you want to settle without a lawyer, the insurance company is gonna give you the bare minimum. They start out small, unless you get a lawyer. My settlement was $96,000.00. Sounds like a lot, right, WRONG! That included medical bills and all.
Get a lawyer. You won’t pay out of pocket (they take from the settlement in the majority of cases) and it may be the only way you get compensation for everything. Best of luck to you.
With the amount of injury you have, there is a possibility for surgery. So I say YES you need a lawyer. You have already racked up thousands of dollars with x-rays, and MRI’s and going to see a specialist, who I am certain will put you in physical therapy, or even suggest surgery!! So YES YES YES you need a lawyer…….. Good luck!
Yeah you should get one. Lawyers help you get the most money by putting an overall dollar figure based on your pain and expenses. They negotiate with insurance companies and hospitals. It’s going to cost some of your settlement, but it’s worth it. You could have some long term back pain, make sure you get funds to get it tended to.
get a lawyer! I just settled years ago and had the same problem. he can advise you what you can get. The insurance company will drag it out till you get very little. Years later-like 20- i am still having problems. Famous last words "I wish I got a lawyer!’ They only get a percentage and well worth it cause they figure in their fees too.
Also your own insurance company may not cover you for some things if they can prove it was from an accident.
Get a lawyer…
What is fair compensation can’t be determined until you know how well you are going to recover. - If you are still off work, I think you should have a lawyer.
For simple whiplash injuries, where the injured party makes a quick full recovery, in negotiations, lawyers sometimes use the formula 3 to 5 times medical specials plus lost wages. But negotiations can be difficult. - If you don’t have hard x-ray or MRI evidence of injury, insurance companies will claim your bills and lost income claims are excessive.
An additional complications is that if your medical bills have been paid by your own health insurance, you will have a claim for reimbursement by your own insurance company. - A lawyer who gets you a settlement can sometimes negotiation a reduction in the claim.
