But my policy doesn’t cover what they’re asking for. Will my policy pay what they can and leave me with the difference? Or will I continue paying the sky-rocketed price AND the full amount that they want from me (if they win)? I’m afraid that they’re blwoing this out of proportion and are unfairly milking me for what I’m worth. I’m a student and my tuition is equal to what they want. I’ve never been sued before and I feel like such a bad person, will this go on my record? Can these people really milk me for every penny? Will a judge be able to determine what’s fair? Help!

Your insurance is going to battle with them for awhile. If you are going to court, get yourself an attorney as well.
No, you are not a bad person. Yes, people will go out of their way trying to get more money than they should ask for. It’s a dredge on our society and remember it if you ever are in the reverse seat!!! Lead by example!
If you have a decent attorney, they should help fight for what is fair and now what the others want. It’s worth the cost of an attorney.
Sorry this happened to you. Without proper represenation, yes, you could get sued for every penny. But it’s a fight and a judge will listen. Make sure you have legal representation on your side too!
Stop feeling like a bad person. Accidents happen. That’s why it’s called an accident and not a purpose. It might even be partially their fault with the right attorney!
Find a lawyer ASAP! it may cost you a little now, but save you a lot of money in the long run.
Your only option is to kill the person suing you. I recommend strangulation.
Talk to your insurance agent. They can TRY to milk you for every penny.
call your local consumer reporter and find out where you can get some free legal advise or else get an attorney. You can not do this alone and your insurance company may not be your friend.
If you need legal advice you can go to your uni. Usually all universities have legal services for students.
If you have to pay difference and can not pay all, ake a suggestion of payment plan. But if that is not a option it will go against any thing you inherit, tax rebate, money coming into you till completed. A lawyer can explain this better. But you do have right to ask if it is being pumped up.
Talk to your insurance co. My son was just in a situation like this, and the other insurance co didn’t want to cover a no-fault accident. The ins. co. got my son a lawyer, everybody went to court, and my son not only didn’t have to pay but got $50 for showing up and explaining his side.
If insurance co. won’t help, you need a lawyer.
If the injured party is awarded more than the limit of your coverage, of course you are liable for the balance. That is the reason insurance companies offer higher limits at increased premiums. You get to choose your risk. If a judgment is found against you, the court can seize your assets and part of your wages. This can go on for as much as 20 years.

Judges will determine the cost by what is shown to them. This can be for actual medical expenses, future medical expenses, property damage, financial loss (wages, etc) and there also could be punitive damages.and court costs.
If they are awarded $ 1,000,000, and your policy limit is $ 300,000. you would be on the hook for $ 700,000.
It is a good idea to get your own attorney. Your insurance company will fight for themselves, and offer to settle the claim rather than go to court. Of course, you need to get your own lawyer.
If your insurance company settles with them, you have to ok it first. They represent you and will do all they can to protect you. If it goes to court (98% settle) the judge will decide what happens. If you loose and have to pay more than your policy limits, you will have a judgment against you for the remainder of the balance (amount after ins. pays).

Just because they are asking for a heap of cash, doesn’t mean they will not settle for your policy limits.
The insurance company has to hire an attorney to represent your best interest. It is not an insurance agent who is dealing with the suit.
They can ask for anything they want to ask for. Merely asking doesn’t necessarily mean they will get it. You and your insurance company must and will defend yourselves . Most times, the suing party will settle for (up to) your policy limits and most times it will be settled out of court. Sit back, take a big breath and try to relax.
It sounds like the damage you caused to the other party exceeds the limits of your policy. That means you are responsible for the difference .Yes, you can and probably will be sued. And a judgement will most likely be placed with the credit reporting agencies.
