In regard to auto. ins. specificically bodily injury. Victim is claiming bodily injury. Will sue i am sure.?
Has used his state farm policy and is now going after mine. he walked away 70 days ago just fine. i even drove by his residence a few times and he l ooked just fine also. this is a moral point for me. you have to stand for something or youll;; fall for anything. i cant stand the thought if my insurance also state farm ends up paying out. not because my rates would go up; obviously wouldn’t like that. but here in south florida , people from other nearby countries are always pullin this. should i try to round up possibly neighbors of his, co workers if i can figure out where he works, and any local businesses he go to to prove he is not and was not hurt.
However he did use his liability/bodily injury first. does that mean he just paid his deductible. never understood auto ins.
it eats at me that visitors, whether they become permanent U.S. citizens come here to use our country. serious inquiries only. sorry if offended anyone but i do have my American right to opinion.

The other party can only pursue his own liability coverage - in the case of uninsured motorist - if he has that coverage. he may have pursued his no fault or med pay coverage for injuries. The only way someone can pursue an injury claim is to pursue from the tort feasor’s insurance carrier, or their own in case of uninsured motorist. If you are at fault for this collision,the other party can only collect from you - if you have insurance - he could not have collected liabiltiy coverage from his own carrier. It does not work that way in the US!
If you think he is committing insurance fraud you can call the auto insurance company and let them know, I know there are a few companies that have a phone number where you can call and if you suspect someone is committing fraud it is your obligation to call. It makes me angry that someone claims they are injured when they are just fine, it makes our insurance go higher, anyway…AH! and just to clarify that….you would be amazed how many US citizen make false insurance claims, the "other countries" people work in construction and all those hard works and get hurt at work and they keep working because they need to, while you see a lot of US citizen claiming they hurt their back just from carrying someone from a wheelchair to a bed!!! So there are a lot of kind of people who do that, from everywhere!
this is what you do. get a video camera first off…and when you have time go by there and tape his every move,…or have someone do it for you. Secondly…do go to his neighbors and work and inquire about his activities. If they are reluctant to give you information they will at least tell him that he’s being watched…and that should steer him away if he has no real injuries.
Any information you gather…get it to your insurance company as quickly as you can…this will help you a lot.
It’s basic PI business…but you do it on your own. Write down everything. Even approach the individual yourself. Act like you are concerned….document it all…do this a few weeks in a row ….but act like you are just concerned and sorry that the accident even happened..do not go in interrogating him. Bring some cookies and sit and talk to him….no one can tell the same lie twice…get a small cassette recorder with voice activaction and put it in your pocket…they pick up pretty good.
This should protect you from any suit…
