I was involved in an accident last fall. According to the police report, I’m at-fault. I got a summons early this yr. At the time they filed court papers, they submitted a claim to my ins co.(weird?) No one was injured at the scene, no ambulance was called. My car was towed – the police officer deemed it wasn’t safe to drive. Other party drove off with theirs

I’m in NJ. We can buy limited-tort(LT) or full-tort w/ our auto policies. My adjuster told me that they have LT. This lawsuit is for pain and suffering. Under LT, one can sue for those damages only if and when the injury is severe, resulted in death, perm. disability, ect. Neck sprain was the phrase my adjuster used to describe their injury. They didn’t request any accommodations for court that led me to believe the injury caused them any mobility problems

How often do these actually go to juried trial n how long does it take?months years?

btw, only one person was involved the other party – wanted to keep it gender netural







I was in a car accident were i was hit by a Drunk Driver.. I was taken by ambulance with minor head scratches but alot of neck and back pain cause i was rear ended, Now the other guy went to jail his insurance admits fault and is taking care of me. Its been about 2 months and now that im done with my doctors they say they want ALL my medical bills. So should i get a lawyer or should i wait and see how much the 1st offer is? Would i get more money with a lawyer? And my bills are about 11,000 dollars any idea of how much i might get? THANKS..







I got into an accident around the end of october last year. At the scene the other guy’s car only had surface scratches since he owned a Mercedes and the bumper took all the impulse, my car was pretty badly totalled in the front. The first thing I did after the accident was walk out of my car to check if everyone was ok, I asked him and he said he was. So we called the police, we didn’t ask for an ambulance or nothing because it was a low speed collision and we both had seat belts on. So the police officer came and took our reports, and asked me if I was ok I said I was and he asked me if the other driver was ok as well, and I told him he was, the police officer asked the other driver as well. Now one year after the accident this driver is trying to make a claim on being bodily injured in the accident. I can prove using physics and dynamics exactly how much force was applied to his seat and through the seat belt onto him, I have the police officer as a witness, how will my case hold up
I am 100% sure he is trying to fraud me, I am pretty sure he cut me off right before a red light but that cant be proven. However the police officer can testify that he was ok at the scene, how badly his car was damaged, etc; isn’t this enough to win a jury over? What is this other guy thinking, that I am so stupid I will settle for what he askes knowing I can win the case so easily because I am innocent and he will be commiting purgery on stand by lying about his injuries? Also doesn’t he get checked by an unbaised doctor recommended by the judge to show what his injuries can be attributed to? I have Gieco insurance, will they do anything to help me prevent this obvious case of fraud? Is there any chance that this guy’s lawyer can trick a jury even with all my proof and evidence?
Thanks for any ideas, also should I contact Gieco’s fraud department and report this as such a case for investigation?

I wasn’t able to give my side of the story to the police i was taken away in an ambulance really quickly.Now, I’m listed at fault and in need of medical and legal help.







My son was sent to the hospital by ambulance, where they did a CAT scan, many xrays, and an EKG. He was sent home with perscriptions and told to see his doctor in 3 – 5 days. He went to his doc, and still has neck and back pain and fluid on his right knee….translation…more dr’s apts and more meds. My son is 22 years old, just out of the Marines with plans to go to college in the fall…he has a part time job that does not come with sick leave, so every day he misses is out of pocket.
A few facts: My son was not at fault (was not ticketed for any violation)
The other auto/driver thought it was a 4-way stop and pulled out in front of him. Also he was in a company pickup, so is a company insurance we are working with.

I guess my question is, will he recieve a settlement from the insurance company? Do we need to get a lawyer, or is it too soon to know? When should we get a lawyer if we need to?

We were hit head on by some kids who were uninsured. It was a pretty bad accident but luckily we have Personal Injury Protection and also uninsured motorists. The combined impact was about 90 mph and it totaled both cars, we are lucky to be alive. But our insurance company decided after 2 months that we must not really be hurt and tried to send us to get a independent medical examiner. That’s all fine and dandy because we have nothing to hide, we are both still truly hurt. But from what I understand from talking with our chiropractor is that this is a tactic the insurance company uses to stop paying for our medical bills and almost all of the "medical examiners" deem the patients fine and need no further treatment thus our medical bills would no longer be covered. So we got ourselves a lawyer to deal with this and they are seeking 300,000 dollars from our insurance company (which is the amount of uninsured motorist coverage we have.) This scares me, I don’t want this kid and his family to be ruined. What’s the likely hood that they will get that, and if not that, what is more likely?
I did go by ambulance to the hospital and I have seen a "real" doctor. As for the chiropractor, the majority of my pain is in my back, hence why I’m seeing a chiropractor. Originally I couldn’t turn my neck or bend down at all. Now my neck is doing better just a little irritated but my lower back is in constant pain. I have a 2 year old and it makes it difficult to do anything with her such as putting her to bed, etc because bending over with any kind of weight (like a 27 lb baby causes issues.)







Hello! 3 months ago I was T-boned by a car that ran a stop sign. My old car was totaled for 0 (91 Honda with 260K miles on it and a past total in the history). I had to get 7 stitches in my head. I didn’t miss work, though I missed two college classes that day. I have a slight scar of an inch and a half or so on my forehead. My medical bills totaled 00 after ambulance, x-ray, stitches, etc. I have police report and witnesses were there on the report. I don’t see the need in a lawyer, since it wasn’t a huge injury and I haven’t had any problems since then, but I have ABSOLUTELY no idea what a fair settlement is for a case like this. I’ve been friendly with the party-at-fault’s insurance agent as he has been to me, but I’ve been offered 0 for pain and suffering (he said that was the max) and 0 for property damage. Should I just accept this? Like I said, I’m not looking to extract as much as I possibly can, but I don’t want to get ripped off either…







I was involved in an accident that will probably leave my car totaled. Myself and a passenger in my car were taken to the hospital by ambulance so there are medical bills involved and there may be on going medical bills. Both drivers are insured. The other driver received a citation that seems to show the reason why the accident occurred. Should I get a lawyer?







My kids were in the car and didn’t have their seatbelts on. I was giving a sitation for the seatbelts. We were all transported to the hospital in an ambulance. I was wondering if any one could tell me if I should get a lawyer. And If I did would my settlement be any bigger. Or should I try and negotiate it out my self. I live in Delaware and the Other insance company has claimed Liabilaty. They are paying for my rental and have sent paperwork to release my medical records to pay them also. Please help!







Fortunately, I did not hit anyone. Does anyone know what I can expect if the blood test comes back under the limit? I asked if I’d blown over the limit and the officer said, "Just barely." If it does come back below .08 do I still have a DWI? Or does that just make the sentence more lenient? I was told the breathalyzers they give out in the field are not that accurate which is why they either give you another one at the police station or a blood test in the hospital (I had to go to the ER). Since I was only a little over couldn’t it be argued that the first test was not accurate? Will I be able to drive AT ALL these first 30 days?

I am meeting with a really good DWI lawyer tomorrow but I’m anxious to know a little about what I might expect.

I do have a ticket for driving while under an impairing substance. Since the breathalyzer was so close to the limit would that estimation of time elapsed be much more critical? Couldn’t one argue that there would be a margin of error equal to the difference in my percentage and the legal limit?
I was knocked unconscious by the airbag so any noted behavior would not be telling of my condition. I was not drunk by any measure. In the ambulance I was talking very clearly, etc., as I was at the hospital. I felt 100% sober. I have no idea how long I was in there car b4 the police and ambulance got there, again I was totally knocked out.
It was raining, I ran off the road on a curve, my tires needed replacing. Honestly, the alcohol had little, if anything, to do with the accident. When I got in my car to go home I felt totally fine to drive. Not drunk or even tipsy.




Are you a personal injury lawyer?




My girlfriend and I were in an auto accident (I was driving the gf’s car). We were hit from behind, at a high rate of speed, through no fault of our own. Based on a preliminary investigation, the other driver’s insurance company claims she has no coverage. Both the gf and I were injured. I went to the ER via ambulance and was released later that day after doing some tests. I am now in the care of my doctor.

What should I do? I have medical expenses and I’m still in pain as a result of the accident. Would a lawyer be recommended or would I be better off to deal with the insurance company myself?
I’m concerned that if the lady is paying her insurance bills (probably the reason her company says she has no coverage), then it’s likely she doesn’t have many assets/income to go after in court.

I am by myself,and have suffered from complications due to a slipped disc in my lower back once,a year i have a back attack,last year Though painful i still managed to make it to the bathroom,this time I cant stand long enough to go to the toilet,and I am peeing in a bucket,i have no friends or family to help me,and I have no insurance,I tried calling an ambulance before,n i got discharged from the ER and they gave me 5 doses of iv drugs so i would get out..and i spent the rest of my time totally bedridden for over a month….SOMEONE HELP!




Auto injury settlement?




I was in an auto accident a little more than 2 years ago(not at fault). I was taken in the ambulance, and after an MRI was diagnosed with a herniated disc on my L5-S1. I have been in constant pain since the date of the accident and have received just about every type of treatment there is. I have done physical therapy, chiropractor, acupuncture, 2 different sets of injections in to the disc, and spinal rehabilitation. Nothing has worked. My lawyer is suing my insurance under my underinsured motorist for 300,000. And he is also suing the other driver’s insurance for 100,000. How much do you think I can expect?
I was 18 years old at the time, and never had back problems… until then.
I know my medical bills arent going to be too much, because I did have medical insurance with my auto policy for 15,000 which i exhausted. I was also recieving disability checks (I havent been able to work since the day of the accident)from my insurance which also exhausted out at 15,000.




Should I hire an lawyer for my car accident case?




I was recently in a rear end car accident where I was not at fault. I was taken via ambulance to the hospital and given x-rays and was diagnosed with having cervical strain and wiplash. I have no medical insurance (i’m only 21) and my neck is still bothering me. I had talked to a lawyer and he said that if I have him represent me then i can go to the chiopracter and they will pay for is until i settle with the other persons insurance company and add those bills in with my emergancy room bills. So if I don’t hire that lawyer i can’t go the chiopracter but if I do then I can. I know he said he would take 1/3 out of what I get but i’ve herd that you get more with a lawyer. Please help?
Also i was recomended by the doctor (when i went to the E.R.) to follow up with a chiropracter if my neck doesn’t get any better. Again I don’t have a family doctor and I have no money to pay out of pocket for a doctor until i get reimbursed from the insurance co.




Do I need an accident lawyer?




It was my birthday and we were headed out to dinner. My partner and I were stopped at a red light when a drunk driver cut through several lanes of traffic and hit us head on. My truck was thrown back into the car behind us. The offending driver threw the engine in reverse and tried to leave but she was hooked to my truck. I jumped out to get her plate number but she couldn’t go anywhere. Then she left on foot, but was eventually found and cited for DUI, hit and run, and colision.

My partner and I were taken by ambulance to the nearest hospital to be checked out as she was having chest pain and we were both having neck and back pain.

We have been going to the chiropractor since then. (This happened 4/2/8).

I contacted my insurance company the next day and everything is pending.

I am a disabled veteran and I get all my medical done at the VA so I have no private insurance. When I contacted to VA about the accident I was told they wouldn’t pay because I was not seen at a VA.
The drunk driver did not own the car she was driving.
My partner was driving (and covered by my insurance to drive) and I was passenger.
