I recently got a DUI and am going to court on Dec. 7th 08. I have spoken with attorneys and received mixed answers.
Two things that can help is that my Air Force recruiter is going to be there with me, and also I have volunteered myself for Alcohol Rehab.

I have talked to several with no satisfaction.
My situation is thus: Last week I inadvertantly nailed my foot to the floor with, what I thought, was a quality nail gun. After running in circles for aboout an hour, I became dizzy and rammed my head into the doorframe. Thanks to the Para- Medics, I was rescued from what could have been a much more serious fate.
Anyway, all of the attorneys I have talked to say I can’t sue myself for negligence. Why not? I have a lot of money. Why can’t I get some?

The story is far too long and too frustrating to spell out, but I’d like to change my auto injury attorney. We’ve already gone through deposition but because of his misstep, we have to wait another six months before we can get on the court calendar. All of the evidence for my case(surgeon’s narratives, police report, guilty party’s stipulation of negligence, etc) has already been submitted to the State Court in Atlanta. Clearly, we are ready to go to trial but cannot at this point. We are so tired of the lies this guy has been feeding us. His failure to serve one of the defendants until June when the case was two years old(which offers them another six months for discovery) is just the last straw for us. We’re speaking to a couple of new attorneys today but I’d like to know ahead of time what to expect. Can the new attorney pick up where the other left off at or will we need to begin again? Will this move set us back even further? Our attorney has a past working relationship with the defendant’s attorney…they seemed to be big buddies at the deposition which bothered me. Seems like a conflict of interest. What are the chances he will divulge personal information with her upon termination?
Michr- I’m not sure as to ‘why’ we are doing this either. My husband and I do not claim to be ‘schooled’ in the field of law, but with the guilty party’s insurance carrier already giving us the stipulation of negligence (which I have a copy of), I figured we would be settling out of court anyway. Isn’t it the same thing as saying "We accept blame"? I think the sticking point was how they continued to drag out making an offer. The wreck happened on May 09. The primary insurance carrier was served within a few months; my uninsured motorist was also supposed to be added…this is the company my lawyer ‘accidentally’ forgot to serve til this past June. His mistake just costs us one of two things: 1.) We wait six months to get on the court calendar which could take a couple more months, or 2.) Release the suit against our UM policy and lose ,000. I don’t even know how he was able to serve them suit papers considering the fact he went over the two year limit. Maybe there’s a loophole…Id

I am a medical record reviewer/medical transcriptionist, and I am wanting to get into reviewing medical records for personal injury cases. Do attorneys hire record reviewers to review records, or do they have a physician’s office review the records? Any info regarding this would be much appreciated.

I was involved in an auto accident, after almost 5 yrs I was just served with a lawsuit for 100,000. I was 18 at the time of the accident and had full coverage but only 10,000 in bodily injury, loss of wages, etc. I have looked for Attorneys practicing in auto accidents, however, it seems they all want to represent the person suing. What type of attorney do I need to find?

I am having legal issue regarding my immigration since few months. I am unable to sort it easily. One is the attorneys whom i consult ask for huge rates which i can’t afford. The Second thing is that I am very busy with my work and don’t have enough time to go consult a attorney and discuss my issues with them.
The issue is getting very serious now. Would like to have a nice suggestion.

The National Practitioner data bank is a registry of all physicians who have ever had a judgment against them, a suspension of privileges or a licensure difficulty. Should there not be a similar registry of problem patients and/or attorneys?

My 8yr old son is getting $$$ from a lawsuit. The amount is less than 50K, but more than 30K (attorneys fees & costs aren’t calculated).
The Court through which this lawsuit was handled is assuming they will take control of this money until my son is 18. If I allow them to do so, what would they likely do with the money? What type of return should be expected, if any?
It seems that it would be best for me to take control of the money and to learn the best way to invest it for my son? Any suggestions on this?

I was told that the ones that advertise are no good.. so where do I find them if I don’t know anyone who knows one? Do attorneys do pro-bono for DUI’s? Do you think one might do this for someone who was arrested for sleeping in their car?
Sleeping in your car does not indicate that you got there by driving there intoxicated. I got in my car and slept. That’s it.

I’m wondering this because there are many people being forcibly drugged and elelctro-shocked throughout the United States, and the world. These "treatments" can and do cause pain, fear, terror, irreversable brain damage, infertility, and even death among many, many other adverse effects. Do attorneys deal with these issues? Or is it something they avoid for a particular reason?
It reminds me of the joke of an "ambulance chaser"
all these attorney’s have to do is get aquainted with psychiatric survivors, and this would be big bucks both for the lawyers, and for the poor souls who have encountered this institution.
and I forgot to mention, there are plenty of "Reglan" commercials on television these days. It is a heart burn medication, that can cause Tardive Dyskinesia. What most people do not know is many people are FORCED to take anti-psychotic drugs that produce the same thing, Tardive Dyskinesia. I think they are entitled to sue just as much as any Reglan user, don’t you? They were forced to take it, which compounds mental distress, and then leaves the victim with other health issues to deal with and further traumatization.

I’ve spoke with people who say their attorneys did nothing for them regarding their DUI
My blood results returned 0.06, but I was also written up for an open container because I had a grocery bag of food and drinks from my hotel room visit and I had an open bottle of vodka. I was leaving town with my suitcase etc. I was not drinking in my car! I have a small trunk (pt cruiser) couldnt fit all my items in trunk area. Yes now I know I should have put suitcase in car and grocery bag in the trunk because of the open unsealed bottle. I thought officer was just giving me a warning….not so he wrote me up to build his case. Do I need an attorney? Can a Public Defender help me if I plead NOT Guilty ?

Or if I hire an attorney in my area will he/she charge more for whatever travel time they may have to do… I’m afraid the local attorneys will be in cahoots with the local judge and law enforcement.

Hello ladies and gentlemen. I was charged with 1st dui 2 days ago with BAC .21. I do remember everything and I was acting normal. I have consulted a few attorneys and will see 2 more tomorrow. Here is what I have so far. The first lawyer have been practicing for 17 years and says that he actually knows the officer who arrested me this night. I know that it is not that important, because state will still be pressing charges, but it still looks appealing. He handled hundreds of cases(IDK how many were won). That lawyer was chief of the State’s DUI Prosecution.He asks 2k for his service with a payment plan, which suits me because I am short on cash. And the only things I could find about him is 6-7 5* reviews.
Another attorney I spoke too has been practicing(almost all criminal charges) for 30 years and is a former student of my professor, whose references would lower my fees from again 2k to 1.2k.
The attorney which has a decent checkable recordcharges 4.5k, but I just can’t afford it. So, pass.
To sum it up, due to the high BAC, some may advice not hire one, because the case is in deep hole, but I still will.
Finally, I don’t leave much hope for tomorrows appointments, because they are quite the same as first two.
That is the story. Any advice on which lawyer to hire will be helpfull. Thank you.

I was arrested and cited on 2nd DUI + violation of probation from the 1st DUI.
My question is, do I really need an attorney?
The officer had a probable cause to stop me, and my BAC was higher than limit anyway, and they didn’t violate my civil rights in any way.
What can an attorney do for me provided that the law is pretty cut and dry in this case?
I know I will get my license suspended for 1 year anyway, for which I may or may not be able to re-apply after 3 mo IF the new law kicks in – with or without an attorney. I still have to go to 18 mo. DUI school with or without an attorney.
I don’t mind going to jail for 3 days, or community service, or whatever I can negotiate.
Can I get a better deal if I have an atty.?
It seems like attorneys are trying to scare me by saying my case is so complex, blah, blah, blah, and I may have to go to jail…. etc.
I have met lots of 2nd DUI offenders through my DUI school in the past and most of them said they could have gotten the same deal they got without their attorneys anyway.
There is this thing called ‘standard offer’ and it really seems you are going to get that ‘standard offer’ anyway unless your attorney goes to trial, and I don’t believe that any attorney will take my losing case to trial for a flat fee of 00
