info on auto accidents and the insurance?




I would like to know that if your in a car accident after you pip is exhausted can your lawyer have the other insurer pip cover your medical expenses. Also on most insurance policies isn’t the bodily injury coverage any where 100,000 and 300,000. The reason for this question is my insurance company wants me to pay for my shoulder surgery out of my settlement.







I read-ended another car at an intersection. Both of us were stopped at a light. When the light turned green, the other car started moving and immediately slammed on brakes. In the meanwhile, I had taken my foot off brake and hit the car (at < 5mph).

The other party has filed claim for 50 for damages and also for "unknown" amount of bodily injury. There is not even a mark of any collision on my car (as the speed was low). My insurance company has agreed to their claim related to damages and is waiting for the exact amount for the bodily injury claim.

This has been quite unfair to me and will definitely bump up my premium like crazy.

Is there any way I can challenge my insurance company’s appraisal of the damages ? Are there any other alternatives ? What kind of evidence would I need to furnish for the same ?

We had called a "Cop" to report the accident. I wanted him to note that the impact was at < 5mph. However, he refused to do that saying that this would be left to insurance
Well… Folks, thanks for the answers. As I said earlier, I am not denying that I was at fault and neither is it my intention to ignore the impact on the other car/driver.

The other party had actually contacted me to settle this privately and we had agreed for me to hand out a certain amount. The day I was going to hand over a check, I just happened to call up my insurance agent and learnt that the other party had reported the accident 5 days ago. So in worst case, I would have still paid the check and also had gotten an acci. reported against me.

Shady dealing like this on other party’s behalf and knowing the speed/magnitude of impact makes me believe that the other party is just trying to extract as much as possible out of this.

Again, my car had absolutely no damages (even minor). So it is difficult to believe that the damagaes to other car are worth 50 and bodily injury is completely out of question. (People dont get injured if another car TOUCHES their car) Arhhh… Patheti







Knowing that if you’re hit by an uninsured motorist and get your car totalled the motorist will declare bankruptcy and you won’t get a dime. Before you say anything, uninsured motorist coverage only applies to bodily injury.







My wife hit a car that was in her blind spot. It was a minor accident with couple of scratchs and no bodily injury.So the other driver offered to settle outside insurance and police werent informed. My wife paid 0 in check and no other information has been exchanged. Can they comeback and ask for more money or can they file a claim??







I am the victim in a collision and the driver at fault has insurance. In TN, all auto insurance policy holders have a minimum bodily injury coverage of claims up to ,000 per individual and ,000 per accident. My medical bills are getting very high, so my question is: Can I claim up to the ,000 limit because I was the only victim, or is my limit ,000?







I have a coverage of 20/40/15. I was at fault in an accident (nothing serious). Besides my vehicle, two other vehicles were involved in the accident. There was only the driver per each of the vehicles. Up to how much bodily injury will my insurance cover for those two people?

So far, I’m told by an orthopedic specialist that I have a compression fracture in my lower spine. The cause was an auto accident. I was a trucker with Schneider National. I drove as a team with another driver. I was asleep in the bunk, as my partner was driving, when a pickup truck went left of center and hit us nearly head on. We were both traveling at 65 MPH. We managed to escape before our semi burned to the ground in a matter of minutes. Two of the four occupants in the pickup truck were killed. We lost all of our personal property in the semi, of which ,000 worth was mine. The other party only carried a ,000 auto insurance policy, both property and bodily injury. Schneider National is taking most of it with a 0,000 claim. I currently have a worker’s comp. attorney, but I don’t have any idea what sort of settlement will be reached at this point. My back pain has been consistent for the past 6 months and seems to be worsening.
I am also unable to return to driving or perform any physical labor. The accident happened in Kansas and I live in Ohio.
Also, the insurance company of the other party is only offering 0 for my property.

And… If the doctors at the occupational health facility that I was first sent to by Schneider had properly diagnosed my condition, it could have been repaired, according to my orthopedic specialist.







I was involved in an auto accident, unfortunately it was my fault. The property damage claim has cleared, however there is still the bodily injury claim pending. How long will this take to clear? It was a minor accident. The guy looked okay and everything, and said he was fine. Unless he started feeling pain the next day, that’s the only reason I could think the bodily injury is still pending.

The accident was in Florida (location wouldn’t make a difference though since it’s the state where the policy was written that determines the coverage, not the location of the accident), I was treated for about a year and a half. No medical assistance was done at the scene.
I already have a lawyer handling this. I’m ready to settle or I wouldn’t be asking this question.







I was recently in an auto accident where I sustained serious injuries and my car was totalled. The other party is 100% at fault and has admitted that, and their insurance company is offering to pay the max amount of their policy on bodily injury (they have minimum coverage, so their policy in GA is 25K for bodily injury and 25K for property damage). The 25K they have offered as the policy limit for medical does not come close to paying my bills. Out of the 25K available towards property damage, they have paid 7K to my insurance company for totalling my car (my insurance company paid me the 7K while we dealt with establishing fault) and they paid me 00 towards the items in my car that were destroyed as a result of the accident. Is there any way to get them to pay me the difference between the 25K available towards property damage and the 00 they have paid out, as that money would make a huge difference towards the medical bills I am going to be out of pocket on.
I tried filing underinsured motorists with my insurance company – apparently you can’t do that in Georgia. I do have uninsured motorists, but they have stated that I can only use it if hit by someone without insurance, if they don’t have enough I’m out of luck. I went through multiple layers of management at my insurance company trying to get them to cover me but they pretty much said no.
I have the maximum coverage possible in GA – underinsured motorist is not even an option on the policy or I would have already had it. (Ironic isn’t it that a maximum coverage person is hit by a minimum coverage person). The release I would have to sign to take the 25K states that I release both the other insurance company and the driver from any future litigation, etc. – I assume that means I can’t sue them personally (though from what I’ve been able to learn about them they have nothing to go after). I am curious as to if this means criminal charges cannot be pursued – this was initially a hit and run accident and I believe the police are going to charge the driver with running. Even though they were found and owned up to what they did I don’t want my taking the 25K to release them from that legal liability as well.
There is a separate, ongoing criminal investigation going on related to this accident due to it being a hit and run – the other driver thought I was dead and ran. That is separate from the insurance issue.







i am going to buy an auto insurance and people told me that it is not that much important to have Uninsured Motorist Bodily Injury coverage since i have a medical insurance. is there any one that have an idea thank you







Has used his state farm policy and is now going after mine. he walked away 70 days ago just fine. i even drove by his residence a few times and he l ooked just fine also. this is a moral point for me. you have to stand for something or youll;; fall for anything. i cant stand the thought if my insurance also state farm ends up paying out. not because my rates would go up; obviously wouldn’t like that. but here in south florida , people from other nearby countries are always pullin this. should i try to round up possibly neighbors of his, co workers if i can figure out where he works, and any local businesses he go to to prove he is not and was not hurt.
However he did use his liability/bodily injury first. does that mean he just paid his deductible. never understood auto ins.
it eats at me that visitors, whether they become permanent U.S. citizens come here to use our country. serious inquiries only. sorry if offended anyone but i do have my American right to opinion.







Is medical for the med bills the other party receives & bodily injury is for the settlement of the claim, pain & suffering and the settlement of permanent residuals? Thanks




How long to settle an injury claim?




I am wondering how long it usually takes for insurance companies to settle auto bodily injury claims. I rear-ended a driver at a stoplight at about 5MPH back in July. He complained of no injuries at the time, officer noted no injuries. Anyways, he later made a claim against my policy, and my adjuster said it is still unresolved (been about 3 months now).

Is it normal for it to take this much time, or am I about to be taken to court? My insurance apparently covers to 0,000.
