The story is far too long and too frustrating to spell out, but I’d like to change my auto injury attorney. We’ve already gone through deposition but because of his misstep, we have to wait another six months before we can get on the court calendar. All of the evidence for my case(surgeon’s narratives, police report, guilty party’s stipulation of negligence, etc) has already been submitted to the State Court in Atlanta. Clearly, we are ready to go to trial but cannot at this point. We are so tired of the lies this guy has been feeding us. His failure to serve one of the defendants until June when the case was two years old(which offers them another six months for discovery) is just the last straw for us. We’re speaking to a couple of new attorneys today but I’d like to know ahead of time what to expect. Can the new attorney pick up where the other left off at or will we need to begin again? Will this move set us back even further? Our attorney has a past working relationship with the defendant’s attorney…they seemed to be big buddies at the deposition which bothered me. Seems like a conflict of interest. What are the chances he will divulge personal information with her upon termination?
Michr- I’m not sure as to ‘why’ we are doing this either. My husband and I do not claim to be ‘schooled’ in the field of law, but with the guilty party’s insurance carrier already giving us the stipulation of negligence (which I have a copy of), I figured we would be settling out of court anyway. Isn’t it the same thing as saying "We accept blame"? I think the sticking point was how they continued to drag out making an offer. The wreck happened on May 09. The primary insurance carrier was served within a few months; my uninsured motorist was also supposed to be added…this is the company my lawyer ‘accidentally’ forgot to serve til this past June. His mistake just costs us one of two things: 1.) We wait six months to get on the court calendar which could take a couple more months, or 2.) Release the suit against our UM policy and lose ,000. I don’t even know how he was able to serve them suit papers considering the fact he went over the two year limit. Maybe there’s a loophole…Id

What happens after a DWI?

Well I had a few beers 3 months back at my buddies house one night, I had stopped drinking and waited about 2 hours before driving home, ended up going through a sobriety check-point and blew a .023 (I’m 19 so the legal limit for minors is .02 in Missouri). After doing the SATOP classes the court decided I needed to pay a dollar re-instatement fee and get an interlock device on my car (it makes you blow and measures your BAC before your car will start). After that I will get a 60 day temporary license, but my question is, will I get my regular license back? How will all of this affect my record, I’ve tried calling my lawyer but he dodges my phone calls these days.

my husband was in an auto accident in July 2005. we had an attorney and have found out that he dismissed the case back in August 2007 without notifying us. we are in need of an attorney to help us get back into the case and maybe even to sue the attorney which failed us. please some has to have a real answer here calling bar is useless they all buddies and do not want to take the case. this attorney did not inform us for any of his dismissal actions and my husband was service us in Iraq and I really need some help on this matter

Arrested for DWI in non-moving vehicle??

I was out the other nite having a few drinks with my buddies. I got in the car and started to drive home. At first I seemed OK, but then I realized I was drunk and can not drive. So I pulled out of the first exit I saw and pulled into a McDonald’s parking lot. I ‘d figured I’d rest and sober up. I fell asleep in the car and was awoken by an officer tapping on the window. He asked me what I was doing. I told him I was resting because I was drunk and couldn’t drive home. I told him I came from a bar that was about 1/2 mile away. He’d asked me to take a sobriety test. I said I’m drunk and too tired. Its about 3 am. He then cuffed and took me to the station. I took a BAC test at the station and blew 0.18. Now this is my first offense ever. I’ve never been arrested, I had only 1 speeding ticket in the last 5 years. I made a terrible mistake that night thinking I was able to drive home. Should I hire a lawyer? The officer didn’t see me drive at all. How does it look for me?
I live in the state of MA. The arrest took place in NH. There is no citation # on the order and condition of bail. How much would a lawyer be for this type of case?
