I was in a minor auto accident. It was the other drivers fault. I was injured. I went to the ER the day of the accident and they said it was cervical strain from where the seatbelt lock so tight onto my neck and shoulder. 5 days later it was really bad,went back to the ER, was told that I was having a muscle spasm that would not let go. Now it is 2 weeks since the accident and my neckand shoulder are still sore. The at fault drivers insurance company called and wants to settle the claim.They want to pay my hospital bills and give me 0 for pain and suffering. I didn’t know they did that. I thought you had to get a lawyer if you wanted money for pain and suffering. I have never even considered getting a lawyer because it was just a minor accident. I was just wondering if anyone else has had this problem. Should I take the 0 or do people normally get more then that. I have never been in an accident before. If it matters the Hospital bills are almost 00 and meds were







I was involved in a accident in which I was hit in the front & driver side I was driving an older blazer so It didn’t sustain much damage (00) However the at fault driver was in a much smaller auto that was totaled.My Knee had ruptured blood vessels, Meniscus tears, swelling,Bruising & severe pain, it Buckles & in 1 incident It caused me to fall injuring my knee even much more, I also had mild cervical strain,Right ankle sprain & upper & lower back pain. My PCP referred my to an orthopedic specialist, physical therapy & chiropractor. I have been in treatment for 22 weeks and have been released by PT & Chiropractor, to go back as needed.released by Ortho specialist to return for injections to knee as needed or other possible treatment. I continue to have pain & can’t sleep on right side but am considered as good as i will be. Also in the accident I had my 13 year old son with me who was thankfully not injured, but I drive him to & from school every day, during the 1st few weeks I could not drive and had very limited mobility. What would be a good settlement for these injuries?
The insurance company has paid to have my vehicle repaired. My Health insurance is paying for my medical bills but its my understanding that I will have to pay them back after the settlement.
What kind of injuries would these be considered? (Soft Tissue)?

My fiancé’ & I were rear-ended Monday by someone exceeding the speed limit by 80mph. We were going about 15 mph (just pulled out and got straight in the road) The other person was doing 125 mph when we were hit. It of course totaled my car and unfortunately the other driver did not survive. I still owe about 00 on it so I am sure I will get that much for it. Their insurance company took fault of course & got me a rental car for 70 days. I went to ER that night & all x-rays were ok. I was released w/a cervical strain & a thoracic strain & a knee strain. I have only slept maybe 8 hours total in 4 days, everytime I close my eyes I see the accident, I am working b/c I can’t afford to stay out but my production is going down hill b/c I can’t focus. My neck pain is getting worse & my back as well. I went to doctor yesterday & he basically said I had strains & muscle spasm that should go away. He gave me anti-inflamtory meds & something to help me sleep but that hasn’t worked yet,
last night I still didn’t sleep, and when I do I have nightmares of the accident. My fiancé’ didn’t get hurt but he has images as well so he is going to doctor to help him rest to. We both saw the person be ejected out of the vehicle and fly in front of our car. It’s horrible. People are telling me that I can get their insurance company to give us the value of the car and still be able to settle with the medical later. One is that true? Next question, everyone is telling us to get a lawyer b/c this “post traumatic stress syndrome” that the doc told me I had could last forever and I may always have problems with my neck and back. I need help; I have never been through this before. Please tell me ups and downs and what’s the best way to handle this? At first I
didn’t want anything except to get another car. But as times goes on I am so mad that this person was traveling this fast in a 45 mph zone. Our car that was totaled was my fiancé’s late aunts. He wanted to always keep it
because of sentimental value & also so that when we got it paid off we could also use the title for collateral…which we can’t do now. Any advice will be much appreciated. Thanks in advance.

I’ve never been involved in a rear-end collision. As superficial as the damage appears to be to both vehicles, I sustained a whiplash injury. Of course the at-fault driver’s insurance company doesn’t want to acknowledge the injury and are asking for authorization to obtain medical records.
I’ve never had to see a doctor for anything other than my annual visits to the gynecologist so there are no records with my primary physician on record other than this injury. Do I also need to provide them the release for my gynecology visits? I don’t want to jeopardize my claim for the injury by not doing so. But it seems rather silly that they might need to know how my pap smears have checked out and that I’ve birthed two children.
My injury is the basic cervical strain with an inflamed C7 for which I’m taking anti-inflammatory meds. I can’t sit in the same position very long before I get spasms in my middle back and a stretching burning sensation in my neck and middle back. But they don’t seem to think this is possible and are discouraging me seeking treatment saying they wont pay for anything they do not feel is "warranted."
I realize they must have to deal with a lot of people who cry wolf for monetary gain. But I have to deal with these painful sensations every day.
I live in Illinois and I do not have a clue what I should do to protect myself and make sure I’m able to get the care I need.

Just to be clear, I have been to a doctor twice. Once just after the accident in an urgent care facility and once to a specialist in my primary doc’s office with whom I am continuing to see for follow ups. My question is, I guess, whether they also need a release for my gynecologist visits and how to handle the claim if they do not acknowledge the injury. The adjuster said it would be hard for me to prove the injury was caused by the accident because the damage appears superficial. I should add I was at a complete stop when the guy slid into me due to the icy roads. It seems his bumper went underneath mine.
Yeah, I’m not worried about privacy issues rather I just wasnt sure if they needed my girl doctor records. I don’t care if they have them. I just want to handle things correctly.







The police were notified promptly, I was taken to the E.R and initially diagnosed with whiplash, after going to a chiropractor he told me I had a grade 3 cervical strain/sprain with some pretty bad damage to my right shoulder and upper spine. I was working when this happened, we go house to house cleaning and it happened while we were going to another site. I did file workers comp and got a lawyer right away. After almost a month after it happened I am still having alot of problems with pain, it is affecting my performance at work. How much money can I get from this accident with a lawyer and how long will it take to actually see any money from this?

I was recently in a rear end car accident where I was not at fault. I was taken via ambulance to the hospital and given x-rays and was diagnosed with having cervical strain and wiplash. I have no medical insurance (i’m only 21) and my neck is still bothering me. I had talked to a lawyer and he said that if I have him represent me then i can go to the chiopracter and they will pay for is until i settle with the other persons insurance company and add those bills in with my emergancy room bills. So if I don’t hire that lawyer i can’t go the chiopracter but if I do then I can. I know he said he would take 1/3 out of what I get but i’ve herd that you get more with a lawyer. Please help?
Also i was recomended by the doctor (when i went to the E.R.) to follow up with a chiropracter if my neck doesn’t get any better. Again I don’t have a family doctor and I have no money to pay out of pocket for a doctor until i get reimbursed from the insurance co.

should i get a lawyer for car accident?




i was a passenger in car that was rear ended at a red light. the vehicle who hit us was speeding and got a citation. i was taken to emergency by ambulance at the scene. i was out of state (california) at the time. i was diagnosed with cervical strain. i returned to my home state (new jersey) where i saw my own physician. he sent me back to emergency where i was diagnosed with severe cervical strain and bruised ribs. i have been sent to physical therapy for my neck, 3 times a week for 4 weeks. hopefully that will be all i need.
i don’t really like to sue people but i sure would like to see all my medical bills paid and some pain and suffering. i do not work so i have no lost income. should i just negotiate with his insurance company or get a lawyer who would get 33% of any settlement. how much would my pain and suffering be worth? my medical bills will be 3 or 4thousand dollars and my out of pocket expenses will be about 0.00.
