I got a DUI on Nov. 5th…went to court in Clinton County, Ohio on the 8th and waived my right to an attorney and just plead guilty so I could just get my punishment over with. The judge sentenced me to 90 days in jail, fines, and license suspension…everyone else there for a DUI plead not guilty after they saw me get sentenced to that. After everyone left the room, he told me that he would give me a chance to do a drivers intervention program and that it would count as 3 days toward the jail sentence and that I would return to court in March to review my sentence and my assessment through the DIP. He stayed (postponed) the sentence and fines until then. I got my license back a couple of weeks ago and i recently wrecked my car when it was all snowy out and got a failure to control citation…this is a basic traffic violation. What is the likelihood of me receiving jail time?







my girlfriend was in an accident, the other driver was cited as driving at unsafe speeds in 25mph zone based on 65 feet of skid marks and a witness statement to police. my girlfriend was pulling out of a alley (right hand turn) and he came up over the hill down towards her. Once he saw her, he slammed on his breaks, skidded into her. cops estimated he was doing 80. My son and girlfriend both injured. He is fighting the citation and his insurance denying fault. I took pics of car, son injuries and accident scene. any advice







The other party failed to yield the right of way entering an intersection. She was issued a citation for the accident and has current auto insurance. My wife suffered first degree burns on her arms and also back and neck pain. Her vehicle looked totaled with the front end completley caved in. Her vehicle is a 2004 Nissan Exterra with 40000 miles and it was almost paid off. We live in TX. My questions are… How much would she recieve to replace her car? Will she get a rental car to drive in the mean time? How long till this gets resolved? Should we expect a settlement for her injuries, lost wages, hospital bills? and should we look into hiring a personal injury lawyer or just let the insurance company handle it? I’d appreciate any insight thank you.

Horrible part is it happened the day before my restricted license were to be issued to me. Is jail time a mandatory penalty? What are the odds of me avoiding jail time if I hire at attorney?

i am assuming this paperwork went to the Custody Judge as well as my sons Gaurdian Ad Litem.It is a Citation for driving under the influence,as well as refusal to proceed with sample for alcohol testing.Problem is,it is NOT MY CITATION!!
I have NEVER been arrested for a DUI,and it isnt even my name on the citations!!!
Would I have a case to sue my wifes attorney for slander and emotional damges for slipping in DUI arrests into my case where if a concerned person such as a judge flips through it and doesnt take time to see the person named on the citation isnt me,will just assume i am a drunk driver?What can I do?

Arrested for DWI in non-moving vehicle??




I was out the other nite having a few drinks with my buddies. I got in the car and started to drive home. At first I seemed OK, but then I realized I was drunk and can not drive. So I pulled out of the first exit I saw and pulled into a McDonald’s parking lot. I ‘d figured I’d rest and sober up. I fell asleep in the car and was awoken by an officer tapping on the window. He asked me what I was doing. I told him I was resting because I was drunk and couldn’t drive home. I told him I came from a bar that was about 1/2 mile away. He’d asked me to take a sobriety test. I said I’m drunk and too tired. Its about 3 am. He then cuffed and took me to the station. I took a BAC test at the station and blew 0.18. Now this is my first offense ever. I’ve never been arrested, I had only 1 speeding ticket in the last 5 years. I made a terrible mistake that night thinking I was able to drive home. Should I hire a lawyer? The officer didn’t see me drive at all. How does it look for me?
I live in the state of MA. The arrest took place in NH. There is no citation # on the order and condition of bail. How much would a lawyer be for this type of case?




Question about DUI/DWI.?




So a friend of my just got a DUI. After he told me the story I couldn’t stop laughing but it made me think.

He and another friend were at a party. My friend is 19 and his friend that was driving was 22. Long story short, they pull into a gas station so the 22yo can grab some smokes. While he’s in there, he leaves the car running and my friend in the passanger seat who is sleeping. A cop pulls into the gas station, wakes my friend up and gives him a breathalyzer. He blows a .12 and the cop give’s him a DUI.

The actual driver of the car comes back out, blows a .03 and doesn’t receive any ticket or citation.

Several questions:

1. How in the world can this be a reasonable search and seizure, he wasn’t making a scene or causing problems, for godsakes he was sleeping. Not sure why the cops even decided to bother him.
2. Since the security camera tapes will show he never got out of the car and that the 22yo was driving, how in the world can they give him a DUI?

This is in MN if it makes a difference. He’s going to talk to a lawyer today. Any questions comments concerns. Thanks!
The thing I’m reading also is that in MN the courts have to show that the person had the intent to drive. Since that’s clearly missing in this case I’m thinking he has a shot of getting out of this.
I know we’re splitting hairs here but it’s not illegal to leave the car running as long as a licensed driver is in the vehicle.

He had to go to work but hopefully sometime tonight I’ll get the info on what the lawyer said. I’m finding this fascinating (probably more so since its not me hahahahahah).







I was involved in an accident that will probably leave my car totaled. Myself and a passenger in my car were taken to the hospital by ambulance so there are medical bills involved and there may be on going medical bills. Both drivers are insured. The other driver received a citation that seems to show the reason why the accident occurred. Should I get a lawyer?







I was recently in an auto accident caused by someone else running a red light. I plowed into them as I went into the intersection. It was my first accident and there were a few things I failed to do at the scene, but the authorities pretty much handled all the info. I also did notify my insurance company right away. Anyway, the other party was very quick to argue that I ran the red light and said she was injured and was hauled off in an ambulance. She wouldn’t even talk to me except to argue that it was my fault and rolled up her window. I also believe she was on her cell when she ran it, but can’t prove it or anything, except that it was already up to her ear after the impact. The other thing that stinks is that all the people sitting in their cars at HER red light she ran never stuck around as witnesses. I did have a passenger in my car who does agree my light was green. Anyway, I wasn’t hurt, the front end of my car is wrecked and now leaking oil. I wasn’t at fault and am afraid that, without witnesses and because she was injured, she’s going to come after me in a "he said, she said" battle. Do I need a lawyer? Every time I search for car accident lawyers they always come back with "personal injury attorneys". I am not injured, so what do I do?
There is no police report as of yet and no one got cited at the scene. People I spoke to about the citation thing were confused as to why no one got cited (and being my 1st accident I wouldn’t know either), but one person told me it was possibly because the police have a way of checking to see who was at fault. Possibly with cameras at the intersection? I nor my passenger didn’t notice any there though.

should i get a lawyer for car accident?




i was a passenger in car that was rear ended at a red light. the vehicle who hit us was speeding and got a citation. i was taken to emergency by ambulance at the scene. i was out of state (california) at the time. i was diagnosed with cervical strain. i returned to my home state (new jersey) where i saw my own physician. he sent me back to emergency where i was diagnosed with severe cervical strain and bruised ribs. i have been sent to physical therapy for my neck, 3 times a week for 4 weeks. hopefully that will be all i need.
i don’t really like to sue people but i sure would like to see all my medical bills paid and some pain and suffering. i do not work so i have no lost income. should i just negotiate with his insurance company or get a lawyer who would get 33% of any settlement. how much would my pain and suffering be worth? my medical bills will be 3 or 4thousand dollars and my out of pocket expenses will be about 0.00.
