Saturday night I wrecked my car. I was with a friend, he ran away. A cop stopped me and breathelized me I blew a .185. I spent 13 hours in jail. It was so scary. I have a 4.0 at A&M, I’m a good student, nothing like this has ever happened to me. I feel like this is the end of the world, I’m hopeless and I don’t know what to do. I know I need to find a good lawyer, I don’t even know how to go about this situation. I made a huge mistake please don’t remind me of that. Any advice, support, similar situations. Anything would be helpful. I’m so lost.

Well my nightmare has come true, My oldest son (20 yrs old) who is in college,works full-time & has never been in trouble before decided to go to a party out of town w/a couple of friends, A fight broke out so he’s trying to find his friends, They are nowhere to be found so he took off, He knew better than to drink and drive! We have had many talks about it! So as he’s trying to set his navigation to get home, There go the police lights! We got a lawyer & saw the video, He doesn’t appear drunk in it, But he amitted to the cop that he had a few! Is there any advise anyone can give us on this? He’s never been in trouble before, He takes full resposibility for his actions and is very ashamed by them. What’s gonna happen next? He can’t even drive until we go back to court & they give him back his license, I know this is a bad offense & I thank God no one was hurt! But will he be able to recover from this? He wants to be a school counselor.
You can say that you hope my son gets the book thrown at him but if it were your son you wouldn’t be saying that! I guess you never made any mistakes throughout your life? And he did not take any test!

I had 3 glasses of wine (on an empty stomach. I hadn’t eaten for 6+ hours. My friend and I were there for probably 4 hours. She walked with me out to my car and she later said that I walked in a straight line and didn’t have slurred speech, etc. She would have stopped me if she thought I couldn’t drive. On the way home, I get pulled over for speeding. The cop asked if I had anything to drink. I told him a few glasses of wine. He makes me do the sobriety tests on the side of the road. I am pretty sure I passed them all, he made me do all 6 (which my lawyer said probably means I did ok on them) and did the breathalyzer. I got arrested and was told my BAC was at .17! No way! I would be falling down if I were that intoxicated! In NY the machines are calibrated to not take into account age, sex, size. Also, I am in the middle of dental work, so it’s very possible I had "mouth alcohol" which from what I have read can double your BAC. Opinions? No judgement please, I know I did wrong

So a friend of my just got a DUI. After he told me the story I couldn’t stop laughing but it made me think.

He and another friend were at a party. My friend is 19 and his friend that was driving was 22. Long story short, they pull into a gas station so the 22yo can grab some smokes. While he’s in there, he leaves the car running and my friend in the passanger seat who is sleeping. A cop pulls into the gas station, wakes my friend up and gives him a breathalyzer. He blows a .12 and the cop give’s him a DUI.

The actual driver of the car comes back out, blows a .03 and doesn’t receive any ticket or citation.

Several questions:

1. How in the world can this be a reasonable search and seizure, he wasn’t making a scene or causing problems, for godsakes he was sleeping. Not sure why the cops even decided to bother him.
2. Since the security camera tapes will show he never got out of the car and that the 22yo was driving, how in the world can they give him a DUI?

This is in MN if it makes a difference. He’s going to talk to a lawyer today. Any questions comments concerns. Thanks!
The thing I’m reading also is that in MN the courts have to show that the person had the intent to drive. Since that’s clearly missing in this case I’m thinking he has a shot of getting out of this.
I know we’re splitting hairs here but it’s not illegal to leave the car running as long as a licensed driver is in the vehicle.

He had to go to work but hopefully sometime tonight I’ll get the info on what the lawyer said. I’m finding this fascinating (probably more so since its not me hahahahahah).

About a month ago I was coming home and got into an accident hitting a light post. I was still able to drive my vehicle home and nobody was hurt. When I got home, my friends and I began to drink heavily. An hour or so passed and a cop showed up at my place because someone had called in the accident. The cop took me downtown and gave me a breathilizer. I blew .23, so obviously i was over the limit, but I wasnt driving, i was in my home. The cop arrested me for drunk driving and i went to jail. I was released without being charged, but i just found out today, almost a month later, that I have been charged. I am in the processes of finding a lawyer, but can they really charge me when I wast caught driving? I dont thinlk this case will hold up, what do u think? I honestly beleive that I was under the limit when i was infact driving, and how can they charge me with my BAC when I was obviouosly drinking alot at home? does anyone have an opinion?

The lawyer says the video did not look too good.Been paying him 0 every month since march till now.I did not fall or anything but could not perform test well and there was an accident No injury.Had problem communicating with the cop since i am an immigrant.Any ideas?Thks

march 22, 2008 .I was leaving the beach at Port Aransas Texas on the last saturday of spring break , when a truck struck my car when he was reversing and left it unmovable , im checking out the car when a cop tells me to wait on another that is on his way for me.the other police officer tells me to get inside the car on the paseenger side. im thinking he is going to help me get some help to take my car out of the sand, or contact family . he drives me to the station and performs field sobriety test’s (only two at that) then arresst me for dwi . i had to wiat one month for me to get a accident report after bonding out , becuase the "officers" that were at the accident were all on "vacation". now im waiting court for the dwi 3rd offense that makes it a felony .. (im only 19 ,doesnt everyone expierment with drugs at this age?) now the at fault insurance company wants to only cover 80 percent ot the damages which are more than 3000 dollars . i allready piad my lawyer 4000 dollars.help!

So, this whole weekend was a huge mistake. I don’t drink. I’m under 21 and I have drank maybe once in the past year or so. I’m a university student and graduated at the top of my class… I’m just not drinker or a bad person at all. I just really need some answers right now…

So, when the cop pulled me over I was on my phone. I got pulled over for not being able to stay in the lane. I was already crying and nervous so I told him I was scared (I really was) for my sister who I had gone to pick up from somewhere I was lost and couldn’t find her (i was in a different city). I was crying the entire time and telling him I had to get my sister.. he was just ignoring everything I said as usual. He asked for my ID. I have a car where the trunk pops up after pressing my unlock button for like 5 seconds, I was crying and all so I couldn’t open it.. I had to do it manually.. I did it and then he began asking me to do the tests so I began and I did 2, the eye one and the step in front of each foot and count.. I did that also.

I honestly can’t say if I failed or not, but after that, he told me the last test was to blow. I refused that since my friend I had been on the phone with has a mother who is a cop and before I got off the phone, she told me that whatever I did, to not blow. After that, the cop started being rude, of course.He sat me in the front and put the camera in my face and the light. I kept pushing it away and he got mad but why would u even sit me in the front seat!?

Then at the police department, he asked me to sign a paper. I asked him to let me see it cause I wasn’t just going to sign things I didn’t know. He kept telling me no.. thats when i got mad and said "i’m not fucking signing anything I’m not going to fucking read!" and he got mad and denied me the phone call and put me in the cell.

I got a DWI with open container. I had told him my sister’s friends and my sister had been in my car and the bottle was behind the drivers seat but I know I am underage to begin with. I just want to know what now.. I know the cop was probably very angry and I am going to get a lawyer but I mean, is there a chance it will be lowered down to a pi since I didn’t blow?

I was arrested for DWI because I was sleeping in my car after having a night out with some friends. I was a little tipsy but I still did not want to drive until I had some time to sober up. While sleeping a cop pulled up to get something to eat at a restaurant that I was parked near and noticed me in the car asleep. I heard him knock on my window but apparently did not respond as quickly as he wanted so he opened my door and had me step out of the vehicle and then arrested me after I refused to speak with him. Is there anything that I can do about these charges.

The video does not show him entering my vehicle without permission but his report states that he did so. Also the keys were in the ignition when the cop arrived. I have a lawyer now and he is looking over the charges.

so i was driving i am 20 years old about to be 21 in a month and live in New York. i got pulled over, the cop said the field breathalyzer was not admissable in court (plus i know u automatically get charged to refuse) so i blew into it an .08 came up. WHen we got to the station i blew into the "official" machine and blew a .06. i was reading up and it said that anything above .05 and below .07 is a DWAI yet i was still charged with a DWI misdemeanor as well as a DWAI. Did something go wrong and is that on the spot breathalyzer admissable in court (keep in mind the cop told me it wasnt but i dont know if thats true or not)? Also, will a lawyer really help me out at all?
the on the spot breathzlyzer im refering to is the one he gave me on the street before taking me into the station. is it admissable in court?

A friend received a ticket for DWI (.16) in NY State in August 2008. She just went to court and claims they totally dismissed it on the first court appearance because the cop did not show for court. Is this possible? A total dismissal because the cop didn’t show?

I was recently involved in an car accident. My tire in the back blew out and i lost control of my car and spun 180 and hit the guard rail and spun another 180 and thats when the front tire blow out . traffic was pretty heavy, luckily i didn’t hit anybody and still breathing after everything was done. I called the cop and he came out and gave me a ticket stating that i "failed to stay within lane" and it’s marked down as an accident, .

Nobody is at fault here,- tires blew out unexpected, I have only 1 way insurance, my car is totaled and i will not get anything for it. on the other hand, my insurance is still investigating on if they should pay for the medical for the people in the car or not. There were 5, full car. We are currently going to the chiropractor for our treatments, the doctor said no need for a lawyer because he can handle all the paper works,. Should we get a lawyer for this case to get the maximum amount of compensation and can i really fight the ticket issued?
after getting home, i found that the tire that blew out first was a bad tire… havent change it in a while.

never been in trouble, DA claims to have a witness but he cannot be found by my lawyer. DA offers 1 yr probation. How bad is it? I was not even in the possession of my keys when cops arrived. Cop had to get them from another person at the scene. My lawyer wants to fight it, what options and does a class B misd really ruin your future?

I heard that it completly comes off your record after ten years, is it still possible to become a cop though? My lawyer even told me, that if I play my cards right, that my DWI won’t even show up on my record. And, if it does, i could be completly off in two years. I have a hook up with a lawyer.
