I would like to first thank you for even reading my story. Ok, so this is how it started, about a month ago i was driving out of san jose area heading back to 880 north and got pulled over by a cop because i had no license plates on my car, but the car was registered and all that. The officer asked me few questions about the license plate and his buddy officer on the right hand side asked me if i had any drinks, and i said yes around 11:pm at a bar in san jose, and this is now 2: pm.. So i stepped out of the car and did all the practices they made me to do so.. I was 100% active and completed all the chores without hesitation.. Any way long story short they locked me for 6 hours and took my license.. I called DMV withing the 10 days of hearing and the DMV hearing department issued my license until the "June 10 2011".. I the breathalyzer showed .09 and so did the blood test.. Please tell me what i should do???My court date is coming on the 8th of this month.. Should i plead guilty or should i plead not guilty?? If any one has gone through this situation before, then i would love to hear back from you.. I am a full time student and it would be very hard for me to face the charges and timing.. I recently got charged with a DUI in Arizona. I have hired an experienced attorney to represent my case. My DUI did not involved any serious damage or accident. I dont even think the cop had a probable cause to stop me because I did not have any traffic violation. My BAC was 0.09. I would like to know what is considered as a weak evidences or an example of a weak case?

If you,ve been on trial for murder and found not guilty, but have a DUI conviction, can you be a cop?
Can a person work in the criminal justice field(corrections, parole, probation, attorney, or any law enforcement capacity) , if this disqualifies them from being a police officer. Does this still disqualify a person from being a police officer if this happen 15 years ago, why or

I was in a car accident where the other driver made a left turn on a red arrow;I had a green light. I couldnt see to my left because the other cars saw this car & stopped but at da same time da car on my left blocked my view. mind this–the intersection, or street on both sides is a 4 lane street each. This driver was trying to make it on a yellow arrow I guess, since the distance is wide, by da time he got to me I didnt see him so I proceeded since it was a greenlight for me-he & I collided-he ripped off the whole front end of my car. I have an ’08 nissan pathfinder-Now my car is sitting in a shop,as 4 the accident i didnt get cited HE DID; there was witnesses bt da cops dealt with them-my car had to be towed away as it was not drivable-now that his insurance contacted me after i called them & took my recorded statement, i am getting a lawyer as he is arguing it was green 4him-is da recorded stmt going to affect my lawyer taking on the case?should i have kept quiet? PLEASE HELP!
ok about my insurance-i contacted them-they told me if he was at fault that i had to contact them-they are not being helpful and saying oh we will take care of you*** i have to be the one calling-and i got a lawyer or trying to because its his word against mine- i mean i dont have the witnesses names or anything-the cop dealt with them. that is why-but i will know for sure on monday if the lawyer will sign on my case or not-and his insurance says i have to wait for them to speak to the witnesses etc..and then they will start a claim process-since the guy is not admitting guilt!!!

so i dont know why ppl are telling me that the insurances will deal with eachother, when my ins is telling me to keep calling the at fault’s insurance. maybe its just an arizona state thing?

I WENT TO MY INSURANCE AND THEY TOLD ME WHY DO YOU WANT TO DO IT WITH US? YOU NEED TO PAY YOUR 750 DEDUCTIBLE. SO THEY WILL NOT TAKE IT INTO THEIR OWN HANDS!! THAT IS WHY IM GOING FOR A FREE CONSULTATION WITH THE LAWYER.

I have just gotten a dwi in Minnesota, my first one as well. cop pull me over, and give me a breath test, my result is .09 which is over the limit( .08) . i also wont be able to drive for 90 days. is it a wise decision to get a lawyer? or is a lawyer/attorney not worth the time and money. If i plea guilty for my case, how much will I be paying the court? What will i face if i plea quilty, jail time maybe?

I got into an auto accident 2 weeks ago. I failed to stop on time because the flip flop I was wearing got stuck between the pedals so I couldn’t hit the break on time. The cop decided to give me a wreckless driving ticket for it. Everyone around me and I think the accident was my fault but I do not believe I was driving wrecklessly. I mean I wasn’t speeding, I wasn’t switching lanes to lanes to pass other cars, I just don’t understand why the cop gave me a wreckless ticket so I want to fight the case to drop my wreckless ticket. It is my first auto accident and I would like to know if I should be hiring a lawyer to fight the case legitimately.

I make somewhere between 50k to 60k a year, can I get a lawyer appointed to me? They ask me to take a copy of my check stubs and two two business cards! Business cards from who? This happened in the city of HOUSTON TX, I am also in the Marine Corps about to get deployed to Afghan, The cop wrote I was very cooperative on the report. I didn’t blow, they didn’t get my blood and the only thing they have is the video?! I got a DWI back when I was 19. I am 21 now and want to become a cop, maybe. So I was wondering if I could or not.

i was driving a dodge 2500 on the highway when there was a sudden stoppage of cars in front of me, this was normal and i hit the brakes hard, they slowed me down to 10 mph but suddenly gave up stopping? i hit a mercedes in front of me and i cant afford to just pay the person for the damages to their car so i have to go through insurance. They said the accident is my fualt , even with the brake failure. Is this right?

I have the truck in the shop getting looked at right now so i can have a statement for my insurance company.

There is deffinatly something wrong with the brakes becuase now the pedal is very soft and i cannot lock the wheels or get them close to locking.
I took the car to the mechanic and he found a faulty master cylinder, he said it has likely failed just previous to the accident as it has not leaked much fluid at all.
and to my fortune, the cop saw the accident, and said i was following at about 10-14 car lengths.
idk about you but thats pretty far to not be able to stop

I was in a side-swipe car accident involving me being in a merge lane and the other car drifting into my lane before the lane started to end. My entire drivers side was damaged (as opposed to the back end of the vehicle if I tried to speed up and cut off the other car but missed). The cop wrote me a ticket and put me at fault in the police report. He told me that he "had" to give me a ticket because a passenger in the other car claimed injury (not ER-necessary though). He said that if he did not write the ticket and the other person decided to pursue a claim against me or whatever, "they" would come after him for not giving a ticket. I personally feel like I was given a ticket because of a procedure that had to be followed and not necessarily because the evidence warranted the charge. Anyway, does going to traffic court involve getting a lawyer or do people usually handle this on their own?
My point is that I never initiated a lane change. I believe the other car drifted right and side swiped me before my lane started to go away. I was prepared to slow down. My ticket says "vehicle cut-in." If I were trying to race ahead and cut him off, then I believe most of the damage would have been towards the back of my car because I would have "missed." Furthermore, after we collided, another car came behind car #2 and rear ended it. There was no damage, though car #3 claimed his car started making noise. The police ran that car off saying that it was either pursue a claim or get a ticket. They left.

Soo this was obviously a retarded mistake on my end. and i definitely learned my lesson, but the consequences for me are stressing me out.

THE STORY:
I was coming from Irvine to Pomona ca, and I had about 2 beers and it was about 11:30pm. i was super tired because i work a lot! but on the ride home I was already falling asleep on the road but was almost home so i stuck it out. well, right by my house i hit a red light, closed my eyes and passed out.
I woke up to a police officer helping me out of the car (my car didnt move, i was just out)
The cop began to give me the field sobriety test, and i was doing perfect on it. then i notice the other officers searching through my car so i asked what they were doing, the officer responded with "their gettin your registration" i said "well i could get it for them, arent you suppose to ask for permission to search through my stuff" and then i moved a little and he grabbed my wrist, when he grabbed my wrist i reacted and pulled a little, (mind you i was OUT a few minutes before this, i couldnt even believe this was going on) when i pulled back a little he reacted and grabbed my other wrist… by that time, i got upset because he was holding me a side. then he said "ok, that it’ put the cuffs on me and took me to the station. I demanded to call my attorney, or for the officer to read me my rights, but he said " no, and I’ll read them when we get there." when we got there i demanded a breathalyzer. so then i took the breathalyzer 2 times. (I did speak to an attorney and he said there are suppose to be 2 scores) the officer gave me the breathalyzer 2x, but said we need 2 scores to get the 1.
The officer said my result was .08.

1 OPTION
I could pay an attorney to fight this all the way but it’ll be 00 (for an okay attorney) and everything can get wiped off, or turned into a wet reckless.

2nd OPTION
i could fight it by myself.

3rd OPTION
Just take the penalties, be broke for the next year, risk loosing my license which will have an affect on my business and my insurance sky rocketing.

?? I dont know if i should get an attorney, considering i dont know how i’m gonna pay for one, if they’ll budge on a payment plan, I’ve never been so backed up on my bills like this before, and I already owe 00 in bills this month.

Does anyone know a better resolution?
