My 63 year old mother was arrested for a dwi back in august even though she didn’t drink. She was pulled over for not driving straight; the cop that pulled her over kept trying to imply she was on heavy medication which she wasn’t. She suffered from a mild stroke a few weeks earlier which was the reason her voice was slurred.
Anyways, she refused to have a BAC test because the cop said it wouldn’t matter, he was still going to take her in. So she was arrested and my father bailed her out.
Her hearing is coming up. What should we expect? Our family’s never dealt with anything like this. Should we hire a lawyer? We live in Texas in Brazoria County which is in the greater Houston area.

I am 18. My BAC percent was .152. Monroe, Louisiana was where I was arrested
Either the bail bond guy or the cop that arrested me told me there is no point in getting an attorney cause of my situation. but I want to know if thats true? I really dont wanna lose my license for six months + two years probation, plus the 1000+ fine, and the classes/community service… that is ****. The fine and classes/service sure, but I dont want the license suspension or probation! Please!
Is there any hope at all? I also am charged with speeding 53 in 35 and improper lane use

I had gotten a dui in february and blew a 2.0 and while I was in jail I asked around about the best attorney in town so they told me the name of a guy…. he was not cheap to hire but sounded like my best bet. He said that we would take it to trial and basically try to get the paper that said how high I blew dropped as evidence do to the the laziness of the cop that did the arrest. long story short I was wondering how it is during trial the operation this guy is going to be able to convince a jury.when at the beginning of the trial obviously im guilty as sin but after, he if he can get this evidence dropped the jury could find me innocent or can the judge step in and drop all charges cause the state has no evidence then the jury can’t deliberate? I don’t know exactly what all it is that im asking but how would a case like this be preceded in the judicialsystemm?

Was not carged with a DWI but the on scene officer and dre said they may charge at a later date. How long can they take to charge me with a DWI?
they have no blood, breath or urine. The on scene cop said I failed a field test on uneven ground. I am in Arkansas. Ambien was found in the car. not on it at time. I do have a dwi #1 on my record.

i got pulled over for a dwi ,2nd one in the past 10 years ,the police officer done the test ,breath,walk the line whole 9 yards and told me i was going 2 jail for dwi ,anyway i was pissed off i was on a date had 3-4 beers within a 5 hour period and i stoped drinking 2 hours befor leaving bar and had something to eat ,well i got to the police station and remind you my night got all screawed up cause of my passed history of the last dwi in the police’s eyes ,the cop looks at me and ask me for my age ,the guy got my id right in front of him ,i told him look on the fu**in licences .that did it they snaped ,i refused to answer anymore question i wanted my lawyer their .they said another charge ok fine ,they threw me into a jail cell the next day i get my paper work and go in front of a judge and itsaid i refuse a cheamical test ,they NEVER ,EVER ask me to take one ,,wwhat happens now ???

MY question is I was pulled over by a detective, (could have been off-duty), and informed that I was driving the wrong way and he said You seem like a dwi. Next thing I know, I am handcuffed and put in his unmarked car to the local police station. There they asked me if I wanted a Breathalyzer. I said no. THen I was transported to the downtown(HELL) jail for 20 hrs.
Once I got out, the clerk told me my dwi was refused, but i am charged with a driving on the wrong side of the road.i. Well, I called the jail and was advised by 2 other ppl, that yes the dwi was dropped, but one out of the 2 said no. So really I am freakin NERVOUS. THis would be my 2nd dwi.
MY question is this: I have had I am really sorry to say,1 dwi before, and they take your license on the spot, tow car, and post bail. Neither of these happened to me. I am planning on seeing a lawyer in 2 days however, do you guys think it sound like it could be dropped or what? I mean the lawyer I called said this was weird. No sobriety test on the road, no rights read, nothing….
Please serious replies only… I feel so awful about this, but I really do not want another dwi on me, I would be happy to do house arrest, whatever, write everyday on not to drive drunk, whatever it takes, ok, i am ramblin. Please anw. Thank You!

I know this is YAhoo answers, but i want to know is this a valid arrest. I think the cop wanted me off the road and Thank GOD, off the road. Trust me, this has really made me realize where my life could go because of a stupid, STUPID CHOICE.
The reason I ask for validity is b/c the cop didn’t take my license, tow car, or issue bond…Which happened to me before in the same state. The jail clerk told me it was refused(dropped). This is just awful.A dectective took me in . Did not give me a soberity test on the road which they do where i live then they do as well at the station. Thank you. And I feel AWful even asking this.
@qs. Thank you for your detailed anw. I was written a a dwi ticket, drive on the wrong side, and refused test. I talked to 3 clerks and 2 out of the 3 say I only have wrong side. Now, possibly the dwi won’t show till later..? I am just saying that I am going by my unfortunate stupid exp, with a past dwi. Where they ask for a soberity test ON THE SPOT (DID NOT HAPpen), take license(DID not happen), tow car(NOT). I live in a mid- size city. Ok, thanks

I was drinking early that night about, 2 drinks. I know my limit, I know the law. Under 0.08 and I had no reason to believe I was over 0.08 so I assumed It was safe to drive. I was driving home when I decided to take a short cut. A cop was parked on the opposite side of the street from several clubs/bars. I decided to turn on the street opposite to where he was parked instead of going straight since I already had my signals on when I realized there was a cop parked there so I didn’t want to be bait. I knew as I was turning the cop saw me, I knew I had every possibility of getting pulled over so I obeyed the law, so that I wouldn’t give him a petty reason to pull me over. He didn’t follow me to see if I was breaking any laws, he caught up to me at a stop sign and turned his lights on. I put my car in park assuming he was after me. He got out and said “that he would catch me at the stop sign.“ He asked for my license, as I was handing him my license he told me that he was on the look out for someone. IMO he was not telling the truth because of the way he kept described me and my vehicle. He made it sound like he was only slightly off. He asked where I was coming from, I really didn’t want to tell him, in order to avoid the question about if I had been drinking. I kept going on about him getting the description completely wrong, and bluntly said that I though he was lying.. and that next time he should get the description right unless he was color blind. (I wasn’t giving him “attitude,” I sort of found it funny) He asked If I had been drinking. I told him the truth. He ran a couple of tests on me. I ended up doing the test no problem, I got back in my car and he ran the eye test on me about 5 times before he went back to his car bought out a breathalyser. I’m not sure how much I blew roadside but back at the station which is not more then 5 mins away I blew somewhere around a 0.039. Which probably makes it impossible for me to be over the 0.08 mark?
I’m a very realistic person. I have nothing against him but realistically speaking I think that this his intentions were not the same for pulling me over as he says it was. His probable cause was what was radioed to him that night, which, if I had the chanced to look though what really happened that night on his shift, It would be recoded somewhere and IMO there would be nothing recoded in that regard about a suspicious vehicle/person at the time he was pulling me over.
I feel that what he did was a rookie move, a boring night mixed with a little bit of discrimination (the fact that im young, out at 2am on a Saturday night) is what gave him a reason pull me over.
I guess my question is since this feels so petty I really don’t feel like spending $$$’s on a lawyer so what are the chances I could get this DWI thrown out by representing myself?
Since when Is being below 0.08, with no probable cause breaking the law?

3 months ago, my boyfriend and I were driving my car. I didn’t have insurance at the time, stupid I know. I learned my lesson and bought insurance the day after the accident. anyway, my boyfriend was driving and he has insurance, though now i learned it doesn’t make a difference because that only covers his car. some lady ran the red light and t boned my car. it was me and my boyfriends first accident so we didn’t know to tell people that saw it happen to give us their number as a witness. cop came, lady told him she had the green light. so it was considered a no fault because we both said we had green light. we stopped at the gas station that was on the intersection after, they said they have cameras and we got the tape, we have video proof she ran red light. we’ve been working with her insurance to prove she’s guilty and they keep drowning it out to be longer, like we have to send the video here, call back in a week, had to send it to a diff claims place, etc. it’s been 3 months we’ve been doing what they’ve told us. i lost my job because my car is undriveable and i could never find a way there. what kind of lawyer should i get? any advice about anything?
i’m in minnesota which is a no fault state…so that means i can’t do anything about it?

I was in a car accident in December. The police placed me at fault, and I have requested a court date to contest the ticket. (The cop actually told me that he had to give a ticket because the other party claimed pain so that the injury could be documented). My insurance company called me today to tell me that the other party has obtained a lawyer to pursue an injury claim. I have also been seeing a doctor for treatment. I am in a no-fault PIP state. Do I need to hire a lawyer to handle the ticket and/or the personal injury, or will my insurance company represent me for the personal injury part of this ordeal?
I was told about the lawyer hire by MY insurance company. I have not received anything from the other party’s attorney (yet).

I had 3 beers on my birthday and got pulled over for not using my light signal on a lane change. The cop had me do a breathalyzer and it was just barely above the legal limit.
I spoke to an attorney and he said that if I do the required DUI school and community service that normally comes with a DUI conviction before my court date, that the DA may be willing to plea it down to only reckless driving. This is mainly because my BAC was barely over the limit and I am a first-time offender with a clean record.
Do I actually need to spend 00+ on an attorney to arrange a deal or could I actually contact the DA’s office myself and see if they’d be willing to make a deal with me?

I’m 18, I made the mistake of trying to drive home and got pulled over. This was in Columbia, MO. BAC of 0.094. I have never had any violation of ANY type before. This was actually the first time I had ever been pulled over by a cop in my life. Talk about scary. My parents refuse to speak to me, and seeing how I’m going to have to pay for everything, I was wondering if anyone had any estimates or good advice. A friend said his fees were only 0 for his lawyer (who happened to be a family friend) plus the 0 fee for getting a DWI. Is this a close estimate for everyone else who doesn’t have the advantage of having a lawyer friend?

I read-ended another car at an intersection. Both of us were stopped at a light. When the light turned green, the other car started moving and immediately slammed on brakes. In the meanwhile, I had taken my foot off brake and hit the car (at < 5mph).
The other party has filed claim for 50 for damages and also for "unknown" amount of bodily injury. There is not even a mark of any collision on my car (as the speed was low). My insurance company has agreed to their claim related to damages and is waiting for the exact amount for the bodily injury claim.
This has been quite unfair to me and will definitely bump up my premium like crazy.
Is there any way I can challenge my insurance company’s appraisal of the damages ? Are there any other alternatives ? What kind of evidence would I need to furnish for the same ?
We had called a "Cop" to report the accident. I wanted him to note that the impact was at < 5mph. However, he refused to do that saying that this would be left to insurance
Well… Folks, thanks for the answers. As I said earlier, I am not denying that I was at fault and neither is it my intention to ignore the impact on the other car/driver.
The other party had actually contacted me to settle this privately and we had agreed for me to hand out a certain amount. The day I was going to hand over a check, I just happened to call up my insurance agent and learnt that the other party had reported the accident 5 days ago. So in worst case, I would have still paid the check and also had gotten an acci. reported against me.
Shady dealing like this on other party’s behalf and knowing the speed/magnitude of impact makes me believe that the other party is just trying to extract as much as possible out of this.
Again, my car had absolutely no damages (even minor). So it is difficult to believe that the damagaes to other car are worth 50 and bodily injury is completely out of question. (People dont get injured if another car TOUCHES their car) Arhhh… Patheti

Saturday night I wrecked my car. I was with a friend, he ran away. A cop stopped me and breathelized me I blew a .185. I spent 13 hours in jail. It was so scary. I have a 4.0 at A&M, I’m a good student, nothing like this has ever happened to me. I feel like this is the end of the world, I’m hopeless and I don’t know what to do. I know I need to find a good lawyer, I don’t even know how to go about this situation. I made a huge mistake please don’t remind me of that. Any advice, support, similar situations. Anything would be helpful. I’m so lost.
