Recently I posted a question about feeding a 4 month old baby small quantities of water. I mentioned that the pediatrician had been rude and snapped at me for feeding her 2 oz of water after 2-3 days of diarrhea. I took her back 2 days later to a different pediatrician and positively insisted on contaminate testing of her stool as there had been blood in her stool for 3 days. The first pediatrician had said it was intolerance of her formula and switched her to soy. The second also switched her to Alimentium BUT heeded my advice to check for Salmonella, ova and parasites (the mother has well water). Come to find out, the baby tested positive for Salmonella (the mother had a boa constrictor in the room that was converted to a nursery). Should I do something to prosecute the first doctor who could have done the same test and possibly prevented the infant from suffering days of cramping diarrhea, an unbelivably raw bottom and bloody stools?
It’s a cut and dried case of a physician not taking the time to care for a sick patient. The child was new to the clinic and new to the doctor and she didn’t even take the time to note her past medical history or other complaints. The child is on Medicaid and her family is very poor. The doctor spent less than 10 minutes with her and just assumed without ever observing the three blood-tinged, stool-filled diapers that she had a milk allergy. Turns out she has SALMONELLA!!
AFTER POSTS – MORE DETAIL:
This, I might add, was not "simply" diarrhea. THE CHILD’S STOOL TESTED POSITIVE FOR SALMONELLA!! This means that IF the first doc had actually taken MORE THAN 10 MINUTES with this Medicaid baby, she might’ve made a different diagnosis. If she hadn’t been so busy snapping my head off for trying to rehydrate this infant, perhaps she might’ve made a better diagnosis. The child STILL TO THIS DAY has diarrhea. There is no blood, but her bottom is still chapped and raw from the 10+ stool filled diapers she has a day. We are using 1/8" of Desitin or Boudreaux’s butt paste, or Triple Paste, or Vaseline, or a mixture, or talcum-free cornstarch powder, or a combination of all that on this child’s fanny. I’m not her mother, just her caregiver, and I’m really FURIOUS with that first doctor for not catching this sooner. Not sure what she could’ve done, but she could have at least KNOWN the child had Salmonella had she taken the time to test!

my mother doctor was terminally ill he treated my mom in july her pressure was really up he did not offer any tests. she died a few weeks later. her doctor who was terminally ill died two weeks after she did is this a wrongful death case or a medical malpractice case. do i have grounds to sue the hospital where he was employed?

we have been to the doctor who is going to send her to a specialist but its going to be a month from now. im especially looking for websites that will show acupressure points or techniques,but anything anyone comes up with will be appreciated

Over a year ago I was misdiagnosed in WV with galbladder stones. I was so sick that I flew home to FL with a fever of 103 and they found out my kidneys were filled with fluid that contained MRSA. The doctor who reviewed my CT scan sent from up north had made a quiet comment that the previous doctor who saw me up north should have caught that.
I know that no doctor would testify another doctor (which I respect), but if the CT scan clearly shows my kidneys filled with fluid, can I try to sue?
I’m quite sure I would have gone into septic shock and died had I not been admitted that night.
Who are you to assume I didn’t suffer? Being hospitalized for a month with drains to my kidneys and a PICC line for IV treatment at home for over a month after that THATS DAMAGE to me. I have a post traumatic stress disorder of getting it again, THATS DAMAGE.

Had seen a specialist on this but with no avail. Just wonder any one who can advise me whether I can go the swimming pool to dip right in so that the water will flood my ear to ease the ringing sound.
Pls help as it is disturbing my sleep and I cannot be consulting doctor who checked my hearing is ok and it seems that the only I can do is listening to CD to overcome this disturbances.

A year ago, I went hiking and injured a muscle in my left lower back. I put ice and heat on it thinking that it would go away (and not knowing yet what was causing the back pains) but it didn’t. After a whole month, I tried acupuncture, which made it worse, and finally I went to the doctor who advised me to go for massage therapy. With massage therapy, I began to heal slowly, but not in a major way and I also received chiropractic treatment for 4 months, once a week first, then every other week. During this time, I occassionally felt pain in my left knee and ankle, but about 6 weeeks ago, while still receiving massage therapy every other week, the pain became chronic and now I feel tingling and numbness in my left leg and I can’t take my regular 30 min walk without feeling pain and discomfort.
The X rays of my back showed nothing really out of the ordinary(nothing wrong with my spinal cord) and the doctor suggests I go to physiotherapy and he also said I have a bit of a pinched nerve near where the muscle injury was. After all this therapy, I doubt physiotherapy would really help. Do I just listen to the doctor and go to physiotherapy or try acupuncture again? I stopped massage and chiropractic treament because I wasn’t getting better in any major way. Please help.

Health insurers have doctors who review things like requests for prior authorizations. If a doctor who never examines you in person and doesn’t know your medical history overrides your own doctor’s medication or treatment requests, isn’t that malpractice? My own doctor could certainly be sued for writing prescriptions without ever examining me.

My wife and I were in an auto accident in Feb 08. It was in our 1993 Chevy truck. The other driver ran a red light and hit the driver side. As a result my head broke out the driver side window. I did not go to the ER in the ambulance we drove after the report was filed with the police. I went for neck and low back pain and wife sustained buises to her right arm and right knee. They did a Catscan that ruled I had severe whiplash and for the back pain they told me to folow up with a chiro. I recieved 2 month of treatment from them for my back. I actually stopped going because the visits started hurting. After not going for a week or so. It still hurt a getting out of bed and every now and then it would remind me. I am a police officer and light duty is not an option. Anything can happen at anytime. About a month ago I woke on a day off and I couldn’t walk without have back pain and shooting pain around my ribs, breathing hurt.I thought it was the way I slept. cont.
The pain persisted all day. I decided to sleep on another bed. All night and the next morning PAIN,PAIN,PAIN. So I went to the ER I couldn’t even made it from the car to the door. After 7 hours of getting my pain under control.|The ER doctor advised that I have a herniated disc and gave me a week off work. So in bed on my back for four days pain lets up enough to return to work. I followed up with my doctor who gave me more pain medication and sent me for x-rays. Now at work I have to get out of my patrol car periodically because my legs go numb. |I have stopped wearing my bulletproof vest because it helps a little. BAD IDEA I know but what do I do Find a new career. Still have to go back to see what x-rays showed but I am wondering what to do about the injury settlement. We already settled the vehicle part. The damages were 00 to the vehicle totalling it. Considering the truck was worth 00.
All help from claim personal would be great!!!!!!!!!

I was hit in the three months ago by a sixteen year-old who ran a red arrow turn light. She was cited and I was not. I did not think I was hurt at the accident, but realized that I had shoulder and neck pain later that night. I went to the urgent care through my doctor who gave me vicodin and a muscle relaxer, and then I went back in two weeks due to continuing pain. I was sent to a physical therapist, which I went to twice a week for the past few months, and once a week the last two weeks. My PT has given me stretching exercises to do at home but has said I am done with the treatment.
Her insurance has accepted liability and already paid for my car to be fixed (just under ,000) and for a rental car. They knew I was seeking treatment for the accident, and I am getting ready to send a letter asking them to request all my medical bills and records so they can offer a settlement. How much do you think my claim is worth?

I was injured in an automobile accident when my daughter & I were out on Mother’s Day (2008). The other driver was faulted for the accident & I was the passenger in my daughter’s little Kia Spectra. We were T-boned on the passengers side & my head was slammed into the seat belt adjusting mechanism as well as my back was twisted (I later found out that I had an annular tear with few treatment options if any). I was promised by my attorney that his firm had a doctor who would see me with or without insurance & he later said that the doctor no longer accepted patients w/o insurance. My injuries were never treated (after I left the ER) but I did keep an accident journal of what the injuries caused me on a daily basis. When I asked my lawyer if he had received the updated copy of my journal, he said "YES". How could he, I never sent it?
He also made the settlement proposal without first discussing it with me, he asked for the ,000.00 Med Pay that was available on my daughter’s insurance coverage, why not the Med Pay coverage from the person at fault? My lawyer also became a doctor over night & told me that he felt that further medical attention for my injuries would not help my case due to the fact that I had a previous condition (brain tumor) and that this would more than likely be used against me. It didn’t matter that I was honest about that fact up front & it didn’t matter that the side of my head that was slammed into the seat belt adjusting mechanism, was on the same side as the surgery to remove that tumor and that since, I have not had a day where I I haven’t had to take prescription pain medicine just to try to dull the pain. The injury site was right on the plate that is in my head.
Throughout all of this, I continued to care for my terminally ill mother & she was hospitalized on the 21 of January (2009) & passed away on the 25. Believe it or not, it was during this time that my lawyer called me to let me know that the insurance company of the man at fault had submitted an offer & I was strongly advised to take it. I felt as if I didn’t accept this offer, I would be compensated at all. This, based on what my lawyer said to me.
We met today and against my better judgment, I signed papers and One of them was the ,000.00 Med Pay check made payable to me from my daughter’s insurance provider, my lawyer said that it was to go to pay the medical bills & that he would pay them. Am I out of luck just because I signed those papers? Is there anything that I can do go after the lawyer for misrepresentation or misconduct or something? He never sent me to a doctor and he lied about receiving the updated journal & he made proposals without consulting with me and he advised me (indirectly) against further medical attention and he went after my daughter’s Med Pay instead of the one who was faulted for the accident.
What can I do now? Do I continue with my accident journal? Help!
I honestly feel as though my lawyer has taken advantage of the fact that I have just lost my mother. He never once called me, I always had to call him. His call finally came the day after I lost my mother and I had called to check the progress of my claim. After he found out about my mother, I had a settlement offer in 2 days. does this sound suspicious?
My daughter just reminded me that my lawyer also failed to contact Kia due to the fact that the side impact air bags did not deploy. I did inform him of this in our initial meeting.

I can appreciate your response to my situation but can you appreciate the stress of the situation that I was in at the time in which he finally contacted me? I was the sole caregiver for my mother, responsible for 2 households, a full time college student, constantly in & out of I.C.U. with my mother while trying to survive college & life and then I had my mother pass away. I am aware of the reputations that many believe lawyers have earned and many would say that I found the "cream of the crop" in the one I ended up with, but is there nothing that one can do when they have been taken advantage of in such a disrespecting manner?

In California, I’ve filed a personal injury auto accident claim and need to release my medical records to the insurance company. I’m only claiming physical injury, not psychological/emotional but the doctor who is treating me for pain with alternative treatments such as biofeedback is also my therapist. His notes from our appoinments contain co-mingled info and I don’t want to submit my personal mental health information. His physical pain treatments are important to my case and I’d like to know if there is a way around this?
