I am writing a paper on DUI laws and how they are not severe enough in virginia, and my focus is the laws concerning fatalities or injuries due to an auto accident while driving under the influence. I have searched for laws about this and can find nothing. All I have found is the basic DUI laws. Does anyone know anything about this?? I have to do a 5 minute presentation on this and am coming up extremely short! Help!

Referring to alcohol here. I don’t understand why the majority of drivers who drive buzzed always get charged with the DUI instead of DWI.
Driving While Intoxicated means you’re drunk as $hit, right? As in well over the .08 limit. While Driving Under the Influence (of alcohol) means you’re still driving drunk, but not drunk enough to be over the limit of .08, correct? But you’re still functional though. You’re just barely drunk.

i am assuming this paperwork went to the Custody Judge as well as my sons Gaurdian Ad Litem.It is a Citation for driving under the influence,as well as refusal to proceed with sample for alcohol testing.Problem is,it is NOT MY CITATION!!
I have NEVER been arrested for a DUI,and it isnt even my name on the citations!!!
Would I have a case to sue my wifes attorney for slander and emotional damges for slipping in DUI arrests into my case where if a concerned person such as a judge flips through it and doesnt take time to see the person named on the citation isnt me,will just assume i am a drunk driver?What can I do?

My wonderful father was stopped at a signal light when a drunk driver rear ended him and killed him instantly. He was only 54. The man was 58 and was cited 4 days prior for driving under the influence.This occurred 3 weeks ago. So what is the purpose of filing a civil lawsuit?

I know what each is. DWI/Driving While Intoxicated
DUI/Driving Under the Influence
Seems to me that if you’re one, you’re the other.
So can anyone out there lead me to the truth? I’ve never done either, and I have no plans on doing either. But I’ve wondered for many a day what the difference is

Don’t worry, I have never been arrested or have a record, I’m just curious because I’ve heard both these acronyms used.
One friend of mine says that a DUI is driving under alcohol intoxication while DWI is driving under the influence of drugs. But another friend of mine says it doesn’t matter, they’re both the same. I’m confused.

What is the difference between a driving under the influence, driving while intoxicated and operating while intoxicated? Is it the state’s classification of what they want to call it or is it something else?

I was arrested for driving under the influence back in November. It was the first time that I’ve ever been arrested and I had a PERFECT driving record for 9 years (not even a single speeding ticket). I live in Michigan. I was given a breathalizer at the scene and I assumed that was the main breathalizer. I was taken to the hospital because my eye was seriously infected with MRSA and the police were afraid of contamination. Anyways, I refused a blood test at the hospital and they got a warrant and then I had to give one. I refused because I didn’t want blood drawn and I assumed that I already did a breathalizer at the scene (I found out later that is just a preliminatry breathalizer test and not the main device). So, I was arrested at the hospital and brought to jail and at jail, I was treated like a leper because of the MRSA. I got a lawyer and the charges were reduced to driving while impaired. I ended up with 48 hrs. of community service, a day class about (cont’d)
drinking and driving, and no license for a whole year! That seems way too harsh. My blood alcohol was .12 which isn’t extremely high. Can I my license back possibly any sooner? I really do live in the boonies and there is no public transportation. I take full responsibility for my actions and I am VERY GREATFUL that no one was injured or killed due to my poor judgement. I will never drink or drive again. What can I do to get my license sooner?

I know that DUI is Driving Under the Influence and DWI is Driving While Intoxicated. Don’t they both mean you’re driving with drugs or alcohol in your system? What’s the difference?

Designated Decoy
One night, a police officer was stalking out a particularly rowdy bar for possible violations of the driving under the influence laws. At closing time, he saw a fellow stumble out of the bar, trip on the curb, and try his keys on five different cars before he found his.
Then, sat in the front seat fumbling around with his keys for several minutes. Everyone left the bar and drove off. Finally, he started his engine and began to pull away.
The police officer was waiting for him. He stopped the driver, read him his rights and administered the Breathalyzer test. The results showed a reading of 0.0. The puzzled officer demanded to know how that could be. The driver replied, "Tonight, I’m the Designated Decoy."
