I plan on attending the DMV hearing without an attorney. I have done extensive research on evidence that may be able to get me out of a DUI. For example, the California officer stated that I had been swerving but if the police camera were to be reviewed, I am 100% positive I was not. I completed all of the field sobriety tests with flying colors but blew .08 then .09 under the breathalyzer. After I got to the station about 20 to 30 minutes after, I blew .11 and .10 meaning my Blood Alcohol Content may have been increasing over time. Not only does this show evidence that the PAS devices may not be accurate, but also that at the time that I was driving, I was under .08. Since it took about 20 to 30 minutes to initialize the first breathalyzer test after I had been pulled over and in that same amount of time I rose a maximum of .03, it can be argued that during the officer’s investigation is when my BAC reached .08 or .09. I was only 2 minutes away from where I was headed and if the officer had not pulled me over, I would have been off of the road before my BAC reached .08. This is my main argument, however I do not know what documents I would need to prove this. Can somebody offer me advice and suggestions on what to do? I cannot simply stand by and be charged guilty for something I am innocent for.

I recently got charged with a DUI in Arizona. I have hired an experienced attorney to represent my case. My DUI did not involved any serious damage or accident. I dont even think the cop had a probable cause to stop me because I did not have any traffic violation. My BAC was 0.09. I would like to know what is considered as a weak evidences or an example of a weak case?




our daughter got a dui and was according to her .06. if she can’t afford an attorney is she appointed a public defender? if she pleads no contest any idea what’ll happen?
Please understand we do not want her on the road and feel only blessed by the fact she was pulled over before she hurt or killed anyone.

I got a DUI on Nov. 5th…went to court in Clinton County, Ohio on the 8th and waived my right to an attorney and just plead guilty so I could just get my punishment over with. The judge sentenced me to 90 days in jail, fines, and license suspension…everyone else there for a DUI plead not guilty after they saw me get sentenced to that. After everyone left the room, he told me that he would give me a chance to do a drivers intervention program and that it would count as 3 days toward the jail sentence and that I would return to court in March to review my sentence and my assessment through the DIP. He stayed (postponed) the sentence and fines until then. I got my license back a couple of weeks ago and i recently wrecked my car when it was all snowy out and got a failure to control citation…this is a basic traffic violation. What is the likelihood of me receiving jail time?




Am I able to leave the country with a DUI?

"Hi, I am legal resident and I got my first DUI about a month ago. I’m still waiting for my court date. Am I able to leave the country for a week without any problems coming back? My alcohol level was 0.11 and the court didn’t receive or review my case for a court date. I had been calling the district attorney every 2 weeks for an update.




I just got a dui. They have made new laws and I’m not sure what they are or how to find out. Is it worth hiring an attorney or a waste of money? I blew a .14 in Sacramento ca. It’s my first offense and I’m 22.







I was charged with a DUI. I was taken into the station and did all the neccesarily procedures. My first test showed a .286 (no way I was that high), the second sample on the test not meeting the .02 agreement, showed a .263. After the test, the officer noticed the hose was broken, or something to that extent. The last test ending at 2:26 a.m. He then was working on the machine, changing the hose I believe ( I’m not an expert on these machines). At 3:12 my final reported value was .23 g/210 L. In the police report I would have assumed that the officer would have noted that the machine "broke" ie: hose breaking, but there was no note of it in the police report. I know there is a lot of speculation on the accuracy of the Intolyzer… Could there be human error? I have a lawyer but am looking for some information on my own. It seems like the two tests, first being .289 and the second going down to a .23 in a 40 minute period seems very strange and almost like the test was innacurate. Any advice/suggestions would be helpful…

In the police report it says " In dash camera ran out of tape right before I pulled him over" There is no tape of field sobriety… The officer stated that I was very polite though….







So I asked for an attorney while I was being interrogated and he said I could have one afterwards…I got charged for a DUI and when it came time to blow into the machine I told him I wanted to speak with an attorney and he said I couldn’t have one until afterwards. Is it legal for the officer to do this?

My cousin just got arrested for her third DUI in Indiana. she has a problem..and she has taken classes, be on house arrest twice and even had 3 months in jail, but nothing seems to work..her current arrest has 10 charges which are:
1 Operating a Vehicle While Intoxicated
2 Operating With a BAC at least 0.08 or more
3 Operating While Intoxicated With a Prior Conviction
4 Operating While Intoxicated With a Prior Conviction
5 Resisting Law Enforcement
6 Operating a Motor Vehicle While Suspended
7 Failure to Signal
8 Unsafe Lane Movement
9 Habitual Substance Offender
10 Operating a Vehicle Without an Ignition Interlock Device
…. this is while she was still on probation for her last 2 DUI’s (which i should mention this is all in a time frame of about 3 1/2 years) yeah i know its horrible..i just wonder what is going to happen next..her second DUI was already labeled as a "felony D" so im guessing this will be a felony too. She also spent jail time in another county for a public intoxication and battery to a police officer offense. She has a hearing for the Revoke of Probation coming up as well. She still owes at least 00 in court fine that were due almost a year ago. She is not working and no longer has custody of her child(he now lives with his father and step mother in a much more stable environment)..of course she has a lawyer, but with that kind of record do you think he will get her out of jail time…if so well thats just dumb of the judge..but if she does get jail time, which i think she is in desperate need of..how long might it be? i would hope its a good amount of time…maybe then she will learn her lesson and sober up for good…thanks for all the answers







My DUI was about 2 years ago and my driving while liscense revoked charges shortly followed but were all reduced to minor infractions by my expensive attorney. Im 22. Im in great shape and dont have any major problems besides my bad credit (lol) so would I be considered?
