Third DUI (OWI-DWI) in Indiana..whats next?




My cousin just got arrested for her third DUI in Indiana. she has a problem..and she has taken classes, be on house arrest twice and even had 3 months in jail, but nothing seems to work..her current arrest has 10 charges which are:
1 Operating a Vehicle While Intoxicated
2 Operating With a BAC at least 0.08 or more
3 Operating While Intoxicated With a Prior Conviction
4 Operating While Intoxicated With a Prior Conviction
5 Resisting Law Enforcement
6 Operating a Motor Vehicle While Suspended
7 Failure to Signal
8 Unsafe Lane Movement
9 Habitual Substance Offender
10 Operating a Vehicle Without an Ignition Interlock Device
…. this is while she was still on probation for her last 2 DUI’s (which i should mention this is all in a time frame of about 3 1/2 years) yeah i know its horrible..i just wonder what is going to happen next..her second DUI was already labeled as a "felony D" so im guessing this will be a felony too. She also spent jail time in another county for a public intoxication and battery to a police officer offense. She has a hearing for the Revoke of Probation coming up as well. She still owes at least 00 in court fine that were due almost a year ago. She is not working and no longer has custody of her child(he now lives with his father and step mother in a much more stable environment)..of course she has a lawyer, but with that kind of record do you think he will get her out of jail time…if so well thats just dumb of the judge..but if she does get jail time, which i think she is in desperate need of..how long might it be? i would hope its a good amount of time…maybe then she will learn her lesson and sober up for good…thanks for all the answers

Do we really need to get an attorney to fight for this?
What can a lawyer do that we cant do on our own?







Referring to alcohol here. I don’t understand why the majority of drivers who drive buzzed always get charged with the DUI instead of DWI.

Driving While Intoxicated means you’re drunk as $hit, right? As in well over the .08 limit. While Driving Under the Influence (of alcohol) means you’re still driving drunk, but not drunk enough to be over the limit of .08, correct? But you’re still functional though. You’re just barely drunk.







So my boyfriend recently got a DUI and hit a parked car (no one claimed the car) it has been there for 6 months. But he got arrested that night and got his license taken away. He is 21 and going to Texas for school in november. What are his options now? We don’t have enough money for an attorney…







I was convicted last july for a dui in cook county. i finished the panel and took the evaluation and classes required. money has been very tight in my home and I haven’t paid a dime toward my 00.00 fine. yep 00.00. I have court July 15th can i go without my attorney and ask for a continuance to pay my fines or maybe a payment plan to pay monthly? im a little nervous. ive never been in trouble before!




Got my 4th DUI need attorney?




So here’s the backstory-
I do have a couple BS DUI’s in my past. One of them is legit, and I am a man and I can admit when I’m wrong, and I was way too hammered to drive on that one, and I took like like a man. The other two are complete crap and both times I passed the field sobriety tests, didn’t violate any traffic laws, cops were both d*cks, and I blew over the limit. Those two were 0.16 and 0.19 respectively, so it’s not like I was twisted drunk or anything either. So yeah, those two don’t count in my book, and the third one does (I’m not even telling you what I blew that night), and now I’m gonna be fighting one more.

So this latest one was Saturday night and I just got out of county the other day for it. Me and some of my boys went down to 4 bars, and ended at Tattle Tails show club and I knew I had to drive home, so the whole night I stuck to only beer except for just at the strip club because they had shots and beers, so guess what? Anyone in their right mind would take 4 shots instead of one beer for the same price.

I left Tattle’s and I distinctly remember walking back to my truck because I was doing the little field sobriety stuff- walk a straight line, say the ABC’s backwards (which would come in handy later) and all those usual things that everyone does when they’re about to drive after having a few drinks. So I know I wasn’t really drunk because I remember all of this clearly. Anyway, I headed home and I watched my speed, drove straight, and I was really careful. But before I knew it, I saw the cherries in my rear view. Pig pulled me over and said I was using too much of the road and I crossed the double yellow (both lies). I didn’t have a license, so I told him a bouncer took it at the bar. He must’ve not believed me because he quickly made me do the field sobriety test (which I KNOW I passed with flying colors) and then I blew a 0.26.

I’m gonna try to fight this one on several reasons-
1. When I got to the jail, they tested me again at 0.21, so clearly their meters are broken if they read that far apart.
2. I know I passed all the field sobriety tests
3. I didn’t violate any traffic laws
4. Pig had no probably cause for breathalizing me
5. Personal assurance that I wasn’t drunk at the time
6. Witnesses who will testify that I wasn’t that drunk when they last saw me
7. No way I was that drunk that night on JUST beer which never gets me drunk.
8. Receipts showing that I only drank 9 beers that night in like 4 hours.

OK, basically I need a good CHEAP lawyer who knows who to talk to and what strings to pull. I’ve got a wife who is leaving me and trying to get sole custody of our 3 kids, and she wants support on all 3 to the tune of 0 a kid per month (yeah right, you’ll see a penny of that money, sweetie). And my mom bailed me out, which she has several times, but this time she wants me to pay her back. I’m in the music industry (hip hop) and I am currently shopping a record deal that could blow up at any point, but I CAN’T be locked up when that drops.

I’ve got another suit about racism playing a part in my not getting signed yet. My mom can’t get her money paid back because I’m white? That’s real fair. So this lawyer my get a 2 for 1, so to speak if the money is right. I’ve got a good girlfriend with good credit, and I can’t be in lockup. I know theres plenty a cats out there that have 4 DUI’s and they walked, so I gotta make this happen, and I’m looking for some help.

Anybody know a good lawyer who knows who to pay, who’s back to scratch, that sort of thing? I dont like doing this, but I’ll buy my way out of this one if I have to. I’ll sell my Camaro, whatever it takes. I’m not going back to county.

Blood test only, which I refused.







I was charged for a DUI Feb 11th. I was told by the officer that I would receive a letter from the DMV within 2-4 weeks. It has now been nearly 7 weeks and I have not received a letter. My attorney said that it would come after my BAC blood results were processed. If these results show under the limit, do I still get my license revoked pre-trial? Thank you.

Dui HELP Please!! Should I get an Attorney?




I blew a 2.2 and a 2.1. The officer says I refused a chemical test, which I sort of did by refusing to CHOOSE blood or urine, but I didn’t understand why he needed a chemical test when he had 3 different breathalizer tests. Anyway, I know I deserved the dui, the only thing I have a problem with is the refusal part which could cause me to lose my license for a year. This is my first dui, any comments or suggestion are appreciated.

Just for the record I didn’t "fight" the blood test that he chose to give me. And yes I know that what I did was wrong and I deserve whatever I am given.
The question still remains, "Should I hire an Attorney?"
Ofcourse your right I blew .21 and a .22, not a 2.1 and a 2.2.







my husband got arrested and we had sessions court, he has never has a dui ever or any other problems. they offered him 2 days in jail 3 day public work, dui school and a fine of 465 plus court cost. he got arrested at .08BAC but later blowed .07BAC. will it help to hire an attorney?or will I end up paying more in the long wrong?




How does DUI appeal process work?




I convicted of a DUI and am in deperate need of some help for the appeal process. I do not have a lot of money to hire an attorney. What should I do?







I was just curious a because i want to be an occupational therapist and I already have one pending.
In Texas DWI is driving while intoxicated. So it would be similar to a DUI. It is still pending and I have a pretty good shot at getting off. I just would like to know the worse case scenario







I was arrested for a DUI on July 10th however my court date was scheduled for September 3rd when i went to court the police had yet to file my case with the District attorney. I had recently had my bag stolen with my citations in it but i paid and got another copy from the sheriff station where they accused me of just not knowing the court date until i had the paper in front of their face.







I got a DUI early this year in april 2009. I blew a .085 and the legal limit in AZ is .08. I missed my court date due to the officer scheduling it on memorial day. I just kind of blew it off after that and since a new year is coming I want to start off with a clean slate and take care of it. I’m wondering if any one has had a similar experience and want to know if maybe they will just have me pay the fine since it has been so long. Either way i want to take care of it I’m just nervous and don’t know that to expect.
