I got a DUI on Nov. 5th…went to court in Clinton County, Ohio on the 8th and waived my right to an attorney and just plead guilty so I could just get my punishment over with. The judge sentenced me to 90 days in jail, fines, and license suspension…everyone else there for a DUI plead not guilty after they saw me get sentenced to that. After everyone left the room, he told me that he would give me a chance to do a drivers intervention program and that it would count as 3 days toward the jail sentence and that I would return to court in March to review my sentence and my assessment through the DIP. He stayed (postponed) the sentence and fines until then. I got my license back a couple of weeks ago and i recently wrecked my car when it was all snowy out and got a failure to control citation…this is a basic traffic violation. What is the likelihood of me receiving jail time?

i was involved in an accident, he pulled out of a parking lot (he was turning left) i ended up t- boning him and there was honestly nothing i could do to avoid it, the police officier listed him at fault and he was given a ticket for failure to yield, i recieved nothing..now his insurance company is trying to say i am 30% percent at fault, i have two witnesses that agree with my story. his insurance company is also trying to get me to agree to have my insurance company pay for everything, i know it is their job to bullying people into settleing, would it be in my best interest to hire a lawyer

I was driving a school bus and a 16 year old ran a stop sign, hit my bus, and tipped us over. I had 15 kids on board (3 of my own). She failed her drug test and all she got was a ticket for failure to yield. Our county attorney said nothing can be done about failing the test because you can’t prove how long marajuana has been in the system. So she got away with it in my mind. Also, the kids at school said she was making a big joke out of it, and now she’s out driving her parents new vehicle like nothing ever happened. Luckily there were just minor injuries to some of the students, but it was very scary to all of us. Isn’t there anything else that can be done? I think she should have gotten her license suspended. She had just gotten a speeding ticket a couple months prior to this too. The attorney says that’s not enough to take her license away.

I took blood 5pressure pills and blacked out driving from the pills. I ran off the road and hit a tree.I was the only one injured.I blacked out from the pills and ran off the road.I was by myself.I dont drink. The dr. had given me 5 pills to take at one time. I woke up 3 hours later in the hospital. they said I had a wreck. a few days later I got a suphena to show up in court as a witness. I went to court and they said they were ticketing me for dwi and failure to control a vehichle. They said they drew my blood and my alchohol level was .11. How do I defend myself. I dont trust the appointed lawyer. He said its my word against theirs. Who put alcohol in my blood? What is going on here..Please this is serious no silly answers please.

Last night my stepson his son and his biological father were injured in a car accident. A wrecker carrying a car on a flatbed had not secured the vehical correctly. Just as my stepson saw that it was about to come loose , it did!
The car came off the truck and slammed into the passenger side of my stepson’s pickup. This sent him into the guardrail. The truck is a total loss. He and his dad were shanken up and are pretty sore but my grandson hit his head, yes he had a seatbelt on, and had to have 12 stitches and stay in the hospital until 2am this morning.
My daughter works part time for a lawyer, who came down to the hospital last night. He said he will handle it. Im sure he will, for a fee.
What is fair? IF the wrecker company broke more than one law is there more than one lawsuit?
I can think of a few. Failure to secure his load. Wreckless endangerment. Bodily injury. Mental anxiety [my wife]. etc

I’m under the legal drinking age, and blew a 1.6. Got a reckless driving, dwi, dwi under age, and a failure to maintain lane. What can I expect to come out of my court hearing? Is it worth getting a lawyer? Fines? Community service? Class?

I’m 20 yrs old, I got my first DUI like a few weeks ago..I was driving while high they say..I wasn’t drunk at all but high so they say. When I took a breathalyzer it came back 0% Should this look better for me? They said they found a little under a gram of marijuana in my car..I was ticketed for missing headlight (didn’t even know, was the real reason i got pulled over, failure to yield, no insurance, no seat belt..all BS..Judge said he they wouldn’t appoint me a public defender because I wouldn’t be at risk of serving any jail time anyway..and he gave me time to find a lawyer or to defend myself..I said i would get a lawyer but I’m just wondering how much that will cost my parents..Ive heard crazy shit like ,000..Sounds utterly insane! I wasn’t even drunk…I live in Memphis, tn..Can anybody give me any ideas of how much this will cost? Because I mean if it costs even ,000 I’m just going to defend myself because that’s just ridiculous..I doubt that much worse would happen if i DID defend myself..Someone told me at the level court or something it wont go on my record or anything like that anyway so there’s no way in hell i would give an attorney that much fuckin money..Can someone help me out here
It was BS because they NEVER asked for my insurance! I had my insurance card in my freakin wallet..They just wrote a bunch of tickets
I will admit to the headlight being out but the seat belt, failure to yield, no proof of insurance are all bogus..Have you not heard of cops just writing tickets because they are assholes?

Sure, they point to having contracts.
However, if there’s nothing in the contracts saying "if you fail the company, you will be let go with no bonus" (which would be a stupid contract because ANY contract should have a clause to allow termination in the case of non-performance), can these failures actually be SUED?
They had a certain fiduciary duty to the company and the shareholders. Additionally, once they accepted taxpayer money, they had a fiduciary duty to them as well.
Can the failures not be sued for a failure to perform in this capacity? Have their contracts recinded?

I was represented by an attorney in March of ’07 for for not at fault car accident. He did a piss poor job and did not represent me properly. How would I go about finding an attorney to file a lawsuit against him for failure to properly represent me? I live in Granite City, IL and don’t know how to find an attorney for that. Please do not answer by saying not to sue or any of that crap, because you don’t realize just how bad of a job he did, and how much his crappy job have cost me.

I was driving on a highway going about 68-70 in a 65 mph zone. A full sized truck pulling a boat trailer (no boat, just trailer) behind it did a turn around in an emergency vehicle ONLY turn around on the interstate. I hit the back of the trailer at about 40 mph after slamming on brakes and attempting to pull to the other lane (but there was an 18 wheeler blocking my way). I was not cited for the accident. The other driver was cited for failure to yield in an emergency turn around.
I was brought to the emergency room via ambulance, and suffered a sprained ankle (that now 4 months later I had to have surgery on because it was misdiagnosed).
The at fault party’s insurance is saying that I failed to keep a proper lookout and are trying to say I’m equally at fault for this accident. I currently have a lawyer who is sending in my demands next week for my losses’ including pain and suffering, medical bills, loss of work, future pain, car damages, and everything else included in the settlement.
My question is, am I equally liable? I don’t feel that I am at fault here. As soon as I saw that he was pulling out from the turn around I attempted to slow down. We collided not even 1/15 a mile from where he turned around. He claimed he was up to 50 mph before I hit him, But with the damage I did to his vehicle he was only going about 25 mph.
Also with medical bills and missed work and all the amount I owe/ deserve before pain and suffering is around ,000. After surgery and missing work and not being able to walk around for 3 months we’re putting suffering at 4x the bills. Is this too much to ask for?

I didn’t actually hit the vehicle from the rear, I hit them on the side of the trailer when they were pulling out. But they didn’t stop until about 1/15 of a mile later. So they were still pulling out when I struck them. To clear up the rear ending issue. I meant earlier that we were cited 1/15th of a mile from the turn around’ not collided.

I got in an auto accident where a person was cited with failure to yield. The car I was driving was totaled. I have and will continue to have medical expenses. No major injuries, sore neck, back and headaches. How much is standard to receive in a claim such as this… beyond the replacement of a totaled vehicle?

I was riding my bike and a lady t-boned me on my ride side. I flew up on the hood of the car and flew to the pavement. I had roadrash, brusing, and a concussion. No broken bones. She was 100% at fault according to the police report. She was also driving with a suspended license. How should I go about obtaining compensation? Through the insurance company or through a personal lawyer? I would just like money to cover medical bills and the bike, anything extra would be a bonus. Which is the best option? With a lawyer I would have to pay out 30% with less hassle. With insurance, I would have to deal with it myself but may end up with more money. Any one have experiences with this?
The police report stated it was completely her fault. She was at a control intersection and I was traveling on a road with no traffic control regulations. She was ticketed for failure to yield the right away and for driving with a suspended license.

I bought a car 4 days ago. 3 days after having my car i got arrested for a DWI in the state of N.Y. I blew a 1.07 on the breathalizer. I was fingerprinted and then allowed to go home. My car was towed and my dad picked it up the next day. I was wondering if it is possible to get the DWI reduced to a DWAI. I cannot afford a lawyer so i was hoping maybe to talk to a DA. Im also checking myself into AA meetings before my court date in hopes that it will help me out. All together i got 5 tickets. I got speeding, 55 in a 40, underage drinking (im 19), a dwi, failure to keep right (was not because of alcohol, i was changing the cd in my car) and an open container (half full, was in the back of the car).
Im expecting huge fines, and crazy insurance premiums. The main questions im asking is:
How long will i lose my license?
Do you think its possible to get it reduced to a DWAI?
Do you think checking into AA meetings before my court date will help at all?
If they were to drop any of these tickets…which do you think it would be?
Maybe i have that wrong? It was almost double the legal limit thats all i know. It doesnt say any where on any of my tickets. It just says:

Well i didn’t plan on getting a lawyer…From what ive heard, if i can somehow get it reduced to a DWAI the fine is about 0-0 with license suspension for 6 months. The thing is i need to know how to get it reduced without a lawyer
