Around a week ago, I woke up in the middle of the night with excruciating pain in my left hip. After that night, it went away for a few days, and has now returned in the same place. I know I didn’t pull anything; I haven’t done anything athletic recently. My mother and I think it might be a problem with my sciatic nerve — does that make sense, and if so, what can I do to help it?

I have a question regarding a personal injury lawsuit that was filed against me. First, let me you give you a brief background:

In July 2003, I rear-ended a Pontiac Sunfire which was in turn pushed into a Chevy Bronco. The Sunfire sustained moderate damages to the front and rear while the Bronco sustained a 0-800 dent to the rear bumper. All vehicles were driven from the scene of the accident.

A few months after the loss, the driver of the Bronco and his wife (who was a passenger in the vehicle at the time) filed suit against me for personal injury.

Since 2003, my insurance company (Allstate) and my defense attorney (provided by Allstate) have attempted on multiple occasions to settle the suit with the plaintiff attorney. Per my attorney, the plaintiff attorney has not once responded to a settlement offer or relayed a demand on behalf of her clients.

In 2009, I provided a deposition as did the plaintiffs. While at my deposition, the plaintiff attorney agreed to high-low arbitration to resolve the matter by year end. I never heard anything after. I then called my attorney in March of this year who advised me that the plaintiff attorney had became unresponsive after the high-low arbitration offer. My attorney advised me that she made the decision to file a certificate of readiness to push the suit to trial. A few days ago I received notification from my attorney that the suit is now set for trial for the first week of June.

I have been an adjuster myself for the past three years and I have never seen a plaintiff attorney not submit a demand or respond to an offer. I initially thought she was pushing for a UIM claim but now that this is going to suit, I have no idea.

At the time of the loss I had k in bodily injury limits. Allstate’s last offer was 00 combined. Based on the plaintiff’s treatment history, there’s nothing to suggest that they sustained any significant injuries from the loss. And I do know that Mr. Plaintiff has a history of auto injury suits, workers comp suits, etc. And per my attorney it appears Mr. Plaintiff is the one that has been more adamant about claiming injury.

My questions are: 1.) If this does indeed go to trial and the plaintiffs receive a verdict in excess of my policy limits, will Allstate cover the excess? I know they are not obligated to, but I feel as if they filed the certificate of readiness to push this to trial and not made attempts to settle (even for my limits) prior, there is an element of bad faith there. 2.) Anyone that is experienced with attorney rep’d injury claims (I only handle unrepped claims), what do you feel the suit is worth at trial? Keeping in mind that the plaintiff injuries appear to be limited to soft tissue with minimal treatment. 3.) At the extreme, if the verdict is well beyond my limits and Allstate does not pick up the excess, can I have the excess discharged in bankruptcy?

1. My question was not specifically whether or not Allstate would be required to pickup an excess verdict. Obviously they are not required to. My question was, and I believe was answered very well below, whether or not bad faith existed given that Allstate pushed this to trial for resolution.
2. Yes, you can discharge a judgment via bankruptcy and retain your assets such as your home and automobile. This is allowable under Chapter 7. I’ve never seen a bankruptcy judge deny a request nor have I seen a plaintiff fight it when their injury claim was so-so. Again, that was not my question. My question was regarding the excess portion and bankruptcy.

Im a surfer, and when paddling your back is arched up in kinda an unnatural way. It causes severe back pain in the lower part of my back. It was so bad a few days ago, I had to get off my board and swim to get out into the deep water. I always do stretches for my arms, neck and legs but I dont really know of my any that would help my lower back out. Any suggestions would be much apprectiated.

I once went back to the gym after a few weeks, when i did deadlifts, i think i did them wrong because i kept my knees straight/locked, after a few days i was playing soccer and while I was running, i got this pain on my back and felt like if it was tightening, and it was only on the right side, i later got stretch marks, I have stayed out of weightlifting for over a month, and the right side of lower back seems different from the left, more loose, and a weird feeling, HELP.

Okay so my sister’s boyfriend got pulled over and he was drunk. He got arrested for DWI. My sister had to go get him but she didn’t want to give me any details on what happened. This man is a complete loser! He went to court for this a few days ago. My main question merely is did my sister have to pay something to get him out of jail and if so how much is estimated? my basset hurt his back jumping out of the tub. he was fine for a few days then he started walking kind of drunk in the back part of his legs. i took him to vet and put him on muscle rex. and pain pills and predsoine. he could walk then all of a sudden he is dragging his feet behind him. he cannot walk. he is in good spirits and eats, drinks water and pulls himself outhside for the bathroom and he is doing all that ok. i do not know what to do. he is happy wags his tail and flaps his ears. please help with any answer. ….regards dian e hall and toby joe hall

A few days ago I found a one winged field sparrow at work. When I got home I examined it more closely and found that it was defiantly an injury and not a birth defect. I treated the wound and am giving it vitamins. It is healing very nicely, eating and drinking, and very active. Sadly I know it cannot be released since a predator would get it.

It seems content but I would like to find a companion for it. Since I can’t seem to find Sparrows in pet stores or online to buy I would like to know if there is another species of bird that would be compatible. I also am not sure how to tell what sex it is.

My gf was in a car accident few days ago .
The car bumper was hit by a guy who was driving without a license.
It wasn’t too bad. But the bumper must be replaced and the insurance company should pay for the medical bills .

My question is this. I have "never" been in such a situation before , there fore I have some questions… because she doesn’t seem to know what to do either . She made some mistakes. She already contacted a lawyer , which she thought was the right move.
But i don’t think it was needed because this just happened a few days ago ,Aren’t lawyers needed when things get out of hand or when - they refuse to pay?

In regards to payment.
2 questions -

If so what if it’s an ongoing procedure like, a physical therapy session for 8 months . What is the procedure for this ? Should she just fax all the bills to All State or wait till everything’s over and then fax everything- Estimate ( for bumper) and Doctors bill to them?

p.s: The lawyer told her to go to that doctor, I know how cunning these lawyers are . I want this to be done without any lawyer present as smooth as it’s possible. I am just worried if she’s going to get into any kind of trap. Please help.

I have recently started drinking alot more water after a long period of not having drank as much as I should have. I go through this evey few months or so. After a few days of drinking water, I begin to feel pain in my right side, underneath my ribcage, more towards the back. I don’t know if it’s one of my kidneys or my liver or what. The pain can be pretty strong; it usually happens after I’ve consumed quite a bit of water (nothing too extreme, though), and sometimes lasts the better part of a day. Is it just one of my organs detoxing?

I got a DWI a few days ago and I had my first appearance in court today. The judge told me my lawyer would have to send them a letter of representation by next week and would have to be there for a pretrial conference on the 29th. I’m not sure if I have to be there as well. I know my lawyer does.

I recently had a car accident (no one was injured, thank GOD!) I made a terrible choice after an end-of-year school celebration. I know this was a terrible choice because I am falling apart emotionally. Please, don’t grill me about it. I need to know if there is any way to postpone a court date for someone facing a DWI charge (first one). I’m preparing myself to live with the consequences… I planned to spend three weeks abroad on vacation. I’ve never been abroad before, never really been anywhere. I had been planning this for months, and now this mess. The court date falls a few days after I am supposed to leave. If court dates can’t be postponed, do I have to be physically present in court, or can my lawyer represent me without my being there? I live in NJ. thanks. i could use a few prayers, too.

about 2.5 years ago i began experiencing leg pain and was diagnosed with 2 herniated discs. i was put on lite duty for 18 mos (i wait tables, had to hostess)
after countless docs pills chiros and breakdowns, i felt better about a year ago and retrned to waiting tables. my mri showed that the hernaition had beome a sligt bulge.

i was movin a few wks ago and felt like i may have reinjured the disc, had some low back pain and a little leg pain.
over the past few days the pain has become almost intolerable. im miserable at work, when standing, sittin… its keeping me up at nite

the pain i have now is worse than its ever been and its constant no matter what i do. i recently started a new job and dont have health ins. and even if i did, i know theyd tell me to get off my feet for atleast a few weeks and thats just not an option

i have a few back strengtening exercises i do, but what else can i do for myself?

I injured my lower disc in my back and over the years it went from a bulging disc to a herniated disc. Since the day I felt that pop I seem to have chronic nerve pain that goes from the lower back down my leg and in to my foot. it seems to hurt constantly and if I have to do anything besides laying in bed it is much worse to the point that after a few days of work I am bed ridden again. I’ve been to the doctors, surgeons, neurologists and the only thing they offer is pain meds which give me some relief but not enough to have a normal, mildly even, active day. I also found using the Dr Ho Tens machine gives me some relief but not enough to function. Does anyone have any suggestions and has anyone had botox injections for such pain?
Botox was suggested by a specialist to block nerve pain somehow. it isn’t covered by OHIP and I’m reluctant to pay for something I’m unsure of. I have been to surgeons and been denied so I have to find an alternative way to deal with this pain. I currently take strong pain meds which give some relief but still have a great deal of pain at all times and especially when standing and even sitting. I also will wake through he night constantly and have to change positions and prop pillows. thanks for suggestions.

I was going down the stairs in my building and slipped on a piece of plastic that was on the steps a hurt for a few days then it went away soon after (3-4days) i was in extreme pain I wen to the hospital and then had an MRI from my docto advice the MRI reads a disc bulge or herniated disc, I have been out of work since 8/27/07 to date 9/21/07 can I make any kind of claim? If so what can be recovered?

I have complained about debris on the steps on 1 or 2 occasions even sweep in front of my own door.
The inside of the building as well as outside the building is nasty. Even in the winter the steps arent freed of snow until next day after asking since my daughter fell down the steps on the snow too.

I am a new teneant there and didnt really want to be known as the complainer so after a few times asking I just left it alone.
