What kind of lawyer do we need and do we have a case?
This is a complaint that we submited to the cheif of police but we would like to take it further. Do we have a case aginst the police officer?
"I have Juvenile Rheumatoid Arthritis and a severely compromised immune system due to immunosuppressant drug therapy. This has gone on since I was one and a half years old. I have severe knee pain and my Rheumatologist stated I will need total knee replacement in the near future. I am physically deemed handicapped and have had my cars license plates handicapped for 6 years now. Officer Hall pulled me over and took me into custody June 20 in the early morning for suspicion of DWI. Upon asking me to step out of the car, I made him aware that I had taken my shoes off to drive because my arthritis is out of remission and it is easier on my knees to drive barefoot. He had me step out anyway, without my shoes and then continued to have me do the walk and turn test barefoot on the side of the highway. There are witnesses to this. In the NHTSA Standard Field Sobriety Test hand guide I am not an eligible candidate for this procedure and the officer neglected to take my disability into account. With a rheumatic flare I should not be walking barefoot on pavement without proper arch supported shoes and with my immuno-compromised state brought on by Methotrexate and Humeria, I was also put at risk for infection from whatever particles could have been on the roadway. The officer then retrieved my purse but still failed to let me have my shoes. I was taken to the county police station where I was still not given shoes and had to walk around the precinct and even into inmate bathrooms with bare feet, again putting me at risk for infection and illness. After completing the necessary paperwork I was put into the general inmate area. Not until then did a separate officer bring me a pair of shoes, but by this time I already had sores on the bottom of my feet. Upon entering, a male inmate who had been brought in around the same time as me asked if I had just been brought in for a DWI and if I had any physical impairment. I stated yes and asked him how he knew this. He explained that after I had been put into a side room that officer Hall was telling the other officers that I had an excuse for everything and was claiming that I had arthritis and a disability. He stated that the officers then began laughing about the situation and made jokes on my behalf. I think it is completely inappropriate to make fun of my disability and especially to do so in front of other inmates. It is my personal medical information and should not be talked about or be shared with other officers either. It is a violation of my HIPPA rights. By the time I was finally released I could barely walk because the precinct was very cold and I had not had proper shoes on for 4 hours. I am still having stiffness and problems stemming from that night. I believe it was unprofessional and cruel for someone with a disability to be treated in this way. I have been dealing with this chronic illness for 23 years and have serious medical conditions resulting from it. It is not something to laugh at or not take seriously. I feel that the situation was inappropriate and does not represent the standard I believe police officers should be held to."
*She was not drunk what so ever, he told her that "it didnt matter, you could blow .02 and im still giving you a DWI"…….. Which I dont understand either………
