What does a lawyer need to file a personal injury lawsuit? If the person they are filing for receives Health Insurance from the state, do the lawyer have to contact the State that provides the Health insurance? If so, why do the lawyer need to contact them? Do they have to get all your records they have on file on what they paid or something?

my stepdaughter caused a accident and her insurance had to pay its limits but the injuries to the person was more than her policy would cover, can the injured come back on my auto policy under resident relative claus? She lives with me and I have her on my health insurance but not my auto insurance, even though she occ. drives my car.

I’ve been getting subrogation letter from my health insurance asking if the injury that I got was a result of an auto accident. This is the 3rd request that they have sent me since I didnt’ do anything with the other 2 letters that I receive. I’ve already settled with the other insurance. If I continue to ignore the subrogation letter, will they come after the settlement or what will they do? Anyone who has been through this, please share. Thanks.

Should insurance companies be forced to let me buy health insurance AFTER I become sick? If they should, should I expect to pay more than a healthy person or should my premiums be the same? Wouldn’t the health care reform bill allow me to wait until I get sick to purchase a policy, and prevent insurance companies from charging me any more than they charge a healthy person? Isn’t this just wrong?

My fiance totaled my car a few weeks ago. He has a non-owners policy on his license, but they said I had to see what my insurance company may do first. They said that because he got injured in the accident in my car (broken arm & ankle), that the bodily injury part of my insurance would cover that. My limit per accident is ,000. There was no other car involved, it was a tree he slid into after a snow storm. I’m having a hard time getting a straight answer from my insurance provider. All they’ve told me is to have him fax his medical bills over & gave me a fax number. How does that work? Will they issue a check for the ,000 to him? Are they just wanting the bills as proof he was injured? Or will they want to only pay the amount of the bills? And will they want to submit payment to the hospital & doctor’s offices? The thing is, he already has good health insurance, that pays for all of his doctor’s visits, etc. But I’ve heard that there’s still the "pain & suffering". We’re wondering if they’ll be sending him a check or how that works. They never asked if he had any health insurance. I’m wondering if they were to find out, would they decide to not pay? They already said it would be covered (this is after the "investigation"). It’s been me leaving them voicemails & them leaving me voicemails, so I’m having a hard time getting a straight answer. I’m hoping someone can tell me how this will work. Thank you, ahead of time!

My wife was hit by a car crossing a street. The car was obviously at fault, but it did not stop… so it was a hit and run. An ambulance and ER visit was needed.
What insurance should be paying for these costs? I paid my health insurance ER visit copay at the hospital but they said my auto insurance would likely cover it and the other costs?
I called my auto insurer and they said they will cover it under personal injury…. and it doesn’t sound like there’s a deductible involved. I’m afraid however that it will raise my rates.
My questions…
Do you think my rates will be raised if I go through my auto insurance?
If so, can I go through my health insurance instead? Or will my health insurance just say it needs to go through auto anyways?
Is an ambulance ride covered by one or the other, or both?
Thanks.
There is not an option of me paying it myself in either scenario. It would either be health or auto. But I don’t want to use auto, unless there is no other option as they may raise rates… which is one of my questions. Health insurance would obviously not raise my rates since it is through my place of my employment.

I have been having lower back pain for a few weeks, and recently re-injured it to make it worse. Now, there is numbness and tingling on the top of my foot and front/outside leg. pressure sensation is fine, but the sense of touch is greatly diminished. I am assuming it’s a pinched nerve (my entire right, lower back is inflamed). I’m worried because while I’ve had back problems before, I’ve never had this numbness in my leg/foot. I’m in my late 20s, but I don’t have health insurance. I am hoping somebody with experience can reassure me that in time, my injury will heal and I will again feel strength and touch in my lower extremities. If it won’t heal on its own, what would I need to do? Thanks for any and all helpful information.

Why doesn’t your own health insurance pay for your injuries in an accident involving someone with no insurance. I can’t understant why the need for uninsured coverage if you have medical insurance, which should pay for your injuries, if someone else causes your injuries.

Several weeks ago, I got into a car accident that was 100% the other party’s fault.
I went to see my doctor and my personal health insurance company (Blue Cross, provided by my employer) eventually paid for the doctor’s bill. Subsequently, I reached a settlement with the other party who paid me personally through the the auto insurance companies.
In my situation, I was (technically) compensated twice (money to my doctor and money to myself) for the same injury. I was told that in some states, such as Texas, it is not only legal, but specifically allowed to "double-dip" on personal injury protection if the other driver is at fault.
Is this "double-dip" situation legal in California?
Thank you very much for your thoughts and sharing your experience with me.

I had a claim today the member lives in a no fault state for auto insurance. A medical claim was submitted and it was a work related auto accident (mail carrier), workers comp has denied the claim, will the no fault automobile insurance pick this up? Even if it’s a work related auto injury?
Sorry, evidentally I was very vague when asking my question..
I work for the person’s health insurance company, and we’re trying to investigate third party liability. The member is the subscriber/insured of our plan. She is a mail carrier and was injured in a car accident while delivering mail. Workers comp denied their claim for whatever reason, but now we’re being told we need to investigate if their auto insurance will pay as they live in a no fault state. If you live in a no fault state when you’re in an accident your auto insurance pays for your damages regardless of who’s at fault. The other drivers insurance pays for their on damages as well. So I’m asking if her auto insurance will pay for her damages/medical expenses if she’s injured in a work related car accident. Or will her auto insurance pay regardless of whether it’s a work related injury or not?
Do you think we should do more investigation as to why workers comp denied the claim?

If I was in a car accident and my health insurance pays all but 00 (lets say) of my medical bills and my car insurance has a 100,000 benefit for accidental injury while in my vehicle, does it really only pay out the ,000? and does that money go right to the hospital?
What if I want something that would pay me a lump sum to my home, like enough to replace my income while I can’t work due to the injury?

I was treated right after the accident for whiplash. It’s in my medical records but then was unable to go to treatment for some time because of other problems but injury got worse now the chiropractor won’t work on me because he says the insurance company won’t usually pay after this time loss. Also the auto insurance company won’t preauthorize treatment and I can’t afford the a visit co-pay required for using my health insurance. I’m on Social Security.
