My accident goes back to Aug 2006. Litigation began in Nov. 2007. All along my lawyer told me he felt I had a good case and my award should be substantial. He did much work on the case and accompanied me through depositions, medical exams, office visits and my freequent inquiries. The insurance company never made an offer. Four months ago he told me my case will likely go to trial and I would be in front of a jury in 90-120 days. I haven’t heard from him since and checked online with the court website to find out there has been no activity on my case for a year. He doesn’t respond to my emails.
My question is; why would he drop my case after doing all this work? Is he afraid to go to trial? Can he just forget about me because he doesn’t want to go to trial? I’d rather get a lesser settlement than none at all but it seems the Insurance company called his bluff and now won’t make any offer. He told me a number of times my case would either be mediated, arbitrated or go to trial. Now all he’s apparently done is backed down. Where does this leave me?
I never exaggerated my injury, in fact, I underwent two surgeries, have scarring and residual symptoms. My lawyer got disgusted with me when I refused to exaggerate. I’m not looking to get rich but do expect to be compensated for this proven liability. The judge issueed a deniel of request for summary judgement. Why won’t this lawer proceed. I will call his office but am tired of playing games. Let’s get on with it or drop it all together. Can he charge me for his work if I drop the case?
You raised a point that is critical to me. You said the judge will at some point insist that the case progress. The court clerk told me the opposite, she said the judge won’t do anything. I reasoned,as you said, that at some point he needs to clear the case from his docket. As long as I know the case must be resolved one way or another by order of the judge, then I can wait. My fear was that it could just be left in limbo forever.
This law firm has done a lot of work on my case and I find it hard to beleive they would just stop at this point. I think they would hurt themselves in the future if the Insurance company pegs them as not being willing to fight. I’m thinking maybe they are waiting for the judge to force a mediation or arbitration. I’m willing to give them one more month then I’ll demand some answers. Does my reasoning make sense? I’m not afraid to call them and have done so many times but I don’t want to foil a starategy if that’s what this is. Lawyeres don’t alw







Has used his state farm policy and is now going after mine. he walked away 70 days ago just fine. i even drove by his residence a few times and he l ooked just fine also. this is a moral point for me. you have to stand for something or youll;; fall for anything. i cant stand the thought if my insurance also state farm ends up paying out. not because my rates would go up; obviously wouldn’t like that. but here in south florida , people from other nearby countries are always pullin this. should i try to round up possibly neighbors of his, co workers if i can figure out where he works, and any local businesses he go to to prove he is not and was not hurt.
However he did use his liability/bodily injury first. does that mean he just paid his deductible. never understood auto ins.
it eats at me that visitors, whether they become permanent U.S. citizens come here to use our country. serious inquiries only. sorry if offended anyone but i do have my American right to opinion.
