The problem no one will take the case so close to the statute of limitations. The state statute is up on the 20th of January 2010. This involves a vehicle accident and big insurance co.

My daugher was involved in a major auto accident on 5-25-03.
It was her vehical. First the other kids in the car told the Deputy she was driving. Later 2 of the other kids told her attny. that the other person in the car was the one driving. No charges were ever brought against him. My question is-who can we contact to have things investigated as to why. Our local Sherrifs Dept. really handled things all wrong. We were informed by them last week, that there was nothing they would do because time had run out on the statue of limitations. Is this true? We thought it was 7 years. Please any information would be great. Our daughters mental/physical health needs some closure.
Thanks
Sueing anyone is not our purpose.
We would just like to see justice done.
We are very fustrated and upset on how the way the county and Sheriffs Dept. handled the investigation, or lack there of. Wondering if there’s a higher level we could go to, to file a complaint, and see if we can get something done.
At the hospital after the accident our daughter was placed under arrest, but no charges where brought against her, because her attorney found out that she wasn’t the one driving. Her question is. Why didn’t the co. press charges against the person driving her car? She did get a settlement from her insurance co. for the loss of her car and most of her medical (she had min. coverage)

I am in medical malpractice settlement negotiations with a dentist. Her insurance company was handling the negotiations, then the dentist license expired and the insurance company dropped the dentist. The dentist obtained a new policy from a new insurance company. Now the original insurance company has dropped out of negotiations. Is it possible that the original insurance company wants me to file suit against the dentist, and then the new insurance company will have to defend the dentist? Or, because the first insurance company received the initial settlement letter with notice of intent to sue, they will have to carry on and defend the dentist even though they no longer have the dentist as a client. Please clarify the typical procedure in this type of situation. Thanks a million! N.
Thanks for the info. I do have an attorney. But I do not want to sue and want to settle. The original insurance Co. made an offer, then we countered..then the Ins Co. dropped the dentist, and did not responded to the counter offer. SO, of course the attorney wants to sue cause he will make the big bucks. I want to settle because we were on track to settle. I just can’t figure why the original insurance company would want to go to court unless they really don’t care one way or another because the dentist is no longer a concern to them in the long run??? Tks. for you input.

I am told that this is not covered because it is considered "transport for hire". A company I want to work for requires me to have my own personal auto insurance for liability purposes, but my insurance co. says any accident or injury would not be covered because I am being paid and that makes me like a taxi service. This is common practice in the home care agencies. Can anyone clarify?

Thus far the guilty party’s insurance co. has been very easy to work with. They told me to take my car to the mechanic of my choice for repairs…no jumping through hoops. They made more than generous settlements to the other people in my car who received minor injuries in the accident. My only concern is that my injuries (whiplash and a torn shouler labrum) are lifetime injuries. I just had surgery last week to repair the tear…I’m in my 40′s so it’s a downhill slope for recovery. I’m not sure if I want to hire an attorney who will take 33% of the money due me, as well as charge me extra for every letter, every phone call, every minute that they "say" they are working on my case. Most people aren’t aware of these additional costs, but I’ve heard of situations where the attorney has walked with more than half of the settlement w/o even going to court! Any ideas/thoughts?

I was hit almost 2 years ago in california. I got an attorney since it was the 2nd person who hit me in 2 months, yeah I know. Well since then I have not received a dime from either accident and now my attorney’s new assistant calls and asks for the address of the person who hit me. Shouldn’t he have this info already after I gave it to them 2 years ago and has insurance info?? The attorney want to serve the person who hit me. Why are we going to court when insurance co. is suppose to pay? Then I found out that the person they are trying to serve is a man and not a woman, but it was a woman who hit me. The assistant said he may be the owner of the vehicle. She didn’t have any more info to give me and I told her that she better call me back soon with the info as to what the hell is going on.
I didnt get a call back today and now I have all weekend to think about whether or not I have to take care of all the medical bills from my accident. I’ve been on this attorney for a while, he freaked out on me once after I called so many time for updates and told me with a horrible tone that these things take time and cases can take up to 2 years and that calling him all the time isn’t going to help.
Has anyone had this happen to them or any idea as to what may have happened? I’m having a nervous breakdown and hate my attorney
Thanks

Were in TX, our lawyer endorsed my name to the insurance personal injury protection checks, adding up to 3000.00 also sign my kids names. Did I agree somewhere on my retainer for that
I only saw 700, then my case was dropped. Did not know till I investigated it on accident from insurance co. I saw the checks not my signature, went to his account, does he have to put POA or anything.
Very mad

I was recently in a rear end car accident where I was not at fault. I was taken via ambulance to the hospital and given x-rays and was diagnosed with having cervical strain and wiplash. I have no medical insurance (i’m only 21) and my neck is still bothering me. I had talked to a lawyer and he said that if I have him represent me then i can go to the chiopracter and they will pay for is until i settle with the other persons insurance company and add those bills in with my emergancy room bills. So if I don’t hire that lawyer i can’t go the chiopracter but if I do then I can. I know he said he would take 1/3 out of what I get but i’ve herd that you get more with a lawyer. Please help?
Also i was recomended by the doctor (when i went to the E.R.) to follow up with a chiropracter if my neck doesn’t get any better. Again I don’t have a family doctor and I have no money to pay out of pocket for a doctor until i get reimbursed from the insurance co.

I hired a med malpractice attorney to negot settlement for me. The offending med pro had previously offered to settle my case & I was under the impression that the attorney would be able to complete the transaction in a timely manner. Once he became aware of the intricacies of my case & the possible $ amount a lawsuit would bring, he started trying to get me to convert from the 0 p/h rate to the contingency rate. Now, over a year has pasted and there is no sign of a settlement. The offending med. pro. insurance co. has not communicated with my attorney in some time. In retrospect, I have no idea if my lawyer even submitted our counter offer to the insurance co. By way of the "grapevine" I heard that the offending med prof says she is being sued by me. I have no intention of getting involved in a lawsuit when a settlement is (was?) at hand. How can I check and make sure the lawyer is representing my best interest and not just waiting for me to give in to a suit and make himself big $
Thank you for your input. See here is the problem. We created a counter offer settlement letter. But how do I know that it was submitted to the opposing counsel and the insurance company? The counter had a expiration date. The insurance co. never replied. In the mean time, I found out more detail regarding the offending provider (unlicensed employees carrying out duties that require state license etc…) When my offending providers state license expired, her insurance company dropped her. So. Is it possible that the original insurance company is WANTING me to file suit, thus the NEW insurance company will have to defend the offending provider? I have no idea, and I am operating in the dark.
