I was rear ended 4 months ago. No doubt of the other guys guilt. He received 2 tickets for it and we even have the surveillance video from the store I was turning into. My question is, I received as they call it a soft tissue injury. I was taken by ambulance to the emergency room, MRIs showed the muscles affected were spasming severely. I was put on a 5 lb weight limit and pain pills and muscle relaxers. I was unable to do even routine things like sweep my floors let alone able to even pick up my children. The insurance company is not denying their responsibility but they only want to pay me 00 to cover my pain and suffering and mental anguish due to the recklessness of their client. I missed work, I have unpaid medical bills still that are currently in collections, and I still have pain if I over due it at work to this day. They are willing to pay my medical bills of 00. I have asked for ,000 to cover what I believe the pain and suffering and the total disruption to my life for the last 4 months since their client negligently hit me. They claim the 00 is their final offer, am I asking for too much? Or are they just not willing to pay what they should. I know of people who have gotten alot more for alot less happening.
It took me 3 1/2 months to decide what I have been though does equal money because I didn’t want to sound greedy. But realisticly how else to you get validation for the heartache, pain, stress, and interuption of your life? I feel by not "paying" something they are belittling the real pain, the loss of experiences, the loss of time that I missed out and can never get back because of their clients carelessness.

Boo to those of you who try to judge and down grade what I am doing. 5 months ago I may have said the same thing as some of you, then I have had to go through the hell of this "accident". Don’t judge me until you have walked in my shoes. For those of you with the good advice, I have planned on settling for less without a lawyer, mainly because the guy’s insurance policy won’t pay more than ,000 so if I used a lawyer I would probably only get -6,000 anyways. my wife was run off the road by a semi (he was sighted for improper lane change) there insurance company is going to offer a settlement how much should we be looking for? Her vehicle flipped 3 times (they paid us 00 for it KBB value) her hospital bill was 000 (they said they would cover it) It included an ER visit overnight stay. We are fortunate she has no broken bones no nothing physically however she had amnesia and a concussion and still has some neck pain and is freaked out to drive especially at night? we talked to a lawyer but i didnt ask (didnt know if it was proper to ask how much we should be getting) so just seeing if anyone knows? thanks

I was recently in an auto accident where I sustained serious injuries and my car was totalled. The other party is 100% at fault and has admitted that, and their insurance company is offering to pay the max amount of their policy on bodily injury (they have minimum coverage, so their policy in GA is 25K for bodily injury and 25K for property damage). The 25K they have offered as the policy limit for medical does not come close to paying my bills. Out of the 25K available towards property damage, they have paid 7K to my insurance company for totalling my car (my insurance company paid me the 7K while we dealt with establishing fault) and they paid me 00 towards the items in my car that were destroyed as a result of the accident. Is there any way to get them to pay me the difference between the 25K available towards property damage and the 00 they have paid out, as that money would make a huge difference towards the medical bills I am going to be out of pocket on.
I tried filing underinsured motorists with my insurance company - apparently you can’t do that in Georgia. I do have uninsured motorists, but they have stated that I can only use it if hit by someone without insurance, if they don’t have enough I’m out of luck. I went through multiple layers of management at my insurance company trying to get them to cover me but they pretty much said no.
I have the maximum coverage possible in GA - underinsured motorist is not even an option on the policy or I would have already had it. (Ironic isn’t it that a maximum coverage person is hit by a minimum coverage person). The release I would have to sign to take the 25K states that I release both the other insurance company and the driver from any future litigation, etc. - I assume that means I can’t sue them personally (though from what I’ve been able to learn about them they have nothing to go after). I am curious as to if this means criminal charges cannot be pursued - this was initially a hit and run accident and I believe the police are going to charge the driver with running. Even though they were found and owned up to what they did I don’t want my taking the 25K to release them from that legal liability as well.
There is a separate, ongoing criminal investigation going on related to this accident due to it being a hit and run - the other driver thought I was dead and ran. That is separate from the insurance issue.

I was in an auto accident where the other driver ran a stop sign. She was issued the ticket and declared at fault, I have a witness who has given a recorded statement to the insurance company to that fact and also on the report for the police. My two small children were in the car but the main impact was on my side and door. I went to the hospital as soon as I could after (when husband came home because my car was towed) Damages on car are 6,000.00 and so far it looks like med bills will be over 3000 easy. I have an MRI next week but we think it is a bulging or herniated disc in my back. I also had whiplash and head problems from head hitting window (nothing serious, but blurred vision and headaches). I have been out of work 3 wks already and can’t do much at home ( I am a homemaker by day and hair stylist by night and weekend) I can’t stand for long or even sit up for long. Anyone know what we can expect?
I am not looking to get rich but I am looking for what is fair. This was completely the other drivers fault and I have proof in the form of a witness and her ticket. My father is a lawyer but he doesn’t do this sort of case much anymore so he said he would refer me to someone if he thought we would be better off than with just the insurance company.

I was in an auto accident three months ago. I still have back and neck pain. I was originally sent to physical therapy which didn’t help. My doc. then sent me to a chiropractor who has helped a little, but just can’t seem to fix it. He took X-rays and found I have spondylosis (I guess I already had it but didn’t know. It was just aggravated by the accident) and scoliosis (which I knew I had). Both of these things are complicating my healing from the accident. The chiro doc is really trying hard, but says I’m a challenge. If he can’t fix it, and the physical therapist couldn’t, what can be done? I’m only 40, and was healthy and active before. Will the other insurance company (the person who hit me) cover future medical expenses if I can’t fix it and will need chiro or ortho care in the future? I’m afraid to sign anything until I’m all the way better, but don’t want this to drag on forever either. Any advice is really helpful, because I really don’t know what to do. Thanks!

Question Details: i had an acccident about a year and half ago and i was a passenger. i have no health insurance and have been footing all medical bills thus far. i am writing a demand letter right now but am wondering how much should be my compensation request.
here’s a brief summary. the other driver is at complete fault. i have all soap notes from doctors,bills and reports. we were hit head on while on our way to my root canal surgery, i was having my permanent put in. i had to go in 2 weeks later wearing a cervical collar. i have choronditis, back sprains and horrible knee contusions still left on my foot. my doctor has recommended physical therapy for up to 3 months but i can’t afford to go anymore thus why i am trying to settle.
total medical bills is about 12,000 not including other misc like pills.
i just don’t want to ask too high or be taken for a fool,so please help. thanks.

I was recently in a car accident where a Nissan truck ran into the back of another car that then ran into the back of me causing 00 worth of damage to the rear of my infiniti. I received moderate whiplash to my neck and had to be taken to the hospital. I checked out without any broken bones and was prescribed medication.

I went to see a chiropractor and he has been working on my neck for a couple days which makes it feel a better. Im 100% not at fault and the insurance company has taken care of my car repair, rental, and medical bills. They ask me " How much do I think I want for this accident" for pain and suffering.

I live in NC. I believe 00 is a reasonable consider the circumstances. I could have lost my life, broke my neck and been paralyzed for life. Thank the lord that I received only a whiplash. The stress that I am undergoing, the constant pain in my neck is a reminder of the accident, which I feel fearful of driving. The time I spent recovering could have been spent enjoying my life. Besides getting behind in my school work, I am absent from my student organization at school which I am a key figure ( president AGC). I don’t enjoy waking up with cramps and headaches nor do I like to take prescription pills, and therapy. I don’t want to be compensation a insufficient amount that wont even cover pain and suffering I went though. It seems like you people are on the side of the insurance company and not the victims in this situation. I wonder if any of you have ever been in an automobile accident and if you have must share some sort of empathy of what I am reiterating.

If I decide to handle my own auto personal injury case, do I have to provide a statement to the other AT FAULT insurers insurance company? I was an injured passenger in my sister’s car and the other person was found to be 100% at fault by their own insurance company. Too, can I file a claim with my sister’s insurance and my own insurance? I am not with the same auto insurance carrier (it’s been about 2-3 months that I switched), but can I still claim with them? I was rear-ended by an eighteen year old doing 35-40MPH. There was about 00 damage done to my year and a half HHR. The insurance company said they would take care of my bills at first, after several months I found out not. Most pain was in my neck and hips. I apparently bit down on my jaw and shattered one of my teeth and root, resulting in tooth removal and replacement with an implant. I missed three days of work to visit the dentist, still need to go again to have the final crown installed on the tooth. My bills so far have totaled about 00.00. Thanks

I was recently involved in a car accident that was the fault of the other driver. There were no injuries(thank goodness!), but the other driver had no drivers license and is not on the policy of the owner of the car(who was also in the car at the time of the accident).Yesterday, I was told by their insurance that this claim could be denied by them and their policy canceled, which leaves me to file with my insurance company. If this happens, I would like to know if I can sue these people anyway and what type of lawyer should I contact. I just purchased a new van in 2008. This really sucks that I might have to pay for the damages to my new van that will probably never be the same again.

My 18 month old and I were rear ended on the interstate and went to ER immediately afterwards. The driver lied about her insurance so it took about a month to finally track down the correct insurance company. I went to a chiropractor for about 4 months then submitted my claim. The insurance company finally made me an offer of 00 that I find to be unacceptable. My chiropractor bills totalled k and the ER was k. They justify the offer because I didn’t start chiropractor until 6 weeks after the injury and the insurance company feels that it’s too long of a time to link the two.
Anyone have any advise on how to get a reasonable settlement without hiring a lawyer?

Which do you think would be the best in this case. Would I have to pay less- if anything- if my automoblie insurance company settled this for me instead of an attorney that would get 35 percent ? I received a check and release form from the at-fault driver’s insurance company. I want to accept the check, as I do not forsee future medical costs associated with the accident. HOWEVER, the wording/language of the release seems vague/too broad…it mentions a "full release" and mentions property damage. The vehicle is currently being repaired at a body shop and they have me in a rental car. If I sign this release, will they stop work on the vehicle and so forth? My only concern here is that I get my vehicle body repairs completed…I do not want to do anything to jeopardize that or release them from that particular part of the claim. Has anyone received offers like this before and signed them? What were the results? I may meet with an attorney and pay for 30 minutes of consultation time to have the document reviewed, just to be safe…and/or write on the release that I am not releasing them from the obligation to repair my vehicle. Any advice on this? Other recommendations?
