Auto accident w/ injuries…questions?




So I had an accident where another person hit me from the rear. My hubby and I both sustained injuries and are currently going to physical therapy. Also have other medical bills such as xrays, ER visits, and doctor office visits. I called an attorney and they immediately wanted to help me with my case and sign us on as clients. I know that my PIP coverage will cover up to 2500/person….but my lawyer thinks he can get money for pain and suffering, my medical bills, and my husband not being able to perform his job like he used too(he is a truck driver now w/ a knee injury). My kids thank god were okay and unharmed. I am also experiences alot of anxiety when I drive now due to the fact that auto accidents are one of my biggest fears. I really dnt want to have to pay a lawyer a percentage of my settlement bc I’ve heard of people handling the negotiations w/ the insurance company themselves. What is the first thing I should do to handle this on my own?? If I call them how would I negotiate something w/ them. Especially not knowing how long the physical therapy is going to last. Where do I begin and what should I say to them?? Thanks in advance! This is all new to me.
I have NOT officially signed the papers w/ a lawyer yet….that’s why Im not asking him/her….and of course if Im injured and in a accident that i was not at fault any lawyer is gonna want to represent me…..there is obviously money involved now…..

I read-ended another car at an intersection. Both of us were stopped at a light. When the light turned green, the other car started moving and immediately slammed on brakes. In the meanwhile, I had taken my foot off brake and hit the car (at < 5mph).

The other party has filed claim for 50 for damages and also for "unknown" amount of bodily injury. There is not even a mark of any collision on my car (as the speed was low). My insurance company has agreed to their claim related to damages and is waiting for the exact amount for the bodily injury claim.

This has been quite unfair to me and will definitely bump up my premium like crazy.

Is there any way I can challenge my insurance company’s appraisal of the damages ? Are there any other alternatives ? What kind of evidence would I need to furnish for the same ?

We had called a "Cop" to report the accident. I wanted him to note that the impact was at < 5mph. However, he refused to do that saying that this would be left to insurance
Well… Folks, thanks for the answers. As I said earlier, I am not denying that I was at fault and neither is it my intention to ignore the impact on the other car/driver.

The other party had actually contacted me to settle this privately and we had agreed for me to hand out a certain amount. The day I was going to hand over a check, I just happened to call up my insurance agent and learnt that the other party had reported the accident 5 days ago. So in worst case, I would have still paid the check and also had gotten an acci. reported against me.

Shady dealing like this on other party’s behalf and knowing the speed/magnitude of impact makes me believe that the other party is just trying to extract as much as possible out of this.

Again, my car had absolutely no damages (even minor). So it is difficult to believe that the damagaes to other car are worth 50 and bodily injury is completely out of question. (People dont get injured if another car TOUCHES their car) Arhhh… Patheti

I have no assets. I am worried that maybe I cannot prove she is faking her claims of injury,etc. What can she get from me if she wins? Can my future tax refund or wages be garnished? I am angry because I am positive she is just trying to scam the system and I am almost positive she is after me because the insurance company investigated and denied her claim.

My wife was rear-ended at a stop light. Our company paid for the auto to be repaired and said they will subrogate against the others insurance carrier. It has been three weeks now and we haven’t heard anything from that insurance company. They (the others ins.co.) do have a copy of the accident report. I believe there is no question of liability because the other driver was arrested for DUI at the scene of the accident.
My wife has had several doctors appointments and has been in pain since the accident. Should we call the ins. co. to make a claim? Or should we get an attorney to do that? Or should we just wait and keep good track of our medical bills that we expect them to pay? I understand we have a 3 yr. limit in Washington State to file a suit against the other driver.

how to fight auto insurance company?




Husband was in a no injury auto accident during business hours in a business owned car, car was totaled. The driver’s insurance company has offered a small amount on the car and nothing for lost of work, rental car, etc. Don’t they have to make you whole? Blue book was 3200. Records on the car show over 00.00 lost business. Their final offer 00.00. Now threatening to send car back. Since no injury, some lawyers won’t even take case. Over small claim amount for Ohio. What is our recourse?

if driver of other vehicle had catastrophic injury in the car accident that was 100% my fault will my insurance company pay more than my policy limit because it was a catastrophic injury. i heard insurance companies will pay more then policy limit if injury was catastrophic.

i was told that if you were involved in car accident and had catastrophic injuries due to the other drivers negligence you could be paid more than insurance policy limit by the insurance company because the injury was catastrophic. is this true. i thought insurance company was only liable for its limit and that was it.

Patient has prescription from the chiropractic to get the massage due to an auto accident. She has pain in the neck, trapezius and constant headache and a severe pain, need constant rate, soap note and all other information that I need to submit.

I have an auto accident case which the logging truck driver jacknifed his truck and hit me head on. I sustained serious injuries, and am suing. Nobody saw the accident, it was far out. I was flown out by medivac. The insurance company representing the logging company hired their "experts" who came back and claim I veered in to his lane and hit him, therefore my injuries are "my fault."
What happens if after reviewing the entire case the judge accepts the defense request for dismissal. Will I have to pay the thousands the defense spent up to that point???

I was in an accident 8 weeks ago where I didn’t see a delivery truck and pulled out in front of him. The truck barely had any damage, many scratches, and my car was totaled. The driver in the truck got out and said he was fine, even moving the debris out of the road and offering to move my car out of the road.

I found out today that he took 7 weeks off work for back and neck injuries, using his Workman’s comp. The claims agent at my insurance company is a little doubtful of his claim. She finds it odd that he had such major damage when he was in a truck that weighed over 10,000, while I was in a little Chevy Aveo and I had no injury at all and my car got the brunt of the impact. She said she needed to speak to him and see all his doctors notes and that she would keep me informed.

What should I expect? How does this impact my insurance rates going up (I knew they will go up because of the accident being my fault, but does an injury accident make it more expensive?) Also, do I need to worry about being sued by the other driver or should me insurance cover all his costs if they find out the injury is what he says it is ?
I never said the accident wasn’t my fault. I just want to know what to expect.

I injured my knee 4 years ago in a skiing incident and although it was mostly recovered, I had pain from time to time. Surgery was recommened at the time of the skiing incident but I declined since it seemed to be doing o.k. Now, I’ve been in an auto accident last month and have been told that my knee will only get better with surgery. I haven’t told my personal injury lawyer or the doctor performing the surgery of the previous knee injury. Will the insurance company paying the settlement be able to find out about it? If so, how will they find out? I’ve never authorized the third party insurance company to get my medical records.

I am in medical malpractice settlement negotiations with a dentist. Her insurance company was handling the negotiations, then the dentist license expired and the insurance company dropped the dentist. The dentist obtained a new policy from a new insurance company. Now the original insurance company has dropped out of negotiations. Is it possible that the original insurance company wants me to file suit against the dentist, and then the new insurance company will have to defend the dentist? Or, because the first insurance company received the initial settlement letter with notice of intent to sue, they will have to carry on and defend the dentist even though they no longer have the dentist as a client. Please clarify the typical procedure in this type of situation. Thanks a million! N.
Thanks for the info. I do have an attorney. But I do not want to sue and want to settle. The original insurance Co. made an offer, then we countered..then the Ins Co. dropped the dentist, and did not responded to the counter offer. SO, of course the attorney wants to sue cause he will make the big bucks. I want to settle because we were on track to settle. I just can’t figure why the original insurance company would want to go to court unless they really don’t care one way or another because the dentist is no longer a concern to them in the long run??? An uninsured, unlicensed driver rear-ended me on the freeway. I had under-insured and uninsured coverage. I broke my little finger and injured the adjacent ring finger on my left hand. These two fingers had previously had surgery to release from a contracture. The accident destroyed the surgical results and my two fingers are now collapsed into my palm giving me
a three finger grip. The hand can never be repaired since the
previous two surgeries resulted in enough vascular compromise that any more surgery would have a 20% chance of amputation. I was put into a cast. There was intense swelling and pain immediately. The swelling eventualy went down after 10 weeks. I was in a cast for six weeks. I did not lose work days. My car was totalled causing me to have to spend 26,000 for a replacement. The insurance company would like to settle — my old car was settled for 3,500; my hosp. bills totalled 5,000. My hand is permanently damaged. I am over 60 years of age.

I rear ended someone, and there was no injuries. How long will they take to get a bill from the insurance company? I called the auto body shop and they said the auto damage was fixable….
Is this a final bill…or will other bills come later?

My wife and I were involved in an auto accident recently. We were hit from behind while waiting at a traffic light (red).
They other diver aggreed that it was his fault. Both of us have auto insurance from same company. His policy is covering damage to my car. My insurance company (which is same as his) says I get health coverage from my policy and not his policy.

Since it is from my policy, they say, I am subjected to deductibles and co-pay.

My question is
a) Is it true that irrespective of whose fault it is, I get health benefits from my policy?

b) If the other driver’s policy is covering my medical expenses, will I still have to pay for co-pay and deductible? After all it is his fault and why should I bear additional cost?

c) I have bodily injury liability in my policy. Similarly other driver must be having the same. That means his policy should pay me.
