So heres the situation: I was in a car accident over two weeks ago. I was going to turn left when a car smashed into me, running a red light. They were totally at fault, I have witnesses. My car is drivable, but I havent been driving it to work since the bumper is off, the headlight is busted, and just basically smashed up. Anyways, I contacted their insurance company (American Access Casualty Company) which from what I’ve read is one of the worst insurance companies who will drag their feet and take forever getting back to you. They finally sent an adjuster out last week, said they’d contact me in 48 hours, and never did. I finally had to call them and leave harrasing voicemails, and they finally returned my call, saying my car is considered totalled, and the reason they havent pursued it further is because they’re waiting on a police report and they cant get ahold of the people who hit me. Im pretty sure this is just bs, as many people have told me insurance companies will say and do anything to prolong paying you. This is my first wreck, so Im not sure what to do here. I already called and made an appointment with a car accident lawyer. Im just wondering how long it should take with the help of a lawyer to get my money for my car, pain and suffering, and time without a car. Im starting school in less than 2 weeks, and have to have a way to get around. Thanks!
i had a big bruise under my chin from where the airbag deployed, but no medical bills, since i didnt go to a doctor. but i had to miss work the day after it happened because of headaches and sore bruise, so that should count for something, plus all this time ive been without a car, in my state (arkansas) they have to pay you for the time you didnt have your car. it was 100% not my fault, i did stop before going to turn, they literally came out of nowhere. i have 2 witnesses, so if anyone tries to say i am at fault at all, i have 2 peoples names and numbers who will say different.

They offered ,000 when my bills were about ,000, but I elected to have surgery because I was still in pain. The doctors had recommended surgery all along but I was afraid.

We have a lawyer and was sent a folder from American family Ins. wanting to go in to our taxes, life history, etc….. The person I hit was proven at fault in arbitration as she pulled out in front of me. I have never heard of such a thing over a car accident. The folder was sent to my lawyer and then sent to us, they sent the same to the other person. Do I HAVE to comply with this? Confused.

ok, to make a LONG story short… I was in an auto accident where i was stopped at a red light and a woman in an SUV thought the light was green and slammed into me at full speed. my car was totalled and i’ve been dealing with major neck pain. i’ve got subluxation in my neck where basically all of the vertebrea have twisted to the right side the top of my spine is crooked and the curve of my neck has been straightened. and i have a badly pinched nerve in my collarbone. it’s been 6 weeks and i’m still in pain. i am not able to do my job anymore. the chiropractor says that he sees improvement but it’s going to be a slow recovery and if he can’t fix me he will send me to a specialist. i’m either going to have to quit or i’m going to get fired because i can’t do the duties that are require for my job and i keep missing work because of it. my question is, does anybody know of some way that i can get money to pay my bills while i’m out of work? i am going to get an injury settlement but i won’t see any of that money until i’m released from anything medical. i really need time off to heal because the problem is i’ve been working and haven’t been able to heal but i don’t know if there’s some way to get money from the insurance for that? by the way, the insurance company of the woman who hit me is paying for everything. i was also thinking of leave of absence but i know i won’t get paid that way either. :( i’m getting very worried. any advice?

How to fine a good Personal Injury Attorney?

My wife was injured over a year ago by a drunk driver. The Insurance company has been slow to pay medical bills and now wants to settle for little more. I regret having to go to an attorney, but I think she deserves more. Question: How can you find a reliable attorney that will give you an honest assessment of damages and pursue the case for us? Is there a list or something. I know nothing about lawyers or the law so it will be a learning experience.




Ok, long story short, 2 years ago, i was hit head on by a drunk driver. Multiple fractures, herniated discs, was out of work for about 3 months. I have had 2 surgeries on my disc herniations. The other drive was at fault, died on the scene. He had 0,000 coverage. I have an attorney and he is about to send the final demand letter to the insurance company.

My bills are 5,000. This does not include the k already paid by my insurance company (I am in Florida)

They initially made an offer of between 50k to 90k. But that was before the surgeries.

In your opinions, what amount do you think this settlement will be? The attorney is demanding the whole policy (0,000) but I don’t think it will be the whole thing.

I was in an auto accident with 3 passengers in November 2009 and the insurance company of the car at fault keeps calling me. It was a 5-car accident and we were the last ones to get hit. I’m going to get a lawyer to deal with them but just curious on how long I have to file any claims. Is there an expiration period for this type of stuff? I live in California by the way.




We have been dealing with a personal injury lawsuit for about two years. The accident occurred in CA and we reside in another state, so we are dealing with our attorney all long distance. The case has been complicated, mainly due to an inattentive attorney from the start, whom we fired. We retained our current attorney not too long ago and the case against the defendants insurance company has been resolved and funds have been sent to our attorney. Here is where it becomes tricky. The funds for my settlement have been sent to us, the attorney is holding the funds from my husband’s portion of the settlement until a settlement is reached with our insurance company (the defendant was an underinsured driver, we had underisured driver coverage). Our attorney claims he cannot release these funds because he will more than likely need to spend the money on litigating the case against our insurance company..and it just does not make sense to me. In our eyes, the case against the defendant is closed (and in the courts eyes) I don’t see why the funds cannot be released, but my attorney alleges this is normal practice in personal injury law. Anyone have any experience with a situation similar to this? Thanks.

i went to physical therapy for about four months. i took x-rays and mri. the mri shows that i have a dislocation in my lower back. but the insurance company has refused to settle me for my injury. my lawyer told me that i should consult another lawyer to sue the insurance company. some lawyers i met are not interested in the case. can i sue the insurance company myself? if so, how do i begin?




Filing auto accident claim for injury?

In October 2009, I was involved in a auto accident. Another car crashed into my car. I got injured below my knee,and had to stay home for around 4 months, before returning to work. I never really recovered and from Feb 2011 I was again in pain and had to go on FMLA leave for the last 3 months and Im currently on short term disability.

Now my question is related to filing the claim against my insurance company ( the person who hit me did not have insurance ). Im preparing all the papers required to file the claim once I recover this time. What I want to know is what are the precautions I need to take while filing the claim with my insurance company ?

My insurance company wants to use reconditioned parts, and they are pressuring us to accept a check made out to us and the finance company. Not enough to pay it off or fix it.

My vehicle is a loaded Suzuki Grand Vitara with all kinds of electronic stuff. Which were mostly scattered across the road after the deer committed suicide. They (the insurance company) had it towed to my home after the accident because there were no dealers in the area and my home was about 100 miles closer than Dallas. Now they are saying we have to pay to have it towed the 100 miles to the nearest dealer, or use someone local.

They are also saying that we contacted the towing company and they are the ones who arranged the tow. There is no one local (car repair shop) who can work on it and get it right. I am afraid if we use someone local it won’t be fixed right. The estimate they gave us has parts coming from a salvage and reconditioned parts dealers.

I need to find a lawyer who can make them fix it right. If it can’t be fixed right then I need them to total it. I have looked in the yellow pages and all of the accident attorneys want injuries. What kind of attorney do I need for just auto damage? I have never sued anyone before. HELP!!!




I was in a minor auto accident. It was the other drivers fault. I was injured. I went to the ER the day of the accident and they said it was cervical strain from where the seatbelt lock so tight onto my neck and shoulder. 5 days later it was really bad,went back to the ER, was told that I was having a muscle spasm that would not let go. My dad was in an auto accident?

My dad was rear ended and now has permanent injuries. Should he contact an attorney and sue. He has soft tissue damage in his back and neck. The insurance company has not offered any money for pain and suffering. They are just paying his medical bills.

He has been diagnosed with perm. injuries, but will continue treatment.
Since KS is a no fault state our insurance companies pays the bills. The doctor has sent him to go have a MRI done. Also if they do offer them what is the usually and customary amount?
