There were no long term injuries. There were some whiplash injuries but all medical bills have been paid by the insurance company. The dui driver went immediately into rehab and actually has been helping other people with alcohol problems get better. He has not had a drink since the accident as he is taking this whole situation very, very seriously. The dui driver doesn’t have much money, basically enough to support his family. He is really sorry for the accident and wishes he could turn back time. We live in the Southeast and are not sure what to do. Any advice would be appreciated. Thank you!







On Jan. 14, 2011 I was involved in a auto accident. My car was wrecked in the process. I went to the emergency room that night because my legs were in pain. The cops gave me the ticket but it wasn’t my fault. I called 411-pain and went to therapy and went to talk to a lawyer. I was in therapy for almost 2 months then my lawyer dropped my case because he said I was at fault, even though I was fighting the ticket at court. My court case was dismissed. So does that mean i’m not at fault? If so can I go to any lawyer and try to see if I can get some money for my medical bills?

I have had a horrible past 3 months. I had to rent a car for 1 1/2 months because I work as a driver and that is my only means of money. I ended up spending over 00 in car rentals. I have a 00 medical bill. I was also in college at the time and my grades suffered big time. I was a A’s student and I went to C’s. I was very stressed with my insurance company because they were taking forever to resolve my case. I just want my bills paid off and some peace of mind. Please help me if anyone knows any info….




Car Accident Injury & Do I need a Lawyer?




I was in a MVC on 12-19-07, I was hit on the passenger side rear, spun multiple times befor stopping. I suffered bruised ribs, hip, and a Lumbar strain. The Other driver had ran a red light when she hit me. She left the sceen, but returned later to recover her license plate. She told the Officers that she was asleep at the wheel, and didnt know what she hit, so she left. I went to the ER, and was released. Her insurance Company is covering the car repairs, a rental car, and my medical bills. I am a Paramedic, and my job requires that I am able to lift 300 lbs with my partner, I went back to work on 12-27-07, on my first call had a Pt. that was 250 lbs, and I had extream lumbar pain when lifting, went home, then to Dr. the following day, I am now on a 30 lbs lift restrick for 30 days. I am going to be out 00 in wages, if I am able to return to work after the 30 days. there Ins. wants to offer me 0 for pain and suffering, what should I do? What am I entitled?

I was involved in a accident in which I was hit in the front & driver side I was driving an older blazer so It didn’t sustain much damage (00) However the at fault driver was in a much smaller auto that was totaled.My Knee had ruptured blood vessels, Meniscus tears, swelling,Bruising & severe pain, it Buckles & in 1 incident It caused me to fall injuring my knee even much more, I also had mild cervical strain,Right ankle sprain & upper & lower back pain. My PCP referred my to an orthopedic specialist, physical therapy & chiropractor. I have been in treatment for 22 weeks and have been released by PT & Chiropractor, to go back as needed.released by Ortho specialist to return for injections to knee as needed or other possible treatment. I continue to have pain & can’t sleep on right side but am considered as good as i will be. Also in the accident I had my 13 year old son with me who was thankfully not injured, but I drive him to & from school every day, during the 1st few weeks I could not drive and had very limited mobility. What would be a good settlement for these injuries?
The insurance company has paid to have my vehicle repaired. My Health insurance is paying for my medical bills but its my understanding that I will have to pay them back after the settlement.
What kind of injuries would these be considered? (Soft Tissue)?







I was in a major car accident with a member of the local government who ran a stop sign and caused the wreck. My truck is totaled, and suffered injuries to my knee, neck, and head. I under went physical therapy for 2 weeks and missed one week of work. Total medical bills of 00, and one weeks of lost wages. I have a lawyer and hope so settle out of court. I’m curious to know how much i might get. The local government is who we have the case against. Can anyone guess how much this kind of thing is worth? Any guesses?




Bodily Injury Question about Insurance!?




If I have a bodily injury coverage on my auto insurance, (100/300) and I am involved in an accident that both drivers (me and the other driver) are found guilty or at fault. Does my insurance cover my medical bills or not?







1. Other car was south bound, lost control and crossed the 101 divider and hit my north bound car.
2. Other driver was killed instantly. He had no insurance and a suspended license. Police report hasn’t been released yet but driver may have been drunk. Insurance was cancelled in March when license was suspended. Does lien holder on car have any liablity? How do I find out if at-fault driver has assets?
3. I was the passenger in a friend’s car. I sustained minor injuries but spent a night in the hospital for testing and observation. Medical bills will be in excess of K between ambulance, ER, doctor bills, CAT scans, etc.
4. Friend’s insurance has k/k uninsured motorist coverage.
5. My auto insurance has 00 PIP and my underinsured policy may cover the additional difference. I’m in TX.
6. I don’t want to get stuck with this bill. Already, the hospital and ambulance company are calling and sending me bills.

Any advice on how to proceed.

Mediatin in my personal injury case is this week, Im not gonnabe able to know how much i need to settle for if my lawyer doesn’t have exactly what he gets…what the medical bills are and if or how much is my settlement gonna be taxed. Car accident, should we consult a lawyer?




Should we consult an attorney about a car accident my husband was recently involved in to make sure we get the max amount we deserve? I’ll try and give you as much details about the accident as possible.

What happened: My husband was driving home from work when 2 cars came to a stop in front of him, he stopped about 1 1/2 car lengths behind them as they were waiting to turn left, about 3 seconds later a large SUV rear-ended him dead on pushing him into the van in front of him and totaling our car. He went to the ER right away but haven’t gotten the x-rays back yet. We won’t get the police report for a few more days still but it was DEFINITELY the woman’s fault. My husband is under DR’s orders to take off 1 week, and then light duty for 1 week (possibly longer after we find out the results of the x-rays), he is feeling anxious because of missing work and we have no savings so we’re stressed about bills, we have a 5 month old and he cannot help me at home, and is afraid to drive now.
Oh yes and my husband drives for a living so him being afraid of getting into another accident is taking a toll on his work performance capacity.

Mainly we want the woman (or her insurance company) to pay: the remainder of our loan, my husband’s present and future medical bills regarding these injuries, lost wages, loss of ability to provide household serivces, loss of use of property (ie the car), pain and suffering (for his physical pain, mental suffering, and emotional distress), a rental car that is comparable to our totaled car until this is settled.

Also we know that the woman has insurance and it is up to date as we have already contacted her insurance as well as ours about this accident.

So do I have a case, should we get a lawyer?
our insurance co offered us about 14k for the car, but we owe about 16k on our loan as we’ve not had this car not even 2 months. When we purchased the car we didn’t get GAP so there is around 2k that will be left on the loan if we accept this.
he was at a dead stop and the woman was going 55mph when she hit him, that is why he was pushed so far. The police officer walked the skid marks from our car and he was pushed 10 feet (I guess that’s about 1 1/2 cars length right?)

and yes I am telling 100% of the truth, I feel bad for the women who hit him as she seemed very upset but we are newly married with a young baby and had worked hard for our car and life only to have it jeopardized by this womans negligence!







I injured two discs and a rib last year in a car wreck that happened here in Florida. It’s a no fault state and everyone is required to carry their own PIP (Personal Injury Protection policy) to cover their own medical bills. The driver at fault pays for the others car and then usually will settle with the remainder that the PIP did not cover. I am tapped out on my PIP limit and now must decide what course of action I must take in order not to have to drain my savings to pay for my con’t treatment. My health insurance is paying its allowance but Im worried this will have an effect on my premium. Anyone have experience in this area?







I was in an auto accident this weekend and fractured my wrist. My car was totaled. The other driver was at fault. I’ve never had an injury in an auto accident before, so I’m not sure where this will go from here. Will I have to wait until my wrist is completely healed (I’m looking at 6-8 weeks in a splint and then possibly some physical therapy after that) to settle my claim? Does that mean that I won’t receive the replacement value of my vehicle until then? I’m not sure what to do here. I can’t go MONTHS without a vehicle, but I don’t want to settle the claim quickly just to replace my vehicle and then incur additional medical bills for physical therapy, etc. months from now. Any advice? Like I said, I’ve never been injured in an auto accident before, so I have no idea how this works.




Getting a settlement from an auto accident?




Is there a certain formula for figuring out a settlement offer? One person told me that it is usually 3x the medical bills. I’m sure it probably depends on how severe the injuries are, but in this case they were minor. My pregnant wife and I were struck from behind by another truck well stopped at a stop sign. We did visit the hospital to check on the baby, but no major injuries were sustained. We have about 00 in medical bills before insurance and about 0 after. The car has already been paid for to get fixed and is no longer an issue. The insurance company offered us 00; which is way more than what we owe in medical bills. But, what if something else is wrong with me, my wife, or our baby that can’t be forseen. Should we ask for more or should we just consider ourselves lucky to get this much? And, if so what are the steps for negoitating a settlement?




Legal Question – Person Injury Lawyer?




Silly question, but figured I would ask. I was involved in a pretty serious car accident. And was offered a settlement from the other party’s insurance company. I agreed. I was working out all the details with my lawyer and figured out he will take 33% of the entire settlement amount, which equates to over K. I was under the impression that he would get 33% of pain and suffering. He was recommended to me, and was not responsive most of the time, did not give me accurate information, I collected most of the medical bills for him and provided him with spreadsheets of all cost. My question is could I terminate the agreement? I assume not, because I am so late in the game. Or could I negotiate a lower rate, or it is too late for this as well. It kills me to give him that much money for such little work…







My daughter was a passenger in a car that went off the road and hit a tree. The driver and front seat passenger did not survive the crash, 1 back seat passenger is in critical condition and my daughter and the other passenger will heal. They received many broken bones and it will be months before they are able to walk.

I have been at the hospital with my daughter for 8 days and we will probably be here another 10 – 14 days.

We are in Michigan and are a no-fault state so our insurance will take care of my daughter. Our agent called and left a message that they would need to start an underinsured motorist claim for us.

What I am wondering is if myself and my husband will be able to file a claim against the liability portion of our insurance. I know that my daughter will receive compensation for her injuries. I am wondering if I need to initiate a claim for my husband and myself as well. I know there are time limits on that stuff but do not know much about it.

was recently hit while riding my motorcycle. I live in Las Vegas, NV so everyone is sue crazy out here. Everyone tells me I should get a personal injury lawyer to get be a settlement check. The man stopped and his insurance is claiming responsibility. They have given me no problems and have been very nice. They’re sending someone to get an estimate on my bike Monday. The accident was simple. I was riding in the far right hand lane and his car merged into my lane. I slammed on my brakes but didn’t react in time and his back bumper hit my front tire. The bike laid over on it’s right side and both the bike and I went skidding across the pavement for about 50 ft. My injuries are: a twisted ankle and road rash on my right arm (light) and right knee (severe). I went to the doctor afterwards and the insurance company said to send them my medical bills so they can settle. What are the pros and cons of getting an attorney? Should I be sue happy or trust the insurance company? Please help
My bike has a lot of cosmetic damage to the right side and I’m pretty sure the front forks are bent because I have to hold the handlebars at an angle to drive straight. Also my husband says when I sit upright the back tire leans the opposite way that the handlebars have to be turned. The bike sounds horrible but that might be beacuse the exhaust pipe is dented and scratched up and is now out of tune. I’m guessing that the bike is totalled. It’s an 07 Ninja 250 and has just under 3000 miles on it. I’m pretty sure the cost of fixing it would be more than it’s worth. I’m definately not going to sign anything without legal advise but I hate people who are sue-happy and I’d hate to be a hypocrit. Good news though, if they total it out I can get a new ZZR600 or 650R like i’ve been wanting. :P Yes I’m stupid for wanting a bigger, faster bike after wrecking my old one but I refuse to give up riding.
