The other party failed to yield the right of way entering an intersection. She was issued a citation for the accident and has current auto insurance. My wife suffered first degree burns on her arms and also back and neck pain. Her vehicle looked totaled with the front end completley caved in. Her vehicle is a 2004 Nissan Exterra with 40000 miles and it was almost paid off. We live in TX. My questions are… How much would she recieve to replace her car? Will she get a rental car to drive in the mean time? How long till this gets resolved? Should we expect a settlement for her injuries, lost wages, hospital bills? and should we look into hiring a personal injury lawyer or just let the insurance company handle it? I’d appreciate any insight thank you.

Hi, I just got a car accident 2 hours ago. I stopped at the yield sign because the cars were driving by, but then a car behind me just crashed into my car. I got out of the car but then the driver waved his hand angrily and told me to move the car the the side lane because cars are in the back. I was sitting in my car because of my neck pain, and he walked up to me. I opened the window but instead of saying are you okay? or i am sorry, he just said there is nothing wrong with your car. He told me to come out of the car. I came out and he showed me the place the crashed into and said that there’s no mark so your car should be fine and he must leave now. I asked him to give me his insurance and license number but he looked at me as if he just heard most ridiculous thing ever and said that there is no reason for him to provide any information to me because my car is in perfectly fine condition. I kept asking but he refused. Instead he gave me his phone number and just drove away. I memorized his plate number. I couldn’t call cops because I was on my way to go fix my cellphone. Right now my back and neck is in pain right now. I called my insurance company and provided all the information i had. I also called the lawyer and the lawyer told me that I must get payment for my injury, getting my car checked up, and time I must spend to do all these things. Lawyer told me that it would be hard case for me because since my car does not have any damage, there is no evidence, and I was not able to get his insurance company number and registration number. But now I kind of feel that I would have to pay more money on the lawyer because this is such a minor injury and collision. I don’t really want to spend my money on lawyers. Doesn’t your insurance company take care of all these or do I need a lawyer for this case? Thank you very much

I was in a rear-end collision in 2002 and still have back and neck pain from it…everything is documented and I have been in and out of physical therapy for years because the pain will go away and then come back again a few months later. It interferes with my ability to focus sometimes, and it makes sitting painful other times. What’s the average or ballpark amount of cash settlement I could receive from the insurance company for this?
The statute of limitations hasn’t run out yet in this case.

I was in a car accident back in September. I was at a stop light, with 2 other cars in front of me. The lady behind me had atleast 1 and a half car lengths. She was stopped also. The light turned green, the first car proceeded through the intersection, the second car moved up to make a right turn, i moved up no more than 5-7 feet. and then WAM. My car was slammed by the lady behind me. She totaled my car, I have been to a chiropractor, now I am in physical therapy awaiting to see whether or not a MRI is going to be ordered. I have had and still have to this moment Low Back Pain, and Neck pain. The other ladies insurance have been taken care of me as far as being off work, medical expenses, etc… I dont feel like I need a lawyer simply because my main concern is getting back to pre-injury status. Which is what the insurance company says is there goal. It has been a pain in the neck but I dont see being sue crazy as number one. What should I expect from here on out? I dont know if I will ever be back to normal, as I have released all previous medical history to them because I never had any medical history.

I have many symtoms of aseptic meningitis and I know this is a common thing done to test for it. I am so scared of needles. Should I go to the hospital? I went for something else a few weeks ago and dont want to seem like a hypocondriac. I am having moderate neck pain and limited mobility in it along with abdominal pain and a severe headache.

I had a Whiplash injury back in August 2010, I having been suffering with the following:
Restricted neck movement, neck pain, low back pain and right leg pain (poss Sciatica root problem) My pains are now chronic and im finding everyday activities such as walking, bending going up the stairs very difficult.
I have been diacogosed with Post Traumatic Stree Disorder and mild depression.
I also have paninc attacks thinking about the accident.
Would I be covered under the DDA act?

my wife was run off the road by a semi (he was sighted for improper lane change) there insurance company is going to offer a settlement how much should we be looking for? Her vehicle flipped 3 times (they paid us 00 for it KBB value) her hospital bill was 000 (they said they would cover it) It included an ER visit overnight stay. We are fortunate she has no broken bones no nothing physically however she had amnesia and a concussion and still has some neck pain and is freaked out to drive especially at night? we talked to a lawyer but i didnt ask (didnt know if it was proper to ask how much we should be getting) so just seeing if anyone knows? thanks

My fiancé’ & I were rear-ended Monday by someone exceeding the speed limit by 80mph. We were going about 15 mph (just pulled out and got straight in the road) The other person was doing 125 mph when we were hit. It of course totaled my car and unfortunately the other driver did not survive. I still owe about 00 on it so I am sure I will get that much for it. Their insurance company took fault of course & got me a rental car for 70 days. I went to ER that night & all x-rays were ok. I was released w/a cervical strain & a thoracic strain & a knee strain. I have only slept maybe 8 hours total in 4 days, everytime I close my eyes I see the accident, I am working b/c I can’t afford to stay out but my production is going down hill b/c I can’t focus. My neck pain is getting worse & my back as well. I went to doctor yesterday & he basically said I had strains & muscle spasm that should go away. He gave me anti-inflamtory meds & something to help me sleep but that hasn’t worked yet,
last night I still didn’t sleep, and when I do I have nightmares of the accident. My fiancé’ didn’t get hurt but he has images as well so he is going to doctor to help him rest to. We both saw the person be ejected out of the vehicle and fly in front of our car. It’s horrible. People are telling me that I can get their insurance company to give us the value of the car and still be able to settle with the medical later. One is that true? Next question, everyone is telling us to get a lawyer b/c this “post traumatic stress syndrome” that the doc told me I had could last forever and I may always have problems with my neck and back. I need help; I have never been through this before. Please tell me ups and downs and what’s the best way to handle this? At first I
didn’t want anything except to get another car. But as times goes on I am so mad that this person was traveling this fast in a 45 mph zone. Our car that was totaled was my fiancé’s late aunts. He wanted to always keep it

One year ago I was in an auto accident. My friend was driving apparently to slow for the driver behind us and was we started to pull into a parking lot they decided to speed up and try to pass us by using the sidewalk. We were hit at my door and I was turned looking at my friend in the back seat. The police cited her and her ins has accepted 100% fault. I went to the ER for head (I hit the door window) and neck pain and fallowed up with my doc. Since then I have had 3 months PT (he said he could not fix me) and still see the chiro. I had 2 MRI, CAT and several x-rays. I was placed on medications including: Valium, Percocet and Oxycodone initially but after a week asked for something weaker and went to hydrocodone which still left me sleepy so I went to IBfrofin 800, meloxican and Skelaxin. Seen a back specialist too. All agree with my doctor that my SI joint is messed up and my chiro put my back at 20% permanently damaged and will need to see him once a month forever My bills are about 9,000. I don’t want a lawyer to take money from my pain so I don’t want to have one. Now that it has been a year and my doctors say I am as good as I am going to get I was to settle. What should I do? Is there a form I can give my doctors to fill out?
Also I was 12 weeks pregnant and ended up having him at 22 weeks in which he died right after birth. With everything that happen the month after and all the medications could this have been a cause? My doctor that delivered him says he can’t tell me the reason I went into early labor. I was on seasonal and didn’t know I was pregnant till 16 weeks .
Sorry I was not clear, I just mentioned I was turned talking to my friend in the back because my spine was twisted when I was hit and injured. The Lady that hit us was faulted 100%, my friends in the car had nothing to do with my injures and even if they did I would never sue my friends.

I have been on a diet for about 1 week now and I have not drank caffeine since I have been dieting. I have had serious upper neck pain and its giving me a headache. Could not drinking soda cause this?

I have had tremors in my left arm for several years. It is getting worse. I have had neck pain over the last 2 years and it is getting worse. I am starting to get light headed and weak. I don’t understand what is going on. I have always been healthy. Please help!!!

I told them my 15 yr old son is having neck pain etc, they want Dr’s records etc but he didn’t go to Dr. I’m concerned to sign away anything before he feels no pain, even very minor pain.
Is there any magic words to put in my reply letter that would make them just submit an offer to settle this without any further issues?

My neck’s hurting as I write this. I became vegetarian about 4 months ago and the back+neck pain started around then. Are these two connected? I also experience bloating. How to solve this?

I have neck pain and some back pain so my doctor referred me to a physical theripist, he didn’t give me any suggestions just said to go to whichever is closest to where i live. What should i be looking for in a good physical theripist? Also I’m kinda scared since i’ve never been to one before. What happens there?
