6 months ago I was in fault for an auto accident. I am now being sued for 0,000 basically for pain and suffering, which is crazy to that extent because the injuries were not that severe. Both of us walked away from the accident. My insurance covers up to 0,000 so the leaves the rest to me. What typical happens in cases like this?

I was involved in an accident on July 1, 2009. I was coming through an intersection (with a green light) and a vehicle coming in the opposite direction decided to pull out in front of me and make a left hand turn. I ended up hitting them. They were found at fault. I settled with my insurance company to cover the cost of my vehicle. Damages came to about , 500 and with that amount my car was totaled. My insurance company (Nationwide) gave me about ,500, the other drivers insurance company offered me almost a thousand less. I was still financing, so the entire ,500 paid for what I owed on my car. I then hired an attorney. I sustained a concussion (which I still encounter headaches from and it could continue for years), neck and back pain, lots of bruising, bumps and burns (from the air bags deploying), not to mention the emotional trauma I am STILL going through, I dove into a deep depression from it all. I have about ,000 in medical expenses (physical therapy, doctors visits etc.) My claim has just now been passed over to the insurance company! What should I expect? What should I base my settlement amount off of? How do you determine how much you should be awarded for pain and suffering? I lost my job from the accident (because I had no car). It’s been almost a year and I still have no car. Can’t afford to buy one without a job and can’t really get a job without a car (goes hand in hand). This wreck has put me through a lot. I hope and pray it’s my last. Any advice? Anything I should go by when the insurance company comes to my lawyer with an offer? Any advice or suggestions is much, much appreciated! Thank you!

I was rear ended 4 months ago. No doubt of the other guys guilt. He received 2 tickets for it and we even have the surveillance video from the store I was turning into. My question is, I received as they call it a soft tissue injury. I was taken by ambulance to the emergency room, MRIs showed the muscles affected were spasming severely. I was put on a 5 lb weight limit and pain pills and muscle relaxers. I was unable to do even routine things like sweep my floors let alone able to even pick up my children. The insurance company is not denying their responsibility but they only want to pay me 00 to cover my pain and suffering and mental anguish due to the recklessness of their client. I missed work, I have unpaid medical bills still that are currently in collections, and I still have pain if I over due it at work to this day. They are willing to pay my medical bills of 00. I have asked for ,000 to cover what I believe the pain and suffering and the total disruption to my life for the last 4 months since their client negligently hit me. They claim the 00 is their final offer, am I asking for too much? Or are they just not willing to pay what they should. I know of people who have gotten alot more for alot less happening.
It took me 3 1/2 months to decide what I have been though does equal money because I didn’t want to sound greedy. But realisticly how else to you get validation for the heartache, pain, stress, and interuption of your life? I feel by not "paying" something they are belittling the real pain, the loss of experiences, the loss of time that I missed out and can never get back because of their clients carelessness.
Thank you to those who understand what I was asking. Boo to those of you who try to judge and down grade what I am doing. 5 months ago I may have said the same thing as some of you, then I have had to go through the hell of this "accident". Don’t judge me until you have walked in my shoes. For those of you with the good advice, I have planned on settling for less without a lawyer, mainly because the guy’s insurance policy won’t pay more than ,000 so if I used a lawyer I would probably only get -6,000 anyways. I just wanted to make sure I was on the right track. Thank you!!

Does anyone have any advice for a settlement amount for a small personal injury? I am not going to get an attorney, it was fairly minor. The fault is totally on the other party, and they’ve settled 00 for myself for minor whiplash, missed work, etc. (0 of that was for pain and suffering). We’re getting ready to settle on my son’s settlement. His nose was fractured and he had a cut inside his mouth. His medical bills are approximately 00, what should I expect for pain and suffering for him? I was in a minor fender bender 7+ weeks ago. The guy hit me and ran but come back 5 minutes or so later to yell at me for not leaving the scene. He was charged at fault improper lane change. 8 hours or so later my neck began to hurt. 24 hours later I was in bad pain went to the ER. 4 days after the accident I couldn’t hardly move my neck arms or shoulders. 6 Days after the accident I went to my first Chiropractor visit. I have been going for 6.5 weeks. I am getting better but still having pain and numbness. Insurance wants to settle now and I am still in therapy with 0 pain and suffering. I refused. Money isn’t the issue but my car still isn’t fixed cause they haven’t paid for it to be fixed. The stress and agravation sets me back medically. My friend thinks I am horrible to expect pain and suffering. What is your opinion and if I am not wrong what is fair for Severe to Very Severe Neck strain with numbness? Just let me know an idea. I am a homemaker in pain nearly constantly. TY
Thanks for your sweet words the first 2 who left me messages. My friend said why would you try to get money. It was an accident that isn’t right to try and get money for pain and suffering. She said boy I hope I never hit you cause you’ll try and sue the pants off of me. That really has hurt me so bad and I feel like telling her off which isn’t right and not talking to her. She said I never sued for money when I was hit and when my husband hit someone they never sued I never heard of such a thing. And so now I feel like the big turd for thinking I should be compensated for missing part of my spring and summer that I was looking forward to enjoying riding bikes, planting flowers doing little things without pain I mean laundry has been so hard. Grocery shopping so many things. And she thinks I am wrong for this. I was told shoot for no less than 15-20,000 since the insurance will offer less. An attorney wanted to shoot for 100,000, I think that is rediculous amount. What’s your opinion?

Question Details: i had an acccident about a year and half ago and i was a passenger. i have no health insurance and have been footing all medical bills thus far. i am writing a demand letter right now but am wondering how much should be my compensation request.
here’s a brief summary. the other driver is at complete fault. i have all soap notes from doctors,bills and reports. we were hit head on while on our way to my root canal surgery, i was having my permanent put in. i had to go in 2 weeks later wearing a cervical collar. i have choronditis, back sprains and horrible knee contusions still left on my foot. my doctor has recommended physical therapy for up to 3 months but i can’t afford to go anymore thus why i am trying to settle.
total medical bills is about 12,000 not including other misc like pills.
i just don’t want to ask too high or be taken for a fool,so please help. thanks.
also the insurance company has never made an offer they said it was a hard hit. both cars in
honey luv. thx. yes i have police reports, soap notes from doctors, medical reports, er report, all bills, xray files and copies. it is other driver’s fault b/c of failure to yield. this was a head on accident and occurred early morning. would i be reimbursed for out of pocket expenses and should i include that in my medical expenses or not?

I was recently in a car accident where a Nissan truck ran into the back of another car that then ran into the back of me causing 00 worth of damage to the rear of my infiniti. I received moderate whiplash to my neck and had to be taken to the hospital. I checked out without any broken bones and was prescribed medication.
I went to see a chiropractor and he has been working on my neck for a couple days which makes it feel a better. Im 100% not at fault and the insurance company has taken care of my car repair, rental, and medical bills. They ask me " How much do I think I want for this accident" for pain and suffering.
I believe I am entitled to at least 00-5000 for my suffering
I live in NC. I believe 00 is a reasonable consider the circumstances. I could have lost my life, broke my neck and been paralyzed for life. Thank the lord that I received only a whiplash. The stress that I am undergoing, the constant pain in my neck is a reminder of the accident, which I feel fearful of driving. The time I spent recovering could have been spent enjoying my life. Besides getting behind in my school work, I am absent from my student organization at school which I am a key figure ( president AGC). I don’t enjoy waking up with cramps and headaches nor do I like to take prescription pills, and therapy. I don’t want to be compensation a insufficient amount that wont even cover pain and suffering I went though. It seems like you people are on the side of the insurance company and not the victims in this situation. I wonder if any of you have ever been in an automobile accident and if you have must share some sort of empathy of what I am reiterating.

I was injured quite badly last year in a motorcycle/auto accident and have just received a fairly large settlement from AAA Michigan. Does anyone know if this is considered taxable income, or is it taxable in a different way?
I’ll be paying H&R Block to do my taxes this year due to a few complications in my life, but can anyone give me a heads up on this area? I need to know if I can start paying the bills accrued due to my ‘downtime’ or should I reserve some for taxes…

All past, present, and future medical bills are covered by AAA directly, and lost wages were paid in full while I was off work. The settlement is for ‘pain and suffering’ and what I need it for is to have someone finish a house I started to build before the accident. I am unable to climb on the roof, etc. like before so can’t do it myself as planned. Also there was a considerable amount of interest paid on another house I borrowed against to fund the new building. Yes, I know that amount is deductable.

Hello! 3 months ago I was T-boned by a car that ran a stop sign. My old car was totaled for 0 (91 Honda with 260K miles on it and a past total in the history). I had to get 7 stitches in my head. I didn’t miss work, though I missed two college classes that day. I have a slight scar of an inch and a half or so on my forehead. My medical bills totaled 00 after ambulance, x-ray, stitches, etc. I have police report and witnesses were there on the report. I don’t see the need in a lawyer, since it wasn’t a huge injury and I haven’t had any problems since then, but I have ABSOLUTELY no idea what a fair settlement is for a case like this. I’ve been friendly with the party-at-fault’s insurance agent as he has been to me, but I’ve been offered 0 for pain and suffering (he said that was the max) and 0 for property damage. Should I just accept this? Like I said, I’m not looking to extract as much as I possibly can, but I don’t want to get ripped off either…

I had a car accident on July 4th 2007, it wasnt my fault. I have been in pain ever since the accident and going through therapy once a week. I lost work for bout 3 weeks, I told my doctor to release me because I cant afford not to work. I want to know how I can get a claim from the other insurance company for my pain and suffering and loss wages without a laywer and getting what I deserve with my injury. And by the way my baby was with me when the accident happened and I was rear ended.

I got badly hurt in car accident; I have been to physical therapy for over a year!! I’m still in lot of pain and have trouble walking.
How long dose it take to get back to normal?

I was a passenger in an auto accident the driver was at fault. Her insurance is going to offer me a settlement for pain and suffering and my medical bills and wages. medical and wages are about 00.
