My son was involved in a single vehicle motor vehicle accident and he was treated and released from our local hospital. The insurance adjustor called a couple of days ago and she is sending us some paperwork to fill out on the PIP-personal injury protection. I realize this does cover medical bills and lost wages, but does it cover any lost items such as tools or his tool box? Any help will be appreciated.

My fil had an operation and came out fine..then in the recovery room they quit the blood thinner even though they were no supposed to – he suffered a strooke due to a blood clot due to no blood thinner and now is paralized on the left side—no lawyer we can find will touch the case because they say drs can change the paperwork and it takes too much money and time to win a case like that- where can I find a good lawyer that will help this man that use to work now he cant hardly walk.

On the front page criminal complaint it says that i am being charged for aggravated dwi -> "drive a vehicle or motor vehicle while under the influence of intoxicating liquor or drugs; and did refuse to submit a chemical breath test as required by the state law implied consent act; contrary to nmsa 1978, S 66-12-102. (a misdemeanor)".. Aggravated dwi because refusal to submit a breathalyzer. i have the paper that shows i did submit a breathalyzer test. In the paperwork that the officer filled out it said i agreed. even the mvd paper says i submitted. Unfortunately i blew enough for an aggravated. The complaint doesn’t mention the BAC.. because the paperwork complaint says that i refused mean i am being charged aggravated dwi based on a refusal? and because one page says one thing and another says the other have any effect on the charge? Does the inconsistency between the complaint and the officers story and the mvd sheet help me in any way? Is it possible to get the charge dropped? And because i blew enough for an aggravated can i be charged for aggravated dwi again? Is it all the same? Am i hoping for a miracle? any advice at all can help. i have yet to meet my lawyer but i will in a couple days. in a couple days. im trying to get all the info i can.

It was a car accident that occurred June 2009. I started going to therapy and was told by my lawyers that, it would not cost me anything just keep going. Turns out, the Doctor office filed my case 4 months late? My No Fault was denied and I was asked to just settle the case Right away. I did that, I was told I would receive 16,200.00 and I am now told I would get ,000. The Law Office tells me, I need to go and talk with the Doctors because the Doctors put a Lien of ,200 since the No Fault was denied. My Questions are: 1. Can the Lawyer without my Permission give the Money to the Doctor. 2. Can I get the money back, because I was told by the Lawyers and Doctors it will not cost me a penny and also because it was the Doctors office fault for filing my paperwork 4 months late?

I was a joint defendant in a discrimation case against myself, three other employess and our employer back in ’05. Another employee was the plaintiff and he ended up dropping the case. How long do I need to keep any of the paperwork from this like notes I took regarding his actions prior to the lawsuit, attorney/client stuff, etc? He is no longer employed with us if that matters.

I crashed into a palm tree in Surprise, AZ and was taken straight to the hospital, there they took blood test. A month later the sheriff shows up at my house and hands me the paperwork for the dui and makes me sign them or I would go to jail. Should i hire an attorney/lawyer to represent me in court. Has anyone had any experiences or recommendations for lawyers in AZ.

I had a Pre Trial Diversion. I didn’t have a lawyer so I’m very confused about what exactly happened. I just went to court, got told it would come off my record when I completed probation in six months or a year? I’m in Texas. Does this mean I was actually convicted?

In the next month, I’m visiting my boyfriend in another country and staying on base. I know there is paperwork that asks if I’ve been convicted of a crime/misdemeanor etc, does this mean I put that I have or haven’t? I don’t want the person I’m visiting to know is why I ask.

Also, if I give my probation officer the information of where I’m staying, address, number,etc, will they call the base to inquire.. I mean it was a DWI not like I’m a huge criminal? I don’t want the person I’m visiting to find out.
Well, I did get 24 hrs community service.. and an alcohol class but that is all I got other than told that I could get it expunged off my record after my probation.??
And I’m visiting out of the country.. it doesn’t come up on my passport?

I had asked him and let him know and he made it seem like it was all fine and dandy. He said all he needed to do was get permission or something with the court so I would need to give him the address, phone number, all the info of where I was going to be at before I left. I was fine until I realized he could call and ask and it would somehow get back to the person I’m visiting and I don’t want him to know. Especially since it’s HOPEFULLY going off my record.. What are the chances he’d call?? Not likely or very likely??

The complaint is against 4 parties, but recently another party is taking action. I would like to add them to the lawsuit against the 4 parties and make it 5 parties, but I don’t know what paperwork to file to do this. Any help will be appreciated.

I am a civilian attorney currently, but I am thinking about joining the JAG Corps. What are the differences in practice? In the civilian world I have a secretary who types all my documents, answers the phone, and keeps the office running. Is there the equalivant of a secretary for a JAG lawyers? How does the office run? Do the lawyers do more of their own paperwork? That’s fine by me if they do. I’m just wondering.

i am assuming this paperwork went to the Custody Judge as well as my sons Gaurdian Ad Litem.It is a Citation for driving under the influence,as well as refusal to proceed with sample for alcohol testing.Problem is,it is NOT MY CITATION!!
I have NEVER been arrested for a DUI,and it isnt even my name on the citations!!!
Would I have a case to sue my wifes attorney for slander and emotional damges for slipping in DUI arrests into my case where if a concerned person such as a judge flips through it and doesnt take time to see the person named on the citation isnt me,will just assume i am a drunk driver?What can I do?

I have paid my lawyer over 00.00 and the last time I was supposed to have court was 11/2009 and my lawyer called me as I got to the courthouse saying court was canceled because of the DA (not the first time i was told this). At that point I was already in the courthouse speaking with the clerk who told me it was my lawyers secretary who dated the paperwork wrong and there was never any court that day.

00.00 lawyer not being honest and 1 1/2 years seems like a long time to me any suggestions or help PLEASE!!!!!!! Thank you…..

You can file the paperwork yourself for a nomial fee. I won my case when the state dropped the charges. Do I need to get an attorney to have my record expunged? Should be very cut and dried since the state dropped the charges on me.

When you go retain an Attny can anyone tell me what the process should be like in the office and what the retainer agreement should say or look like? the Attny i’m thinking of hiring for my DUI his paperwork said on the top of the page FEE AGREEMENT – CRIMINAL CASE, he also does criminal cases, I haven’t signed yet or paid, so I’m wondering if that sounds like a common form or not? the rest of it states about the payments, their commitment to the client and so forth, but I noticed unlike other agreements I’ve seen on line, his does not have his name on it, only the law firm name and address, it also does not say the name of the city. Does every law firm have their own agreement forms or does it have to be identical in all law firms? when I say his name is not on the form I mean the part where it is supposed to say who represents you in the first paragraph, it does have the name of the firm on the top with his last name, and also at the end of the agreement a part where he signs. Does this sound normal? also what other paperwork should be given or what should be explained to me at the time of agreement? and should the attny be the one in the office while I retain or can his assistant take care of that?
Wolf, thanks so much, that helps alot, because this is a highly recomended Attny and not cheap, the law is doing the right thing because I’m now going through hell, one of the hardest things is the waiting, my court date is 6 weeks from now, It’s torture to wait, but I guess I deserve it.
