I’m involved in a personal injury case where the accident occur ed in August 2005. It still is not settled. A law suite has been filed but no trial. Is this at all usual?

What is a reasonable time frame of calling your attorney to check the status of your personal injury case? I know you can call anytime you want to but, is once a week or every 2 weeks obsessive? The case is to the point of the defense attorney excepting mediation/offer a settlement or going to trial. As it seems there is no other person to do a deposition on.

I got into a car accident few months ago in Seattle and my car was totaled. It was a new BMW and I had full insurance and coverage on the car, now my insurance is delaying the payment and it’s bringing all kinds of excuses not to pay full amount. Do I have a personal injury case? Should I call a personal injury lawyer to deal with my insurance at this point? The insurances now a days are just caring about their own pockets and nothing else: (

In a civil suit against a local city government, is it a good, effective strategy to enjoin their Liability Insurance Carrier, who’s adjuster, as expected, rejected the claim for damages submitted to the city’s risk management department?

Should the insurance carrier be included and listed as a co-defendant in the pleading for damages?

Or, should the suit/pleading be amended to direct the complaint solely against the city’s Liability insurance carrier and be treated or approached similar to an auto personal injury case?

Can lawyers for each side ask any question in a personal injury case even if it is designed soley to embarrass the witness and is basically irrelevant.
The question being asked has nothing to do with my injury. It pertains to my stepson who is HIV positive. I’m not sure what the purpose of this is, but I was asked about the nature of his disability during a pychological examine ordered by the insurance company, I’m concerned that this now can be brought up at trial and will be very upsetting to my wife.

Mediatin in my personal injury case is this week, Im not gonnabe able to know how much i need to settle for if my lawyer doesn’t have exactly what he gets…what the medical bills are and if or how much is my settlement gonna be taxed. Does he have to tell me exactly how much he gets before I settle? To the penny?

This is a NJ personal injury case, in which the defendant rear-ended my car which resulted in an injury. Do I need to have consent from the defense attorney for this motion? Do I need to withdraw a motion just because the defense requests it and does not want an Expedited Jury Trial?

After winning my personal injury case in court, I waited a year for the attorney to tell me there is no money. How can I check and see if all this is true? The defendents went bankrupt.

my friend is trying to find out how to file a complaint against a personal injury lawyer in florida, the guy took her personal injury case and then after doing nothing with it for 6 months turned around and told her he didnt have time for a low profile case and now she cant even collect on it to cover her doctor bills and stuff like that, she wants to file a complaint and i wanted to show her how yahoo answers kicks butt! ty for your help!

Just settled a personal injury case, and part of the settlement will be used to pay medical bills. My lawyer said his office will send the payment. Is this common and can I pay the bills myself?

When we filed for bankruptcy last year, our bankruptcy attorney asked us if we had any pending lawsuits. We replied with a yes, as I had to hire a personal injury lawyer cause of a car accident we were in. We were forced to get a lawyer because of the extensive medical bills…the insurance company of the at-fault driver refused to pay any of our bills…my medical bills were over ,000 & growing with my treatment and Dr’s. didn’t know when I’d be finished receiving treatment. With us already paying some of the bills out of pocket, it got to the point were forced into bankruptcy….there was no other way. We were told by the trustee and our bankruptcy lawyer that all monies received from the personal injury case would have to be applied toward the creditors in the bankruptcy. So in the end…these are the figures…

Leaving ,000+ to creditors. Could we have lied & gotten all of the ,000 w/out getting caught

I called my lawyer today to see how my case is going, and he said he wanted a meeting to discuss my case, what could this mean. Its a personal injury case that Began in 11/24/09.
Of course I did that,my lawyers are always giving me the run around and about a month we were waiting for a higher bid on the case.

If I decide to handle my own auto personal injury case, do I have to provide a statement to the other AT FAULT insurers insurance company? I was an injured passenger in my sister’s car and the other person was found to be 100% at fault by their own insurance company. Too, can I file a claim with my sister’s insurance and my own insurance? I am not with the same auto insurance carrier (it’s been about 2-3 months that I switched), but can I still claim with them? Can a lawyer put in an amount to an insurance adjustor to try and make a settlement for a personal injury case without first discussing it with the client?
He never even told us the amount, he just put in the offer. We were expecting it to be much higher but it is a very unique case hopefully he knows best. I thought before he put in the amount he should of at least contacted me and let me know what was going on which he never did.

Are medical lien holders allowed to take the money that is awarded or settled as pain and suffering compensation in a personal injury case.
