My cousin just got arrested for her third DUI in Indiana. she has a problem..and she has taken classes, be on house arrest twice and even had 3 months in jail, but nothing seems to work..her current arrest has 10 charges which are:
1 Operating a Vehicle While Intoxicated
2 Operating With a BAC at least 0.08 or more
3 Operating While Intoxicated With a Prior Conviction
4 Operating While Intoxicated With a Prior Conviction
5 Resisting Law Enforcement
6 Operating a Motor Vehicle While Suspended
7 Failure to Signal
8 Unsafe Lane Movement
9 Habitual Substance Offender
10 Operating a Vehicle Without an Ignition Interlock Device
…. this is while she was still on probation for her last 2 DUI’s (which i should mention this is all in a time frame of about 3 1/2 years) yeah i know its horrible..i just wonder what is going to happen next..her second DUI was already labeled as a "felony D" so im guessing this will be a felony too. She also spent jail time in another county for a public intoxication and battery to a police officer offense. She has a hearing for the Revoke of Probation coming up as well. She still owes at least 00 in court fine that were due almost a year ago. She is not working and no longer has custody of her child(he now lives with his father and step mother in a much more stable environment)..of course she has a lawyer, but with that kind of record do you think he will get her out of jail time…if so well thats just dumb of the judge..but if she does get jail time, which i think she is in desperate need of..how long might it be? i would hope its a good amount of time…maybe then she will learn her lesson and sober up for good…thanks for all the answers







My brother was recently arrested for obstructing a police officer. He gave a false name when he was being questioned while the driver of the car was having a DUI test. After giving the wrong name the police officer arrested him but let the driver go home since he was under the legal limit. Currently looking for a great criminal attorney in Springfield. For my Driver’s Ed class, I have to do a report on drinking and driving. I live in Minnesota, so please make sure any information you give to me is for this state, not any others.

I need to know what tests a police officer could make you take if they suspect your drinking while under the influence of alcohol. I already know a few things, but if someone could post some more, it would be greatly appreciated! Thanks!

I GOT A DUI.. SHOULD I GET AN ATTORNEY?




Soo this was obviously a retarded mistake on my end. and i definitely learned my lesson, but the consequences for me are stressing me out.

THE STORY:
I was coming from Irvine to Pomona ca, and I had about 2 beers and it was about 11:30pm. i was super tired because i work a lot! but on the ride home I was already falling asleep on the road but was almost home so i stuck it out. well, right by my house i hit a red light, closed my eyes and passed out.
I woke up to a police officer helping me out of the car (my car didnt move, i was just out)
The cop began to give me the field sobriety test, and i was doing perfect on it. then i notice the other officers searching through my car so i asked what they were doing, the officer responded with "their gettin your registration" i said "well i could get it for them, arent you suppose to ask for permission to search through my stuff" and then i moved a little and he grabbed my wrist, when he grabbed my wrist i reacted and pulled a little, (mind you i was OUT a few minutes before this, i couldnt even believe this was going on) when i pulled back a little he reacted and grabbed my other wrist… by that time, i got upset because he was holding me a side. then he said "ok, that it’ put the cuffs on me and took me to the station. I demanded to call my attorney, or for the officer to read me my rights, but he said " no, and I’ll read them when we get there." when we got there i demanded a breathalyzer. so then i took the breathalyzer 2 times. (I did speak to an attorney and he said there are suppose to be 2 scores) the officer gave me the breathalyzer 2x, but said we need 2 scores to get the 1.
The officer said my result was .08.

1 OPTION
I could pay an attorney to fight this all the way but it’ll be 00 (for an okay attorney) and everything can get wiped off, or turned into a wet reckless.

2nd OPTION
i could fight it by myself.

3rd OPTION
Just take the penalties, be broke for the next year, risk loosing my license which will have an affect on my business and my insurance sky rocketing.

?? I dont know if i should get an attorney, considering i dont know how i’m gonna pay for one, if they’ll budge on a payment plan, I’ve never been so backed up on my bills like this before, and I already owe 00 in bills this month.

Does anyone know a better resolution?







On July 23, 09′ on I-84E in CT I was in an accident, my car was totaled, the other driver was found at fault. My car was towed to a local shop and the police officer gave me a paper with the information to obtain an accident report. Following the accident I heard nothing from the other Ins. company I finally tracked down a phone number for them (Safeco) and started the process. I was told to get a rental and asked briefly about getting medical attention to which I received no clear answer long story short I still have not received medical attention because no one will return my calls. What should I do, my insurance company has already tried calling them with little more success? Today is August 14, 2009







the disc were l3-4, l4-5, and l5-s1. i am a police officer and was injured in training accident due to another officer’s negligence. i am unable to go back to my job due to chronic back pain and restrictions placed by the doctor. i have thirty years to retirement and dont have a back up career. what kind of injury settlement can i expect from this?. i am unsure of the laws in tennessee. thank you for any help.




Do you have to breath into a breathalyzer?




One of my co-workers was pulled over (he had 2 cocktails) and he blew into the breathalyzer and went to jail for a DWI. His lawyer said that by law an individual doesn’t have to blow into a breathalyzer. My question is what will a police officer say if you say no?

i got pulled over for a dwi ,2nd one in the past 10 years ,the police officer done the test ,breath,walk the line whole 9 yards and told me i was going 2 jail for dwi ,anyway i was pissed off i was on a date had 3-4 beers within a 5 hour period and i stoped drinking 2 hours befor leaving bar and had something to eat ,well i got to the police station and remind you my night got all screawed up cause of my passed history of the last dwi in the police’s eyes ,the cop looks at me and ask me for my age ,the guy got my id right in front of him ,i told him look on the fu**in licences .that did it they snaped ,i refused to answer anymore question i wanted my lawyer their .they said another charge ok fine ,they threw me into a jail cell the next day i get my paper work and go in front of a judge and itsaid i refuse a cheamical test ,they NEVER ,EVER ask me to take one ,,wwhat happens now ???







I had a spinal fusion in 05. Now I want to become a police officer and want to know if this will disqualify me? I have minimal pain and almost 100% range of motion. I know its a disqualification for the military (tried that) so I was curious.







Ok, First I need to know how to get a continuance for trial on my behalf without a lawyer. I have trail in two weeks and I’m not ready for court. I currently do not have a lawyer however I’m thinking about apply for a public defender one week before trial. The 1st offense DWI / speeding accusations happened in St Tammany Parish. I live in New Orleans. Do you think the public defender’s office will accept my application one week before trail? My grandmother was trying to get me a lawyer but it did not happen due to insufficient funds. What is the chances of me winning a case from refusing the breathalyzer IN ST TAMMANY? Should I ask the clerk to put me on the docket the day before trail and plea guilty under 894? If the Judge gives me probation will it transfer over to Orleans Parish. I did not drink that day, not even one alcoholic beverage. I was tired very tired I worked a 14 hour shift that day(this is not my defense). So I might look or sound slightly impaired on the police officer’s dash cam. There’s reasons why I did not take a breath test and I will explain the reasons to my lawyer only, I have no comments on an open case.
Also while I was in court for my plea I received a parking ticket that I failed to pay. The parking ticket is months old now. What do the courts do about an unpaid parking ticket in St Tammany? Issue warrants? Suspend my license?







The violator is an illegal immigrant so although he will have to appear in court, he doesn’t exist. He didn’t have a Driver Lis. and provided false insurance information to the police officer that took the report. Can I claim compensation for damages from the state? Claim it as a loss on my tax returns? My insurance already said that I will receive nothing from them considering that my car was too old to have collision insurance on it.







Will I be able to continue my duties as a police officer wearing the gunbelt, after surgery?







I was involved in an accident last fall. According to the police report, I’m at-fault. I got a summons early this yr. At the time they filed court papers, they submitted a claim to my ins co.(weird?) No one was injured at the scene, no ambulance was called. My car was towed – the police officer deemed it wasn’t safe to drive. Other party drove off with theirs

I’m in NJ. We can buy limited-tort(LT) or full-tort w/ our auto policies. My adjuster told me that they have LT. This lawsuit is for pain and suffering. Under LT, one can sue for those damages only if and when the injury is severe, resulted in death, perm. disability, ect. Neck sprain was the phrase my adjuster used to describe their injury. They didn’t request any accommodations for court that led me to believe the injury caused them any mobility problems

How often do these actually go to juried trial n how long does it take?months years?

I got into an accident around the end of october last year. At the scene the other guy’s car only had surface scratches since he owned a Mercedes and the bumper took all the impulse, my car was pretty badly totalled in the front. The first thing I did after the accident was walk out of my car to check if everyone was ok, I asked him and he said he was. So we called the police, we didn’t ask for an ambulance or nothing because it was a low speed collision and we both had seat belts on. So the police officer came and took our reports, and asked me if I was ok I said I was and he asked me if the other driver was ok as well, and I told him he was, the police officer asked the other driver as well. Now one year after the accident this driver is trying to make a claim on being bodily injured in the accident. I can prove using physics and dynamics exactly how much force was applied to his seat and through the seat belt onto him, I have the police officer as a witness, how will my case hold up
I am 100% sure he is trying to fraud me, I am pretty sure he cut me off right before a red light but that cant be proven. However the police officer can testify that he was ok at the scene, how badly his car was damaged, etc; isn’t this enough to win a jury over? What is this other guy thinking, that I am so stupid I will settle for what he askes knowing I can win the case so easily because I am innocent and he will be commiting purgery on stand by lying about his injuries? Also doesn’t he get checked by an unbaised doctor recommended by the judge to show what his injuries can be attributed to? I have Gieco insurance, will they do anything to help me prevent this obvious case of fraud? Is there any chance that this guy’s lawyer can trick a jury even with all my proof and evidence?
Thanks for any ideas, also should I contact Gieco’s fraud department and report this as such a case for investigation?
Please help me, i dont know what to do now.
