The police stated that on his report that I was not at fault, but the insurance for the other party called me and said I was at fault for this accident. Oddly, the other party’s insurance is still sending someone over to assess the damage on my car – I’m not sure how this works.
Do I have to worry about getting a lawyer, in case they still want to say that I am at fault and not pay for my damages? Or should the police report hold up for this case and I still get my damages repaired by them? I’m trying to avoid getting a lawyer, as I understand their fees are high.
Also, I did not notify my insurance yet, do I need to, even if I was not the one that hit them?

Details: It was my light and the car on the opposite direction turned left, not waiting for me to pass and hit me. Bumper came off, with major dents around, and tire busted from impact.

My husband was involved in an auto fender bender accident. The car he hit was not damaged, but the lady that was in the car insisted on calling the policy, according to the police, her car didn’t even have scratches so he couldn’t file a police report, however, he did take some pictures for documentation purpose. Later that day, our insurance company informed us that the lady has filed a claim to visit a chiropractor . We are worried that the lady is faking or beefing up the injuiry and is trying to take advatage of this situation. Will insurance company allow this to happen?

My sister was in a six car pile up. She was the third car and the police report states that she was stationary. We live in NJ.
Now, she has been contacted by the legal teams of two of the other people involved. Is this something she should be concerned about, or do they typically just go after everyone? Is there something she could do to pre-empt any legal battles? We really do not want to get a lawyer or deal with any courts but if that is the next move, we would like to know now what to expect.

insurance company now to let them know my car was in an accident or wait till I speak to my lawyer? (I was in the hospital for 4 hours getting xrays)ouch
I am not in jail, someone failed to yeild the right of way to me, now my car is totalled, there is no fixing it. the blue book is only about 2600.00 which means I must sue otherwise I will not get enough money to buy a new car. I had a lot of money into the car, brand new tires. 1000.00 worth of rims… I could go on for ever this was my baby and she’s dead.

I have only used a lawyer once in my life cause the last @ss that hit me I was a nice guy and didn’t even do a police report, he claimed that he would pay me the damage, and guess what, I couldn’t contact him for 3 months. I am sick and tired of being taken advantage of and people like you are part of the problem. reality is you cannot replace a car that you have put thousands into for blue book value, you have no idea what pride in your car is.I have terrible neck and back pain my car is totalled and you stand up for the one at fault. I hope one day your child has a similar situation and gets screwed just like you imply that I should allow. I WILL NOT ALLOW SOMEONE TO TAKE ADVANTAGE OF ME ANY MORE I AM NOT A DOOR MATT!!! if the insurance company makes a reasonable offer that is fine. but I can 99% guarntee they won’t. by the way all that claim I just cry, I want my lawyer. I have a friend that deals with these claims. and even though the insurance companies like to make you think you are getting everything that is due to you. one often doesn’t. He is there if i need him and last time I had a problem with an insurance company not wanting to pay out, he got them to. their insurance company couldn’t even get in contact with their client. there are some bad people out there, and dealing with a small insurance company I have never heard of scares me. if it were a large insurance company I wouldn’t be as worried. I am a very nice girl who has been taken advantgage of many times. I never get the long end of the stick. Im sorry that people feel they need so stereotype me in a bad way. by the way this is the next morning my jaw is killing me, my head hurts like hell, and I feel all twisted up. am alive, but are any of these pains going to impact me for the rest of my life? may need to go toadr

He did not file a police report and he says the damage comes up to 00.00 I do not believe him because my car is barely scratched but would I still have to pay him? He didn’t file a police report and we both don’t have collision on our insurance.. Thanks for all the help you can give in advance!
I backed into him.. I was a bit under the influence at the time but wasnt noticiable but he did not file a police report and it has been a week since the accident.

I was involved in a car accident on Friday. Police came, but there was no police report. Declared it was my fault. We didn’t get the insurance involved until Monday or Tuesday. The other party then claimed she had a serious injury on Weds, but she did not say she was injured on the day of the accident or previous days from Weds. Her insurance company (Mercury) is now hiring a lawyer for her. What should I do or what could happen to me? Is it possible that I could be suspended from driving as im only 19, a teen driver? Hi all,
I got in a car accident the other day (A person rear-ended me) and I just received the police report, stating that it was the other person’s fault for driving at an unsafe speed that he hit me. So I’m glad for that. Anyhow, I went to my dad’s friend who is a lawyer. My dad and the lawyer are as close as friends can be. But right now, I’m kind of suspicious of my dad’s motives. I’m thinking he is trying to get some money out of this car accident for himself and less (or little) for me. I have claimed injury and of course, damage to car body work. Is there a way that my dad can get some of the money for himself and leave as little for me?
It’s sad to say, but I don’t trust my dad. He is as sly as a snake and only cares for himself, not for the benefit of his kids. Even my mother is careful around him, and hence, they are divorced. So is there a possible way for my dad to pocket some of this money? Of course, I know his friend will. The deal split is 65/35. But right now, I’m just feeling a little uneasy about my dad.

The car hit me from behind at 60 mph on the freeway when all traffic ahead of me stopped.
The car is under my dad’s name and so is the insurance if that helps.

my car got hit police report says the other driver was at fault both airbags deployed in my car i called paramedics, had a few injuries but nothing life threatening so i did not go to d hospital? should i get a lawyer? or wait to see if insurance pays b4 i get a lawyer? who pays 4 d paramedics bill? and other tips that will help its my first accident thanks

We were involved in an accident. One party ran thru a stop sign without stopping and hit our car. Our car then spinned around and hit another car causing major damages and injuries to the 3rd car. It was reported in the police report and concluded the party running thru the stop sign is at fault. Under this situation, will the party at fault liable for everything even the 3rd car was hit by us? How will insurance company typically handle situation like this regarding the compensation?

I was involved in an accident last fall. According to the police report, I’m at-fault. I got a summons early this yr. At the time they filed court papers, they submitted a claim to my ins co.(weird?) No one was injured at the scene, no ambulance was called. My car was towed – the police officer deemed it wasn’t safe to drive. Other party drove off with theirs
I’m in NJ. We can buy limited-tort(LT) or full-tort w/ our auto policies. My adjuster told me that they have LT. This lawsuit is for pain and suffering. Under LT, one can sue for those damages only if and when the injury is severe, resulted in death, perm. disability, ect. Neck sprain was the phrase my adjuster used to describe their injury. They didn’t request any accommodations for court that led me to believe the injury caused them any mobility problems
How often do these actually go to juried trial n how long does it take?months years?
btw, only one person was involved the other party – wanted to keep it gender netural

My daughter shattered her arm in an auto accident last weekend (Friday) and had surgery a week later (Friday) to fix it. She was the passenger in the car. She does not have any health insurance. The police report states that due to conflicting stories, they cannot place who was at fault. But I was able to obtain a CD from a service station that had the accident on tape. The other party turned in front of my daughter while they both had a green light. After asking around to friends and family, nobody knows of a good attorney for me to contact! I’m looking for all of her medical bills to be paid, as well as lost wages. Has anybody had success with a certain lawyer or know of a good one I can call? I would really like a referral instead of just picking one out of the phone book. Thanks!

Can someone claim they saw you driving and then tell the cops then the cops give you a dwi even when they state in their police report they did not observe you driving or in or near your vehicle?

I was involved in an auto accident on 5/18/2008. I was driving northbound on interstate 95 headed to new york from virginia. When the accident occured I was In new jersey. Someone hit me in the passenger rear side which caused me to spin out of control and do about 3-4 360 degree turns down the freeway. I finally came to a STOP when the passenger side of my car hit the rear of an S.U.V. At that point the S.U.V stopped for a mere 1-2 seconds and sped off. I was left on the side of the highway by myself. Me and my passenger both sustained what we thought were minor injuries. An officer came wrote a police report (since there were no other vehicles that stopped he wrote it as hit/run). A tow truck then took my car off the turnpike and to the nearest local repair shop. I then had to take a TRAIN to new york from jersey to where my family lives. The next day I went to seek medical treatment for my neck/back/and right shoulder, so did my passenger. I got treatment 3 times a week from a chiropractor and got x-rays. The following week i returned home (virginia) where I found a chiropractor and had my medical files transferred. I have been seeing him since… I have seen a medical doctor, gone to get an MRI, and now have to go see an orthopedist. (The mri found i had a fracture in my shoulder) I went back to finally pick up my car from the shop the framework/ body work/ and paint had been done but they had not done anything mechanically to my car yet they insisted it was READY FOR PICKUP. i was furious so i end up driving my car back home to virginia because i could not waste any more time/money. My car still has check engine light on, abs light on, speedometer doesnt work, suspension was SHOT. the passenger side strut was blown i could tell cause that side of the car had no bouyancy (sp?) to it. I then called my lawyer and he called the insurance company and got them to replace that strut. EITHERWAY the car is still not mechanically sound and back to the state it was before the accident.
MY QUESTIONS ARE….
WHAT STEPS DO I TAKE FROM HERE?
ITS BEEN 3 MONTHS SO FAR AND MY CAR IS STILL NOT RUNNING CORRECT.
I have contacted the insurance company they told me an adjuster would come out to look at my car again and nobody has called me or showed up.
Am i sueing my insurance company?
All my lawyer has done is send out letters of representation to the doctors i have seen that my chiropractor has referred me to…

I’m being charged with domestic violence injury to property. my current lawyer doesn’t advise to go to trial, reasons being that in the police report I told them I put a hole in the wall, and this is the only evidence. And there’s no witness.
My question what is the possibility to get the case dismissed?
(The DA has offered an 1 year deferred judgement with 36 hour anger management, and this offer is exactly the same the 1st time when I went to the public hearing by my self).
