So heres the situation: I was in a car accident over two weeks ago. I was going to turn left when a car smashed into me, running a red light. They were totally at fault, I have witnesses. My car is drivable, but I havent been driving it to work since the bumper is off, the headlight is busted, and just basically smashed up. Anyways, I contacted their insurance company (American Access Casualty Company) which from what I’ve read is one of the worst insurance companies who will drag their feet and take forever getting back to you. They finally sent an adjuster out last week, said they’d contact me in 48 hours, and never did. I finally had to call them and leave harrasing voicemails, and they finally returned my call, saying my car is considered totalled, and the reason they havent pursued it further is because they’re waiting on a police report and they cant get ahold of the people who hit me. Im pretty sure this is just bs, as many people have told me insurance companies will say and do anything to prolong paying you. This is my first wreck, so Im not sure what to do here. I already called and made an appointment with a car accident lawyer. Im just wondering how long it should take with the help of a lawyer to get my money for my car, pain and suffering, and time without a car. Im starting school in less than 2 weeks, and have to have a way to get around. Thanks!
i had a big bruise under my chin from where the airbag deployed, but no medical bills, since i didnt go to a doctor. but i had to miss work the day after it happened because of headaches and sore bruise, so that should count for something, plus all this time ive been without a car, in my state (arkansas) they have to pay you for the time you didnt have your car. it was 100% not my fault, i did stop before going to turn, they literally came out of nowhere. i have 2 witnesses, so if anyone tries to say i am at fault at all, i have 2 peoples names and numbers who will say different.




About a week ago ,I got into the dumbest accident. We were both in the right most lane to turn right on the red light. It was dark and she was about to turn but hesitated and stopped at the curviture point of the turn. I thought she went, and the road was pretty clear of the traffic since it was midnight. She was about 5 to 6 ft away from me. I hit my accelerator and hit her. I was ultimately shocked. She set there for the longest crying. The EMT and fire trucks came out. I hit her at about 12-15 mph . My bumper had paint damage and popped out a little bit. Her back bumper had paint damage and her back light was broken due to the impact. She claims that she has hit her head on the steering wheel, which in my mind could only happen if she wasn’t wearing a seat belt. The trooper gave me a ticket, which I do deserve. She chose not to go to the hospital, but mentioned that she would be going to a doctor to get checked out. She also claimed that she had injuries from a previous accident that did not heel completely, which is understandable. She claimed that when she hit the steering wheel , her neck bounced back really fast and that she had headaches. My biggest fear is that she will attempt to sue me for injuries, lost wages, medical bills, and loss of happiness. I do have the insurance, but the process is going to take forever since the traffic report does not come for 10 days. Any ideas on this matter?




ok, to make a LONG story short… I was in an auto accident where i was stopped at a red light and a woman in an SUV thought the light was green and slammed into me at full speed. my car was totalled and i’ve been dealing with major neck pain. i’ve got subluxation in my neck where basically all of the vertebrea have twisted to the right side the top of my spine is crooked and the curve of my neck has been straightened. and i have a badly pinched nerve in my collarbone. it’s been 6 weeks and i’m still in pain. i am not able to do my job anymore. the chiropractor says that he sees improvement but it’s going to be a slow recovery and if he can’t fix me he will send me to a specialist. i’m either going to have to quit or i’m going to get fired because i can’t do the duties that are require for my job and i keep missing work because of it. my question is, does anybody know of some way that i can get money to pay my bills while i’m out of work? i am going to get an injury settlement but i won’t see any of that money until i’m released from anything medical. i really need time off to heal because the problem is i’ve been working and haven’t been able to heal but i don’t know if there’s some way to get money from the insurance for that? by the way, the insurance company of the woman who hit me is paying for everything. i was also thinking of leave of absence but i know i won’t get paid that way either. :( i’m getting very worried. any advice?




I have a claim against the insured driver of USAA who ran a red light. The adjuster has been unresponsive and hostile, I already filed a complaint against him. But now I must file a lawsuit, small claims court probably. Any info on how to do this?




Lets say ur insurance expired at midnight and at 2AM a car runs red light and totals ur car and seriously injures u. Clearly other driver is at fault.

But lawyer says he cant represent u cause u were uninsured. Why is that??

Wouldnt the lawyer love this since its easy money????

I was involved in a rear end collision in July last year. I was sitting at a red light in my car when a pick-up truck ran into the back of me. I got whiplash which caused me months of back and neck pain and Im currently undergoing physiotherapy treatment. I’m about to begin legal proceedings for personal injury against the driver of the car who ran into me.

My question is in cases like this in Florida, what would be a typical contingency fee percentage that an attorney would ask for.

Car accident? should I get a lawyer?

I was involved in an accident yesterday. The other driver ran the red light and tboned me such as she was found at fault. It is my first accident and im not sure how this works ionly suffered minor bruising and a concussion other than that just pure soreness and a little ake in my lower back so nothing too serious. Should I hire a lawyer and if yes is it beneficial to sue the other carrier immust wanting to make sure I get the most out of the situation I can and not leave anythingout







My 16 year old had a car accident today with a motorcyclist causing her to break her arm. I was not with him but he had two friends with him the car videotaping him and distracting him causing him to pass the red light. Two months go he got his drivers license and he and my car are both fully insured. Should I get lawyer for our court date which is in two weeks? Can the injured party bring a lawsuit against me and asking for additional money/compensation? what is the worst scenario for my son and me? I really appreciate your advice.







on 10/26/2005, i involved in a serious auto accident where i had head injuries, back injuries, arm injury, and emotional distress. the medical bills were close to 15k. I still havent recovered all the way so I am still going to the doctors once a month. i was stopped at a red light when a car lost controll and hit my car totaling it instantly. the driver of that car had full coverage insurance and so did i. i have already hired a lawyer who will represent me. around july 2007, the lady’s insurance company, allstate, offered me ,000 but i refused to sign the release form and now we are going on trial. i was just wondering how much money i will get from this because it will take about another two years. i mean the accident happened in 2005 and it looks like i wont get the money until 2010 or 2011.







I recently had a car accident. I was waiting for a green arrow to turn into the neighborhood and go to my friend’s house. By the time my "arrow" went green, as I turned, I suddenly got hit on the the corner of the passenger’s side that caused me turning 360 degrees & ended up behind that car which end up hitting the pole. There were only two of us and he was going straight on a red light but by the time the policemen came, he reported as the incident is unresolved and it’s not one’s fault because both sides claim that they had a green light. It was his fault apparently ’cause he went on a red light and "I" on the other hand, had a "green arrow" not a green light where i should be yielding to him. And so, I went to get a lawyer and they told me that I only have 50/50 chances. Which makes me mad because I was the one who got injured badly and my car got hit pretty badly as well.at the end it’s hard to determine since I ended up being behind his car. Do you think i’ll win this case?
it was the Left green arrow by the way. And he hit me the corner ( on top of my front rear wheel)
He’s a new driver and he got his driver license the day before the accident. He’s around 17 or 18 so does that help?




Car Accident Injury & Do I need a Lawyer?




I was in a MVC on 12-19-07, I was hit on the passenger side rear, spun multiple times befor stopping. I suffered bruised ribs, hip, and a Lumbar strain. The Other driver had ran a red light when she hit me. She left the sceen, but returned later to recover her license plate. She told the Officers that she was asleep at the wheel, and didnt know what she hit, so she left. I went to the ER, and was released. Her insurance Company is covering the car repairs, a rental car, and my medical bills. I am a Paramedic, and my job requires that I am able to lift 300 lbs with my partner, I went back to work on 12-27-07, on my first call had a Pt. that was 250 lbs, and I had extream lumbar pain when lifting, went home, then to Dr. the following day, I am now on a 30 lbs lift restrick for 30 days. I am going to be out 00 in wages, if I am able to return to work after the 30 days. there Ins. wants to offer me 0 for pain and suffering, what should I do? What am I entitled?

About a weekend ago, my hubby was driving home and stopped at a red turn signal. It was icy, bad conditions. He waited until the turn signal turned green and started into the intersection when he saw a snow-plow come into view, so he stopped for a few seconds to make sure the guy was going to slow down (the guy had a red light.) The guy slowed down, so my hubby thought it was clear and pulled to go through, but the guy DIDN’T stop and plowed into him. My hubby tried to speed up but with the ice he couldn’t get clear.

The plow showed no damage. My hubby’s car (our family car) had the rear passenger door slammed into place (we can’t open it), the gas-cap slammed into place (we can’t open it), and the front door slammed into (we can open it, but it creaks and pops when we do.) Because it was early in the morning, there were no witnesses.

Because there were no witnesses, the other guy is claiming my hubby ran the red light, not him, and that it was completely his fault. Since there are no witnesses, the other guy’s insurance company is claiming no liability, meaning that we aren’t going to get anything to try and fix our car. They did not look at our car to even try and determine how it was hit or whether that could tell them anything.

My husband has never had so much as a speeding ticket. He has never run a red light (even when I was giving birth) and has been driving for 14 years without ever having an accident.

The other company said that at this point we contact our insurance agent and let them argue back and forth, but I’m starting to think we should get a lawyer, one that deals in stuff like this, and let him handle it.

Do you think we have a case? What sort of lawyer should I look for?
The thing is, it costs nothing to talk to a lawyer and a lawyer who is experienced in this sort of thing would be able to tell us if we have a case or not. Also, there’s a statute of limitation that after so many weeks after an accident, you can’t GET a lawyer, so that worries me too.
I see your point. I still disagree that it was my husband’s fault. We don’t have collision insurance, so this is going to be hard to handle.

As for why he didn’t stop… the fact is he did. He was pulled into the intersection (ie, he was not safely to the side) and saw the truck coming up the hill. He knew the truck had a red light, but he stopped anyway to make sure the truck was under control. So he started his turn, and then stopped to assess the approaching vehicle. It appeared to slow down, so he assumed it was stopping and continued with his turn. If he had stopped and let the truck run the light, his car wouldn’t have been hit… but he would have been in danger of another car hitting him if it had come over the hill because his nose was sticking into the intersection.

When the other driver saw him already turning at the intersection, he should have stopped (besides having a red light.) But, there are no witnesses. Makes you wish every car had a dash-camera.




I GOT A DUI.. SHOULD I GET AN ATTORNEY?




Soo this was obviously a retarded mistake on my end. and i definitely learned my lesson, but the consequences for me are stressing me out.

THE STORY:
I was coming from Irvine to Pomona ca, and I had about 2 beers and it was about 11:30pm. i was super tired because i work a lot! but on the ride home I was already falling asleep on the road but was almost home so i stuck it out. well, right by my house i hit a red light, closed my eyes and passed out.
I woke up to a police officer helping me out of the car (my car didnt move, i was just out)
The cop began to give me the field sobriety test, and i was doing perfect on it. then i notice the other officers searching through my car so i asked what they were doing, the officer responded with "their gettin your registration" i said "well i could get it for them, arent you suppose to ask for permission to search through my stuff" and then i moved a little and he grabbed my wrist, when he grabbed my wrist i reacted and pulled a little, (mind you i was OUT a few minutes before this, i couldnt even believe this was going on) when i pulled back a little he reacted and grabbed my other wrist… by that time, i got upset because he was holding me a side. then he said "ok, that it’ put the cuffs on me and took me to the station. I demanded to call my attorney, or for the officer to read me my rights, but he said " no, and I’ll read them when we get there." when we got there i demanded a breathalyzer. so then i took the breathalyzer 2 times. (I did speak to an attorney and he said there are suppose to be 2 scores) the officer gave me the breathalyzer 2x, but said we need 2 scores to get the 1.
The officer said my result was .08.

1 OPTION
I could pay an attorney to fight this all the way but it’ll be 00 (for an okay attorney) and everything can get wiped off, or turned into a wet reckless.

2nd OPTION
i could fight it by myself.

3rd OPTION
Just take the penalties, be broke for the next year, risk loosing my license which will have an affect on my business and my insurance sky rocketing.

?? I dont know if i should get an attorney, considering i dont know how i’m gonna pay for one, if they’ll budge on a payment plan, I’ve never been so backed up on my bills like this before, and I already owe 00 in bills this month.

Does anyone know a better resolution?







While I was making left turn at the intersection upon the signal turning green, I was broadsided. The other driver was clearly running the red light, but claimed she had the green light. There was no witness and the police report didn’t specify who’s at fault. No injuries on both parties. Does anyone know what the California laws/rules say about the case like mine?

Just got into a car accident, I’m completely fine except for a few scratches and bruises, but my car is totaled (go seat belts!). I have another car I can use so I won’t be missing work or anything. After the accident, they took me to the hospital, they checked me up and gave me x-rays where it hurt but found nothing. The driver a fault was totally drunk, ran a red light and hit me. Everything is his fault. There was a witness that reported that to the police.

So given those circumstances, is it worth getting a lawyer?
Also, the driver at fault does have insurance.
