My fiancé’ & I were rear-ended Monday by someone exceeding the speed limit by 80mph. We were going about 15 mph (just pulled out and got straight in the road) The other person was doing 125 mph when we were hit. It of course totaled my car and unfortunately the other driver did not survive. I still owe about 00 on it so I am sure I will get that much for it. Their insurance company took fault of course & got me a rental car for 70 days. I went to ER that night & all x-rays were ok. I was released w/a cervical strain & a thoracic strain & a knee strain. I have only slept maybe 8 hours total in 4 days, everytime I close my eyes I see the accident, I am working b/c I can’t afford to stay out but my production is going down hill b/c I can’t focus. My neck pain is getting worse & my back as well. I went to doctor yesterday & he basically said I had strains & muscle spasm that should go away. He gave me anti-inflamtory meds & something to help me sleep but that hasn’t worked yet,
last night I still didn’t sleep, and when I do I have nightmares of the accident. My fiancé’ didn’t get hurt but he has images as well so he is going to doctor to help him rest to. We both saw the person be ejected out of the vehicle and fly in front of our car. It’s horrible. People are telling me that I can get their insurance company to give us the value of the car and still be able to settle with the medical later. One is that true? Next question, everyone is telling us to get a lawyer b/c this “post traumatic stress syndrome” that the doc told me I had could last forever and I may always have problems with my neck and back. I need help; I have never been through this before. Please tell me ups and downs and what’s the best way to handle this? At first I
didn’t want anything except to get another car. But as times goes on I am so mad that this person was traveling this fast in a 45 mph zone. Our car that was totaled was my fiancé’s late aunts. He wanted to always keep it
because of sentimental value & also so that when we got it paid off we could also use the title for collateral…which we can’t do now. Any advice will be much appreciated. Thanks in advance.

I was in an auto accident, the police came but didn’t make a report because we both said we weren’t hurt and all she had was a small crack in the bumper. we are both insured but she didn’t want to go through insurance. I tapped her bumper from behind because she made a right turn and once I saw it was clear I made my right turn on a green light. As soon as I turned the corner she was stopped there and I couldn’t stop my car in time so I hit her bumper. The police said it was minor under 0 in damages on her 2000 mitsubishi gallant, her estiamte came to 8 plus rental car total of 6. My dad won’t let me claim with insurance he thinks we will lose our discounts. Should I have a lawyer review my claim relase form I’m sending to her to sign before I pay her? I got a claim release from off a legal form website…I’m worried this lady is shady, but we can’t afford increased premiums. I have Geico in CA, does anyone know there claim threshold for surcharges?
I was not driving fast for road conditions…Se slammed on her brakes and stopped for no apparent reason, I never drive fast and I don’t tailgate this was just an unfortunate accident

I was recently involved in a car accident. Someone ran a red light & hit the front drivers side & her back end swung around and hit the back drivers side of my car going about 40-50 mph totaling my car. I was rushed to the ER before I could get any of her information & the police officer was supposed to come to the ER to talk w/me & give me a police report #, He never came, but there were 3 witnesses that talked to him stating they saw the whole thing & she ran the red light. I have no information about her, her insurance hasn’t contacted me, & I am waiting on the police report. My insurance has covered for a rental car for now.
My 6 month old son was in the car with me, the paramedic checked him out & he has had a followup with his Dr. & they said that he looks fine, but it just shook up. My head hit the steering wheel & slammed against the window. I have a bump on my head that is black & blue & my forehead and whole left side of my body is bruised. I have had a constant headache & my neck, back & body is all stiff & is in a lot of pain. I followed up with a Dr. but he told me that I am just telling myself that I am in pain, he looked at the floor the whole time & he would not even look over me. I am in the process of going to another Dr.
I have never been involved in an accident to this extreme before. Should I get a lawyer? or should I just try to work with the insurance company myself?

recently I had a car accident, a semi truck rear ended me totaled my car, I had neck injury. the lawyer recover 00 for me(included all medical, car rental expense), he want to charge me 00 33.3 % of the settlement . But however my medical expense is 00 and my rental car car expense is 0. This basically leave 0 for my wage lost and other pain and suffering. my question is can lawyer take a percentage on my medical bill, rental car which in my opinion those arematerial demage, and I think they should just take the percentage from my wage, pain and suffering demage. Please advise regards

Well medical expense and car rental expense I could recover without lawyer. Because these arewith a fixed cost. I had an accident 10 years ago and I just files the cliam against the other party’s insurance company. They assign me a rental car the very next day, and also they pay for my emergency room visit. since this time my accident was more serious I hire a lawyer. but however he didn’t get me a rental car the lawyer ask me to go rent car out of my pocket first which I think their motive is take a percentage on my rental car expense they recover. so that why I think why should take a percentage on my rental car expense (they couldn’t get a settlement for the demage of my car for 4 weeks so I had to paid 800 dollar for rental car the lawyer could’ve just ask the insurance company to rent a car for me) and medical expense is fixed cost as well. the motive is truly questionable
