My separated husband for 2yrs will not sign off to a claim adjuster for the car I paid for and have driven for 3yrs. I unfortunately never got his name off the title either. I already have a lawyer because the total was due to a teen running a stop sign without a license for injury, but they are saying they can’t help with the property issue i am having. Isn’t there SOMETHING I can do?? It’s bad enough I will only be getting 1,800 for the total of the car.

I was driving a school bus and a 16 year old ran a stop sign, hit my bus, and tipped us over. I had 15 kids on board (3 of my own). She failed her drug test and all she got was a ticket for failure to yield. Our county attorney said nothing can be done about failing the test because you can’t prove how long marajuana has been in the system. So she got away with it in my mind. Also, the kids at school said she was making a big joke out of it, and now she’s out driving her parents new vehicle like nothing ever happened. Luckily there were just minor injuries to some of the students, but it was very scary to all of us. Isn’t there anything else that can be done? I think she should have gotten her license suspended. She had just gotten a speeding ticket a couple months prior to this too. The attorney says that’s not enough to take her license away.

I was in a major car accident with a member of the local government who ran a stop sign and caused the wreck. My truck is totaled, and suffered injuries to my knee, neck, and head. I under went physical therapy for 2 weeks and missed one week of work. Total medical bills of 00, and one weeks of lost wages. I have a lawyer and hope so settle out of court. I’m curious to know how much i might get. The local government is who we have the case against. Can anyone guess how much this kind of thing is worth? Any guesses?

Is there a certain formula for figuring out a settlement offer? One person told me that it is usually 3x the medical bills. I’m sure it probably depends on how severe the injuries are, but in this case they were minor. My pregnant wife and I were struck from behind by another truck well stopped at a stop sign. We did visit the hospital to check on the baby, but no major injuries were sustained. We have about 00 in medical bills before insurance and about 0 after. The car has already been paid for to get fixed and is no longer an issue. The insurance company offered us 00; which is way more than what we owe in medical bills. But, what if something else is wrong with me, my wife, or our baby that can’t be forseen. Should we ask for more or should we just consider ourselves lucky to get this much? And, if so what are the steps for negoitating a settlement?

I was drinking early that night about, 2 drinks. I know my limit, I know the law. Under 0.08 and I had no reason to believe I was over 0.08 so I assumed It was safe to drive. I was driving home when I decided to take a short cut. A cop was parked on the opposite side of the street from several clubs/bars. I decided to turn on the street opposite to where he was parked instead of going straight since I already had my signals on when I realized there was a cop parked there so I didn’t want to be bait. I knew as I was turning the cop saw me, I knew I had every possibility of getting pulled over so I obeyed the law, so that I wouldn’t give him a petty reason to pull me over. He didn’t follow me to see if I was breaking any laws, he caught up to me at a stop sign and turned his lights on. I put my car in park assuming he was after me. He got out and said “that he would catch me at the stop sign.“ He asked for my license, as I was handing him my license he told me that he was on the look out for someone. IMO he was not telling the truth because of the way he kept described me and my vehicle. He made it sound like he was only slightly off. He asked where I was coming from, I really didn’t want to tell him, in order to avoid the question about if I had been drinking. I kept going on about him getting the description completely wrong, and bluntly said that I though he was lying.. and that next time he should get the description right unless he was color blind. (I wasn’t giving him “attitude,” I sort of found it funny) He asked If I had been drinking. I told him the truth. He ran a couple of tests on me. I ended up doing the test no problem, I got back in my car and he ran the eye test on me about 5 times before he went back to his car bought out a breathalyser. I’m not sure how much I blew roadside but back at the station which is not more then 5 mins away I blew somewhere around a 0.039. Which probably makes it impossible for me to be over the 0.08 mark?
I’m a very realistic person. I have nothing against him but realistically speaking I think that this his intentions were not the same for pulling me over as he says it was. His probable cause was what was radioed to him that night, which, if I had the chanced to look though what really happened that night on his shift, It would be recoded somewhere and IMO there would be nothing recoded in that regard about a suspicious vehicle/person at the time he was pulling me over.
I feel that what he did was a rookie move, a boring night mixed with a little bit of discrimination (the fact that im young, out at 2am on a Saturday night) is what gave him a reason pull me over.
I guess my question is since this feels so petty I really don’t feel like spending $$$’s on a lawyer so what are the chances I could get this DWI thrown out by representing myself?
Since when Is being below 0.08, with no probable cause breaking the law?

The young woman was cited for failing to yield/ran a stop sign. My husband was driving our car to work when it happened. After a few minuites he began to feel sore in his shoulder & neck. The Ambulance was called to look at his shoulder and neck area. They put ice on it & advised him take Advil. Now he is feeling pain & soreness. He is a server ,so he lifts & uses the arm to make a living.
This all happend on Disney property, in Florida.
So, what do you suggest we tell her Insurance company to make sure this is handled appropiately and we don’t get taken ?

We were involved in an accident. One party ran thru a stop sign without stopping and hit our car. Our car then spinned around and hit another car causing major damages and injuries to the 3rd car. It was reported in the police report and concluded the party running thru the stop sign is at fault. Under this situation, will the party at fault liable for everything even the 3rd car was hit by us? How will insurance company typically handle situation like this regarding the compensation?

I was struck on my motorcycle by an unisured motorist that ran a stop sign, breaking a total of 9 bones, I’ve had 4 operations and I still have 1 more to go. My bills have hit over $ 300,000 the woman that hit me got less than a 00 in fines and is already driving again. I think it should be a $ 2000 dollar fine and they lose their auto to be sold at auction and drivers license for a year. The fine and money gained from the sale of their car should go into a fund to pay the victim’s. Once they are hit with a fine and loss of their car and license maybe they will think twice about getting behind the wheel and not having insurance. Because let’s face it, if you can’t afford insurance you cant afford to drive.

I was in an auto accident where the other driver ran a stop sign. She was issued the ticket and declared at fault, I have a witness who has given a recorded statement to the insurance company to that fact and also on the report for the police. My two small children were in the car but the main impact was on my side and door. I went to the hospital as soon as I could after (when husband came home because my car was towed) Damages on car are 6,000.00 and so far it looks like med bills will be over 3000 easy. I have an MRI next week but we think it is a bulging or herniated disc in my back. I also had whiplash and head problems from head hitting window (nothing serious, but blurred vision and headaches). I have been out of work 3 wks already and can’t do much at home ( I am a homemaker by day and hair stylist by night and weekend) I can’t stand for long or even sit up for long. Anyone know what we can expect?
I am not looking to get rich but I am looking for what is fair. This was completely the other drivers fault and I have proof in the form of a witness and her ticket. My father is a lawyer but he doesn’t do this sort of case much anymore so he said he would refer me to someone if he thought we would be better off than with just the insurance company.

Is it really necessary? I got in a car accident this morning in my neighborhood, actually right in front of my house. I pulled to the stop sign and was going to turn right but realized I forgot something, so I just did a u-turn in the intersection. I was hit on the driver side, which happened after I made the full u-turn. It was reported as my fault, of course. But the other driver hit and ran. I couldnt even get a tag number or a full description. I didnt go after him, because for one I had an infant in the car screaming. Thankfully, neither of us were hurt. So I am not claiming any medical, just collision to get my car fixed. Everyone is telling me to call a lawyer. But, I really dont see the point, I am not claiming anything else other than repairs on the car.

Hello! 3 months ago I was T-boned by a car that ran a stop sign. My old car was totaled for 0 (91 Honda with 260K miles on it and a past total in the history). I had to get 7 stitches in my head. I didn’t miss work, though I missed two college classes that day. I have a slight scar of an inch and a half or so on my forehead. My medical bills totaled 00 after ambulance, x-ray, stitches, etc. I have police report and witnesses were there on the report. I don’t see the need in a lawyer, since it wasn’t a huge injury and I haven’t had any problems since then, but I have ABSOLUTELY no idea what a fair settlement is for a case like this. I’ve been friendly with the party-at-fault’s insurance agent as he has been to me, but I’ve been offered 0 for pain and suffering (he said that was the max) and 0 for property damage. Should I just accept this? Like I said, I’m not looking to extract as much as I possibly can, but I don’t want to get ripped off either…

I’m looking for things to build my case because my lawyer seems to not be interested in doing it. I wasnt red my miranda rights…when they sent all my information to my lawyer the sent someone elses driving record…the information they sent said the officer did the breath test and actually a college student working there did everything the officer just stood in the room…i was only pulled over for turning right out of a straight lane because i missed the turn lane that was hidden by trees (stoped at the stop sign used my blinker)…pulled over off the road in MY APARTMENT complex (no traffic didnt drive bad, never even saw anyone else on the road…so i didnt endanger anyone)…Also I’ve tried to research it but havnt found anything, I have hemophilia and was wondering if there was anything that has to be done different when breath testing, arresting or incarcerating someone with hemophilia…any information will help thanks.

No crash, criminal record, anything. Got pulled over for incomplete stop at stop sign and got a DUI (chose blood test over breathalyzer). If I’m not contesting the DUI, is it still worth it to get an attorney? Or just go in myself and plead guilty? The attorney fees would come in real handy elsewhere, but if it helps…

in October 2008, will be 2 years for my car accident. 2 months ago, my lawyer told m he can no longer proceed with my case unless i pay him hourly instead. Bills started to come to me–before i was on a lien. i just do not know how to deal directly with the insurance. I was rear ended, and it was not my fault.
My insurance is AMEX and the other driver is CAIGO.
1) i have dr bills ,000 +
2) MRI ,000 +
3) EMG ,000+
4) physical therapy ,000
5) surgery 18,000 +
6) 2 months disability report for my doctor
7) medicin2 only 0 ( i hate tranquilizers)
My insurance covers 100,000 underinsured motorist
My car bumper were only damaged, and its cost was only about ,500. i did not have police report at the scene, but after 5 days i went to the hospital with severe back pain…and the trauma began.
how should i start? should i add all the bills and double them and just ask for settlement for the amount?

i wasn’t in a natural position when the accident happended. i was totally stopped and twisting my neck and bending my back to have a clear view of the trafic–curved street stop sign.
i did nto demand any ammount..all i know my lawyers was asking 0,000 from own insurance and whatever from the other insurance. and he said we will see what happens..all the sudden he dropped towards the end.
my own health insurance so far paid for physical therapy visits, everything else was on alein, and now i start to get bills.

Its been almost two years since I was in an accident. The other driver was at fault. The insurance company paid on my car but have not paid my hospital bills. Whats the deal.
car 1 me traveling north car 2 at stop sign pulled out hitting my cars rear quarter panel drivers side sending my car into south bound lane to be hit broad side by on coming car. then hitting a telelphone pole as car left the road.
