I am sure that you are as eager to settle this matter as I am, so I appreciate your being able to get back with me regarding my claim. However, I believe that the offer you presented will hardly suffice the damages and inconvenience I have occurred due to your client’s negligence.
As a result of the accident on March 19, 2007 I continue to have muscles spasms resulting in neck and back pain. My primary physician Dr…..has recommended that I complete physical therapy as a follow up from the chiropractic care I received. I will begin therapy next week with my initial consultation, and from that I can provide you with the estimated time and cost. Also, because the medication I was on caused severe drowsiness while awake I have been prescribed additional medication for the early hours, and for when I’m at work.
To my understanding of the research I have done and the questions I have asked my physicians, back pain from injuries involving auto accidents rarely go away completely. I will be faxing over additional documents that will support my claim, and hopefully from there we will be able to conclude a satisfactory agreement that will cover cost, suffering, and the additional therapy that I will need.
Also, I can get the cost and time for the recommended therapy, but I cannot afford to pay for it out of pocket. will i have to complete therapy before they settle?
and is it reasonable to be compensated for any discomfort i believe may continue in the future

I have been dealing with unbearable pain for just about 2yrs. It started a few months after the epidural I recieved with my youngest child. I finally went to the doctors about a yr and a half ago complaining of the pain. They put me on tramadol and sent me to get an x ray it came back normal, so I asked about getting an MRI. I also went to an rhumatologist (RA) who diagnosed me with fibromyalgia and when I told her of the back pain she argued with me saying its just your fibromyalgia. They told me do to my insurance that I had to go through a process which was x ray, physical therapy, mri. I was all for it ,well they never did anything, so a month ago I went to my regular doctor again and told her I wanted an mri or a referral to someone who could help me ( I was at my wits end with pain and all the other suffering to much to type) so she sent me to an orthopedic doctor. They got me in the beg. of dec for an MRI and I got the results today saying I do in fact have a bulging disc. My question is do I have a chance at a law suit ?
It wasn’t just misdiagnoses they didnt attempt to do anything for a long time even though they knew I had to complete certain things to get the mri. Plus all the times they never refilled meds to ease the pain all the times my daughter saw her mother crying in pain that was so bad it made me sick, pale etc. All any one did was say o well you need an mri but here are more meds and we cant or wont do the mri.

I had a Whiplash injury back in August 2010, I having been suffering with the following:
Restricted neck movement, neck pain, low back pain and right leg pain (poss Sciatica root problem) My pains are now chronic and im finding everyday activities such as walking, bending going up the stairs very difficult.
I have been diacogosed with Post Traumatic Stree Disorder and mild depression.
I also have paninc attacks thinking about the accident.
Would I be covered under the DDA act?

Is medical for the med bills the other party receives & bodily injury is for the settlement of the claim, pain & suffering and the settlement of permanent residuals? Thanks

i was rearended, the guy only had liability insurance. bodily INJURY WAS MORE THAN POLICY LIMITS. MY AUTO INSURANCE EXHAUSTED PIP LIMITS. I HAD TO HAVE AN ANTERIOR CERVICAL FUSION. DOES THIS ALL GET PAID FOR AS WELL AS REIMBURSEMENT FOR MISSED WORK, AND OUT OF POCKET EXPENSES AND VEHICLE DAMAGES AND PAIN/SUFFERING/INCONVENIENCE?

I am going to be receiving settlement money from a Personal Injury Mental Anguish Claim. I live in Texas. Is this taxable?
Based on the recent conflicting responses: a few more details: This is a suit made for mental damages due to sexual assault. The case is purely mental anguish/suffering. There is not a physical component.

I got badly hurt in car accident; I have been to physical therapy for over a year!! I’m still in lot of pain and have trouble walking.
How long dose it take to get back to normal?
How do I handle pain suffering settlement?
What is fair to ask for, based on the fact it is 100% the other person fualt and I have had to go to miss ove 1000 hour of work and go painfull re-hap for a year. Moreover still have trouble walking??
What should I be doing to get well?
My Doc seams to be doing nothing?
I need to find a better Lawyer and doc in OC, CA,
Please give any suggestions you might have ASAP!
