About a week ago ,I got into the dumbest accident. We were both in the right most lane to turn right on the red light. It was dark and she was about to turn but hesitated and stopped at the curviture point of the turn. I thought she went, and the road was pretty clear of the traffic since it was midnight. She was about 5 to 6 ft away from me. I hit my accelerator and hit her. I was ultimately shocked. She set there for the longest crying. The EMT and fire trucks came out. I hit her at about 12-15 mph . My bumper had paint damage and popped out a little bit. Her back bumper had paint damage and her back light was broken due to the impact. She claims that she has hit her head on the steering wheel, which in my mind could only happen if she wasn’t wearing a seat belt. The trooper gave me a ticket, which I do deserve. She chose not to go to the hospital, but mentioned that she would be going to a doctor to get checked out. She also claimed that she had injuries from a previous accident that did not heel completely, which is understandable. She claimed that when she hit the steering wheel , her neck bounced back really fast and that she had headaches. My biggest fear is that she will attempt to sue me for injuries, lost wages, medical bills, and loss of happiness. I do have the insurance, but the process is going to take forever since the traffic report does not come for 10 days. Any ideas on this matter?

My son was involved in a single vehicle motor vehicle accident and he was treated and released from our local hospital. The insurance adjustor called a couple of days ago and she is sending us some paperwork to fill out on the PIP-personal injury protection. I realize this does cover medical bills and lost wages, but does it cover any lost items such as tools or his tool box? Any help will be appreciated.

I was involved in an auto accident, after almost 5 yrs I was just served with a lawsuit for 100,000. I was 18 at the time of the accident and had full coverage but only 10,000 in bodily injury, loss of wages, etc. I have looked for Attorneys practicing in auto accidents, however, it seems they all want to represent the person suing. I recived a 3 inch long bone deep laceration to my left wrist. My radial nerve, brachialas muscle, brachialas tendon, and anything from skin to the bone was lacerated. I had surgery for that injury on July 17, 2006 I had the injury on July 12, 2006. Here i am a little over a year after this happen confused whether to trust my lawyer over how I will paid. I would think that I would get money for the traumatic experience along with loss wages. My lawyer is only saying that I will be paid for loss wages from the time that I was hurt and out of work. Yesterday at a court appearance for child support my husbands girlfriend (angry about the amount of child support) smarted oFf to me and said "I would never see any of his accident money either" This originally confused me I found out today he was in a auto injury in January of this yr I filed for divorce in February none of this was even mentioned before. I knew he kept buying new vehicles but he would put them in her name, I had no idea of an accident. My question is since we are legally married, but separated due to Domestic violence (this was a no contact order the judge made, for an assault on me) am I still entitled to any of his claim? I would really like to know any information or links that I can review and see about pursuing with an attorney, if its really an option. I did read that any money for lost wages and future wages was subject to child support is this true?

My wife and I had a car repoed earlier this year and now the collection agency is treatening a lawsuit or the lender Toyota is.
I need to buy some time 3-6 months so I can pay the settled amount.
The creditor has said that want to put a lein on our home and ganish our wages.
Does anyone have a suggestion on how to get them to stop the collection/lawsuit?

I was in a MVC on 12-19-07, I was hit on the passenger side rear, spun multiple times befor stopping. I suffered bruised ribs, hip, and a Lumbar strain. The Other driver had ran a red light when she hit me. She left the sceen, but returned later to recover her license plate. She told the Officers that she was asleep at the wheel, and didnt know what she hit, so she left. I went to the ER, and was released. Her insurance Company is covering the car repairs, a rental car, and my medical bills. I am a Paramedic, and my job requires that I am able to lift 300 lbs with my partner, I went back to work on 12-27-07, on my first call had a Pt. that was 250 lbs, and I had extream lumbar pain when lifting, went home, then to Dr. the following day, I am now on a 30 lbs lift restrick for 30 days. I am going to be out 00 in wages, if I am able to return to work after the 30 days. there Ins. wants to offer me 0 for pain and suffering, what should I do? What am I entitled?

I was in a major car accident with a member of the local government who ran a stop sign and caused the wreck. My truck is totaled, and suffered injuries to my knee, neck, and head. I under went physical therapy for 2 weeks and missed one week of work. Total medical bills of 00, and one weeks of lost wages. I have a lawyer and hope so settle out of court. I’m curious to know how much i might get. The local government is who we have the case against. Can anyone guess how much this kind of thing is worth? Any guesses?

I am in the middle of a lawsuit with the insurance company and have received a settlement for loss of wages, and am awaiting for mediation for the tort case. My question is, does a lawyer take their cut from both the loss of wages AND tort settlement? I was under the impression that they were not allowed to take anything from your loss of wages settlement.

The other party failed to yield the right of way entering an intersection. She was issued a citation for the accident and has current auto insurance. My wife suffered first degree burns on her arms and also back and neck pain. Her vehicle looked totaled with the front end completley caved in. Her vehicle is a 2004 Nissan Exterra with 40000 miles and it was almost paid off. We live in TX. My questions are… How much would she recieve to replace her car? Will she get a rental car to drive in the mean time? How long till this gets resolved? Should we expect a settlement for her injuries, lost wages, hospital bills? and should we look into hiring a personal injury lawyer or just let the insurance company handle it? I posted an earlier question asking for help in an accident I was recently involved in ((DUI/meth abuser hits bicyclist = broken back). I received a lot of useful info, but have a few more questions. I’ve been told by some people that have successfully sued the negligent driver’s insurance company and won. The cases were won based on the driver having prior DUI’s and the company still insuring the driver. Is this beyond the scope of possibility? Does anyone know of something like this happening with some some degree of success?

Otherwise, aside from the driver getting charged with DUI and felony assault (due to the severity of my injury)- I get no recourse. Nothing to help pay my insurance deductibles, nothing for pain (of which I’m in a lot of) and suffering. This is all based on the driver having no personal assets and the fact that he will most likely declare bankruptcy if I try to sue him for future wages, etc. He is, after all, a meth addict. Any advice is appreciated!

I was a passenger in a limo and we got into a bad crash, my bills are huge. It turns out the company doesn’t have insurance (it is illegal) and my lawyer wants me to sue my own insurance instead of suing the owners of the company personally and putting a lean against their property. What should I do?

I have wonderful medical insurance and they have covered a great deal but there is a lot that is remaining and that I lost personally (wages, etc). Should we consult an attorney about a car accident my husband was recently involved in to make sure we get the max amount we deserve? I’ll try and give you as much details about the accident as possible.

What happened: My husband was driving home from work when 2 cars came to a stop in front of him, he stopped about 1 1/2 car lengths behind them as they were waiting to turn left, about 3 seconds later a large SUV rear-ended him dead on pushing him into the van in front of him and totaling our car. He went to the ER right away but haven’t gotten the x-rays back yet. We won’t get the police report for a few more days still but it was DEFINITELY the woman’s fault. My husband is under DR’s orders to take off 1 week, and then light duty for 1 week (possibly longer after we find out the results of the x-rays), he is feeling anxious because of missing work and we have no savings so we’re stressed about bills, we have a 5 month old and he cannot help me at home, and is afraid to drive now.
Oh yes and my husband drives for a living so him being afraid of getting into another accident is taking a toll on his work performance capacity.

Mainly we want the woman (or her insurance company) to pay: the remainder of our loan, my husband’s present and future medical bills regarding these injuries, lost wages, loss of ability to provide household serivces, loss of use of property (ie the car), pain and suffering (for his physical pain, mental suffering, and emotional distress), a rental car that is comparable to our totaled car until this is settled.

Also we know that the woman has insurance and it is up to date as we have already contacted her insurance as well as ours about this accident.

So do I have a case, should we get a lawyer?
our insurance co offered us about 14k for the car, but we owe about 16k on our loan as we’ve not had this car not even 2 months. When we purchased the car we didn’t get GAP so there is around 2k that will be left on the loan if we accept this.
he was at a dead stop and the woman was going 55mph when she hit him, that is why he was pushed so far. The police officer walked the skid marks from our car and he was pushed 10 feet (I guess that’s about 1 1/2 cars length right?)

and yes I am telling 100% of the truth, I feel bad for the women who hit him as she seemed very upset but we are newly married with a young baby and had worked hard for our car and life only to have it jeopardized by this womans negligence!

my son signed on a loan with his girlfriend and she took the car and moved. it was repo-ed and he didn’t know until he got court papers. Now the bank can’t find her and they are going to garnish my son’s wages for the full amount. We are willing to pay half but not everything. Someone told us it was eligal in missouri to give a loan to someone with a 5 year suspension for a DWI.
