lost personal injury case and now got to pay?




my auto insurance liability was 100000 and the driver sued me for pain and suffering for 85000 and won. can i transfer all assets to family members and file bk to avoid payments. if wages are garnished can i quit and get under table jobs. how long will this judgment be against me.







Say another employee has a grudge and calls in a complaint (pretending to be a customer) against another employee of equal rank, but higher seniority and the company fires the employee with higher seniority. Will a lawsuit cover lost wages, or just return the job?







I was in a car accident and I have a lawyer that has received the check from the insurance company , I asked that he pay the doctor with it..He said he has the check but he is redirected PIP reserved for lost wages. I didn’t have a job..Legally can I demand him to pay the Dr. or do I have know rights when it comes to that. This lawyer is not a very good lawyer but this was new to me and he half the time doesn’t even call me back. Please advise what I should do and if I can demand he pay the Dr.
Let me add some additional information..My lawyer has received ,400.00 he says he is withholding pip (personal injury protection) so when the case settles he can see if the dr will take less or a payoff amount, and then he will release the money. I was told he has done this with other clients to get more money out of it for him. I want to know if he has received that much money can I demand him to pay the Dr. Fees now. Hope that clarifies alittle more







** the person declaration page said 50,000/50,000 would this be the amount the lawyers will be suing for and paying out any medical bills and lose wages from also.. if not then where do they get the dollar amount to sue for — or would there be some kind of guidelines for how much they can sue for







I have no assets. I am worried that maybe I cannot prove she is faking her claims of injury,etc. What can she get from me if she wins? Can my future tax refund or wages be garnished? I am angry because I am positive she is just trying to scam the system and I am almost positive she is after me because the insurance company investigated and denied her claim.

The other driver was at fault. He was overloaded with logs on his truck and they came crashing out the back of it right onto my car.







The accident happened around the beginning of last year. I feel like I’m bugging my attorney but, I don’t understand the timeline of it all! He sent the demand letter to the Insurance company on June 5th and said they had 10 days to respond! Well, it’s been more than 10 days and I’m getting anxious! I have moved out of the state the accident occured in and am having trouble transfering my treatment to where I live now. I have had cervical spinal fusion and have to go have rhizotomys done every six months for gosh knows how long! I just don’t want to bother my Attorney was hoping for some feed back! Oh, and does the amount of your medical bills contribute to how much they’ll offer? Mine at this point are over 0,000.00
If I wait until I am done treating, I will never close my case! According to both my neck surgeon and my pain manangement Doctor, it looks like I have to go in every 6 months to a year to have Rhizotomy’s done on my back, bilateral on 3 levels, for the rest of my life. My Neck surgeon wants me to have them done on my neck but, I’m not healing from these as fast as I should! I also have irreversable nerve damage on my left side. My attorney did not request documentation for lost wages or any other things. He said we have enough with my medical bills and future treatments. The Semi driver’s coverage is a single limit 1Mil. Which I am told is all we can go after! But, just in future Rhizotomy’s we are looking at over 300,000. If I only live until 63. It’s just frustrating and I feel like I’m annoying my attorney, I know he gets 1/3 but, I’m not the type that likes to be considered a pain in the butt.







My daughter shattered her arm in an auto accident last weekend (Friday) and had surgery a week later (Friday) to fix it. She was the passenger in the car. She does not have any health insurance. The police report states that due to conflicting stories, they cannot place who was at fault. But I was able to obtain a CD from a service station that had the accident on tape. The other party turned in front of my daughter while they both had a green light. After asking around to friends and family, nobody knows of a good attorney for me to contact! I’m looking for all of her medical bills to be paid, as well as lost wages. Has anybody had success with a certain lawyer or know of a good one I can call? I suffered a sprained ankle, broken arm at wrist (ulna) and have 3% whole body disability from a neck injury (has bone spur contributed to accident that causes neck and arm pain). I’m out approximately 3000$ in lost wages.

I was working at the time (driver) and it is workmans comp so vehicle repair and doctor bills are to be paid to my employer. My case is with the other driver in this case not work comp.

Please do not simply advise to get a lawyer.
Also I live in Tennessee so theres not many million dollar cases won here for these types of cases. I want to be fair anyway so that wouldn’t be something I would want. I also don’t want to sell myself short as I am soul bread winner for my family.

I have already sent all of my information, medical and loss wages, to the adjuster. Are there any specific questions I should be asking or any information I should be aware of to know what is fair to settle. How much should I ask for when negotiating. My doctor bills are ,000 and I had to make arrangements for my 4 children to be taken care of while undergoing treatment 4 times a week, one of which is a baby an one is special needs. I wasnt able to even clean my house due to back pain from the wreck. I just want to know what is fair compensation. Please help me so I know what to do when they call with an offer.







I was injured quite badly last year in a motorcycle/auto accident and have just received a fairly large settlement from AAA Michigan. Does anyone know if this is considered taxable income, or is it taxable in a different way?

I’ll be paying H&R Block to do my taxes this year due to a few complications in my life, but can anyone give me a heads up on this area? I need to know if I can start paying the bills accrued due to my ‘downtime’ or should I reserve some for taxes…

All past, present, and future medical bills are covered by AAA directly, and lost wages were paid in full while I was off work. The settlement is for ‘pain and suffering’ and what I need it for is to have someone finish a house I started to build before the accident. I am unable to climb on the roof, etc. like before so can’t do it myself as planned. Also there was a considerable amount of interest paid on another house I borrowed against to fund the new building. Yes, I know that amount is deductable.




How do I have my auto injury case reopened.?




2 years ago, I was in a very bad car accident which my vehicle was totaled and I sustained injury to my arm and right leg. I was out of work for 2 months, and due to lost wages and no income and excalating doctor’ bills I settled my case. I continued to experience pain in right shoulder and shortly afterwards they found out that I had a rotator tear to the arm. I had to have surgery to repair the injury since then I have continued to have pain to my right shoulder. I am not able to lift anything of weight with my arm or often times unable to lift my arm over my head without pain. I am not sure if at all possible if I can have my case reopened for other medical expenses. Please help







I was diagnosed with whiplash, left tibial nerve damage, a slipped vertabrae, and a bulging disk. I did nerve testing, x-rays, and a mri. I have to see an ortho-specialist this week. I have been off work since the accident. I want to know excluding the medical bills and lost wages, what is fair compensation. Also, am I being unrealistic, do I need a lawyer?




Allstate handling my auto injury claim in bad faith?




Ok, brief run down…This happened in NC, on 4-25-08. I was on the highway (65 mph) heading to work, traffic had come to a stop, next thing I know I get hit hard from the back! Someone not paying attention had rear ended the truck behind me which then plowed into me.

My car took 5K worth of damage and was total loss. I was taken to emergency room and had xrays which actually showed muscle spasms. I was given 3 different pain meds for whiplash. I immediatly felt numbing/tingly sensations along with the soreness after being hit.

I missed 4 days of work and an hour for each of the 25 chiropractor sessions I had over few months.

I had 7692 in med bills. 1140 in lost wages. So 8832 in special damages…the adjusters "final offer" was 8500, which obviously doesnt even cover my special damages!? She said the average med bills for such an injury are 6500, and lost wages arent paid on an hourly rate ~they are just figured into the inconvinence…

I called and complainned to the supervisor, saying I felt my claim was being handled in bad faith and was trying this step before retainning the attorney I have been speaking to. I want my special damages paid for as they have supplied no reason to deny them and something for pain suffering.

They call me back with a new "final offer" of 10,000. This leaves 1,200 for pain suffering…does this sound low to anyone else? Since they made point to say "final/top offer" guess Id have no other choice but to retain an attorney and go to court in couple years?

You obviously have no grasp of the law in regards to auto injury claims…
I will clarify for you, I did not have sick or vacation time, I am on contract pay. BUT, even if I did, that too is considered lost earnings and is entitled to be reimbursed. Same goes for med bills. If health insurance paid for it, which I dont have, yes they would demand to be reimbursed from settlement. Medpay from my insurance does not have to be repayed, but is also not to be considered, in fact it is ILLEGAL for an adjuster to bring up such extra coverage benefits as you are mentionning, it is the law.

my son signed on a loan with his girlfriend and she took the car and moved. it was repo-ed and he didn’t know until he got court papers. Now the bank can’t find her and they are going to garnish my son’s wages for the full amount. We are willing to pay half but not everything. Someone told us it was eligal in missouri to give a loan to someone with a 5 year suspension for a DWI.
