I was in an auto accident where the other driver ran a stop sign. She was issued the ticket and declared at fault, I have a witness who has given a recorded statement to the insurance company to that fact and also on the report for the police. My two small children were in the car but the main impact was on my side and door. I went to the hospital as soon as I could after (when husband came home because my car was towed) Damages on car are 6,000.00 and so far it looks like med bills will be over 3000 easy. I have an MRI next week but we think it is a bulging or herniated disc in my back. I also had whiplash and head problems from head hitting window (nothing serious, but blurred vision and headaches). I have been out of work 3 wks already and can’t do much at home ( I am a homemaker by day and hair stylist by night and weekend) I can’t stand for long or even sit up for long. Anyone know what we can expect?
I am not looking to get rich but I am looking for what is fair. This was completely the other drivers fault and I have proof in the form of a witness and her ticket. My father is a lawyer but he doesn’t do this sort of case much anymore so he said he would refer me to someone if he thought we would be better off than with just the insurance company.

I was recently in a car accident where a Nissan truck ran into the back of another car that then ran into the back of me causing 00 worth of damage to the rear of my infiniti. I received moderate whiplash to my neck and had to be taken to the hospital. I checked out without any broken bones and was prescribed medication.

I went to see a chiropractor and he has been working on my neck for a couple days which makes it feel a better. Im 100% not at fault and the insurance company has taken care of my car repair, rental, and medical bills. They ask me " How much do I think I want for this accident" for pain and suffering.

I believe I am entitled to at least 00-5000 for my suffering

I live in NC. I believe 00 is a reasonable consider the circumstances. I could have lost my life, broke my neck and been paralyzed for life. Thank the lord that I received only a whiplash. The stress that I am undergoing, the constant pain in my neck is a reminder of the accident, which I feel fearful of driving. The time I spent recovering could have been spent enjoying my life. Besides getting behind in my school work, I am absent from my student organization at school which I am a key figure ( president AGC). I don’t enjoy waking up with cramps and headaches nor do I like to take prescription pills, and therapy. I don’t want to be compensation a insufficient amount that wont even cover pain and suffering I went though. It seems like you people are on the side of the insurance company and not the victims in this situation. I wonder if any of you have ever been in an automobile accident and if you have must share some sort of empathy of what I am reiterating.







Thus far the guilty party’s insurance co. has been very easy to work with. They told me to take my car to the mechanic of my choice for repairs…no jumping through hoops. They made more than generous settlements to the other people in my car who received minor injuries in the accident. My only concern is that my injuries (whiplash and a torn shouler labrum) are lifetime injuries. I just had surgery last week to repair the tear…I’m in my 40′s so it’s a downhill slope for recovery. I’m not sure if I want to hire an attorney who will take 33% of the money due me, as well as charge me extra for every letter, every phone call, every minute that they "say" they are working on my case. Most people aren’t aware of these additional costs, but I’ve heard of situations where the attorney has walked with more than half of the settlement w/o even going to court! Any ideas/thoughts?







I was diagnosed with whiplash, left tibial nerve damage, a slipped vertabrae, and a bulging disk. I did nerve testing, x-rays, and a mri. I have to see an ortho-specialist this week. I have been off work since the accident. I want to know excluding the medical bills and lost wages, what is fair compensation. Also, am I being unrealistic, do I need a lawyer?




Allstate handling my auto injury claim in bad faith?




Ok, brief run down…This happened in NC, on 4-25-08. I was on the highway (65 mph) heading to work, traffic had come to a stop, next thing I know I get hit hard from the back! Someone not paying attention had rear ended the truck behind me which then plowed into me.

My car took 5K worth of damage and was total loss. I was taken to emergency room and had xrays which actually showed muscle spasms. I was given 3 different pain meds for whiplash. I immediatly felt numbing/tingly sensations along with the soreness after being hit.

I missed 4 days of work and an hour for each of the 25 chiropractor sessions I had over few months.

I had 7692 in med bills. 1140 in lost wages. So 8832 in special damages…the adjusters "final offer" was 8500, which obviously doesnt even cover my special damages!? She said the average med bills for such an injury are 6500, and lost wages arent paid on an hourly rate ~they are just figured into the inconvinence…

I called and complainned to the supervisor, saying I felt my claim was being handled in bad faith and was trying this step before retainning the attorney I have been speaking to. I want my special damages paid for as they have supplied no reason to deny them and something for pain suffering.

They call me back with a new "final offer" of 10,000. This leaves 1,200 for pain suffering…does this sound low to anyone else? Since they made point to say "final/top offer" guess Id have no other choice but to retain an attorney and go to court in couple years?

You obviously have no grasp of the law in regards to auto injury claims…
I will clarify for you, I did not have sick or vacation time, I am on contract pay. BUT, even if I did, that too is considered lost earnings and is entitled to be reimbursed. Same goes for med bills. If health insurance paid for it, which I dont have, yes they would demand to be reimbursed from settlement. Medpay from my insurance does not have to be repayed, but is also not to be considered, in fact it is ILLEGAL for an adjuster to bring up such extra coverage benefits as you are mentionning, it is the law.

The police were notified promptly, I was taken to the E.R and initially diagnosed with whiplash, after going to a chiropractor he told me I had a grade 3 cervical strain/sprain with some pretty bad damage to my right shoulder and upper spine. I was working when this happened, we go house to house cleaning and it happened while we were going to another site. I did file workers comp and got a lawyer right away. After almost a month after it happened I am still having alot of problems with pain, it is affecting my performance at work. How much money can I get from this accident with a lawyer and how long will it take to actually see any money from this?

Good Florida car accident lawyers?




My friend had a car accident on I-95, the other guy got the ticket, and my friend has whiplash. How hard is it to get anything out of the other driver who cause the accident. Should she get a car accident lawyer to represent her, or just see what the insurance company offers them? And who would a good car accident lawyer be, in South Florida?







I have tried to contact a couple of lawyers out by me but they kind of shy away when they find out it was out of state. Also Can I sue for major pain in my neck and shoulder ie..whiplash? Thanks everyone.







Last week my friend and I got into an auto accident. We were both drunk when she drove 86 mph into a telephone pole. We were taken by ambulence to the hospital. I had a severe concussion and whiplash. It is less than a week, and I am in severe pain still. I have been thinking about getting an attorney to help me out.
