I was in a car accident and it clearly was not my fault I had a witness watch the whole thing. I do not have full coverage and liability was rejected by the other driver’s insurance. Where do I start? Any websites or anything would be very helpful. I can only find injury lawyers and I’m not injuried. HELP PLEASE!

i am confused on this i got a paper today from my lawyer note: back in june 4th 2010 i was in a car accident i have a slip disc on my neck and back problems now i am going through goldstien for my attorney i got this letter and it says this please be advices that we received 7 additional checks from state farm that total 9,015.73 these checks represent the medical payments portion of the auto policy enclosed is a power of a attoreny form which will allow us to sign these checks on your behalf please sign and date Power of attorney in front of a witness , then on the bottom says We will distribute the checks as listed below
Current Recovery ,015.73
Amount held in escrow towards expenses,
medical bills,and attorney fees untill final settlement of case (,015.73)
Balance payable to client .000.00
Please return the signed power of att. form to the office in the enclosed self addressed stamped envelope Please be adviced the enclosed funs are not to be considered a total settlement of your claim
i am just wondering if the thousand is what i will only receive i been through so many pain drs chiropractor and such and have 2 major injuries what is this i have no clue i am confused on this statement

The airbag was deployed, which cause injuries to her face, neck, mouth, nose and arms. She was bleeding from several areas and the police did not call ambulance. They asked her (age 17..first ever accident) if she wanted medical and she just nodded no. Shouldnt they call regardless? The ER nurses and dr’s went ballistic. She was in shock with lots of blood oozing from her nose and mouth. Her parents drove her to the hospital. Anyone know what should have happened here? NO drugs or alcohol was involved and they knew that..they put her in the back seat of the cop car and told her to shut up (she was obviously crying and upset) This happened in Winnebago Illinois
my brother was called to the scene and found his daughter in the back seat of the cop car, bleeding and crying uncontrollably. The cop told him to shut up when he asked why she was in the car and no EMT. He got upset and called the cop a naughty name and the cop told him if he didn’t leave or shut up he would be tassed. Several witness to the fact that my bro did not do anything other then call the cop a p@#@ for not letting him talk to his daughter. When the cops arrived, she was laying on the ground next to the car and they yanked her up my her arms and pushed her into the cop car by her arm, shoulder and head. The next day, she had finger bruises on her upper arm (and you can see finger prints) which we took pics of.

This is a follow up question … IN a nutshell my boarding house manager was drunk one night he choked me in front of a witness and then fled… he was arrested later that night and charged with domestic violence.. i filed a restraining order and today in court in was made permanent for one year.. the judge also stated i have a potential lawsuit i can file against the home owner who employed the house manager.. Question i have for you all is anyone familiar with the law.. can you tell me if you were in my shoes what grounds would that lawsuit be on… People on here have said it would be easier to move.. that may be true but at this time i don’t have the money and second and most importantly.. is everyone saying .. just let it go.. like it never happened.. he has broken into other tenants rooms including a pregnant woman and also another roommate.. every time there’s an incident the home owners are contacted .. and all they have to say is.. well maybe with all the drama there everyone needs to move and we can just sell the home… its a care free attitude.. and yet they continue to employ him… the idea of a lawsuit has come to me as a means of showing them you cant treat people like that… about the choking incident i was not hospitalized or anything like that … and i live in Tacoma,Washington…

I took blood 5pressure pills and blacked out driving from the pills. I ran off the road and hit a tree.I was the only one injured.I blacked out from the pills and ran off the road.I was by myself.I dont drink. The dr. had given me 5 pills to take at one time. I woke up 3 hours later in the hospital. they said I had a wreck. a few days later I got a suphena to show up in court as a witness. I went to court and they said they were ticketing me for dwi and failure to control a vehichle. They said they drew my blood and my alchohol level was .11. How do I defend myself. I dont trust the appointed lawyer. He said its my word against theirs. Who put alcohol in my blood? What is going on here..Please this is serious no silly answers please.

Can lawyers for each side ask any question in a personal injury case even if it is designed soley to embarrass the witness and is basically irrelevant.
The question being asked has nothing to do with my injury. It pertains to my stepson who is HIV positive. I’m not sure what the purpose of this is, but I was asked about the nature of his disability during a pychological examine ordered by the insurance company, I’m concerned that this now can be brought up at trial and will be very upsetting to my wife.

My 16yr old was involved in an auto accident. She was going straight on a highway and another car was making a left turn and turned in front of her causing my daughter to hit her car. The other driver was issued a ticket for careless operation. A car behind my daughter was a witness to the accident along with a passenger with my daughter. The driver at fault was a 78 yr old lady that was with her 80 yr old sister on their way to a casino. They are fighting the ticket saying that my daughter was speeding and didn’t even use her brakes because there were no skid marks. This was 8:30 pm and it was dark. They are also claiming that the elderly sister had injuries. But, when I asked if they were ok, they did mention the sister bumped her head on the window upon impact but she was ok. They also stated that she had an aneurism(sp?) 4 mos before. The police report states that my daughter was doing the speed limit and that the driver behind her did see her brake lights. Can they win?

While I was making left turn at the intersection upon the signal turning green, I was broadsided. The other driver was clearly running the red light, but claimed she had the green light. There was no witness and the police report didn’t specify who’s at fault. No injuries on both parties. Does anyone know what the California laws/rules say about the case like mine?

I hurt my back at work downstalking stuff I told a manager I hurt my back pretty bad but he blew me off when I told him,the next day I called in and talk to a different manager about what happened she ask me why wasn’t there a report but fortunetly I had a witness that saw me report to the dBAG manager the first time anyways moving on so I’ve been on workers comp for the last 7 months and during that time I’ve had them harrassing me threating my job and while there getting mad at me….. Who they should really be mad at are the doctors or insurance company they are constintly dragging there feet……. like I said they I’ve been out for 7months but it was only up until a couple weeks ago that they just did my MRI and all the while my work has been thinking that I’m playing them the MRI says different it says I have a torn legiment in my lower back and the orthopedic doctor said to me verbatim that this is a "permenent life injury" and it’s something they can treat but it’ll always be like a patch on a tire just a temporary fix but it’ll still be permenent and she said that surgery isn’t possible now whether that’s truth or not this is still there doctor telling me this (the workers comp doctor) she told me a ideal job for me now is a desk job or a manager position

Just got into a car accident, I’m completely fine except for a few scratches and bruises, but my car is totaled (go seat belts!). I have another car I can use so I won’t be missing work or anything. After the accident, they took me to the hospital, they checked me up and gave me x-rays where it hurt but found nothing. The driver a fault was totally drunk, ran a red light and hit me. Everything is his fault. There was a witness that reported that to the police.
So given those circumstances, is it worth getting a lawyer?
Also, the driver at fault does have insurance.

My parked car was hit by a drunk driver who fled the scene (leaving his car there). There was a witness but he only saw the idiot run, not the actual accident. The idiot tried to report the car stolen 1/2 hr later. If he is successful and they say it was stolen, which insurance coverage comes into play? I have collision and comprehensive but not uninsured motorist coverage. Also, if he is found to be responsible but does not have insurance, would my collision/comprehensive cover that?

3 months ago, my boyfriend and I were driving my car. I didn’t have insurance at the time, stupid I know. I learned my lesson and bought insurance the day after the accident. anyway, my boyfriend was driving and he has insurance, though now i learned it doesn’t make a difference because that only covers his car. some lady ran the red light and t boned my car. it was me and my boyfriends first accident so we didn’t know to tell people that saw it happen to give us their number as a witness. cop came, lady told him she had the green light. so it was considered a no fault because we both said we had green light. we stopped at the gas station that was on the intersection after, they said they have cameras and we got the tape, we have video proof she ran red light. we’ve been working with her insurance to prove she’s guilty and they keep drowning it out to be longer, like we have to send the video here, call back in a week, had to send it to a diff claims place, etc. it’s been 3 months we’ve been doing what they’ve told us. i lost my job because my car is undriveable and i could never find a way there. what kind of lawyer should i get? any advice about anything?
i’m in minnesota which is a no fault state…so that means i can’t do anything about it?

I got into an accident around the end of october last year. At the scene the other guy’s car only had surface scratches since he owned a Mercedes and the bumper took all the impulse, my car was pretty badly totalled in the front. The first thing I did after the accident was walk out of my car to check if everyone was ok, I asked him and he said he was. So we called the police, we didn’t ask for an ambulance or nothing because it was a low speed collision and we both had seat belts on. So the police officer came and took our reports, and asked me if I was ok I said I was and he asked me if the other driver was ok as well, and I told him he was, the police officer asked the other driver as well. Now one year after the accident this driver is trying to make a claim on being bodily injured in the accident. I can prove using physics and dynamics exactly how much force was applied to his seat and through the seat belt onto him, I have the police officer as a witness, how will my case hold up
I am 100% sure he is trying to fraud me, I am pretty sure he cut me off right before a red light but that cant be proven. However the police officer can testify that he was ok at the scene, how badly his car was damaged, etc; isn’t this enough to win a jury over? What is this other guy thinking, that I am so stupid I will settle for what he askes knowing I can win the case so easily because I am innocent and he will be commiting purgery on stand by lying about his injuries? Also doesn’t he get checked by an unbaised doctor recommended by the judge to show what his injuries can be attributed to? I have Gieco insurance, will they do anything to help me prevent this obvious case of fraud? Is there any chance that this guy’s lawyer can trick a jury even with all my proof and evidence?
Thanks for any ideas, also should I contact Gieco’s fraud department and report this as such a case for investigation?
Please help me, i dont know what to do now.

I was in an auto accident where the other driver ran a stop sign. She was issued the ticket and declared at fault, I have a witness who has given a recorded statement to the insurance company to that fact and also on the report for the police. My two small children were in the car but the main impact was on my side and door. I went to the hospital as soon as I could after (when husband came home because my car was towed) Damages on car are 6,000.00 and so far it looks like med bills will be over 3000 easy. I have an MRI next week but we think it is a bulging or herniated disc in my back. I also had whiplash and head problems from head hitting window (nothing serious, but blurred vision and headaches). I have been out of work 3 wks already and can’t do much at home ( I am a homemaker by day and hair stylist by night and weekend) I can’t stand for long or even sit up for long. Anyone know what we can expect?
I am not looking to get rich but I am looking for what is fair. This was completely the other drivers fault and I have proof in the form of a witness and her ticket. My father is a lawyer but he doesn’t do this sort of case much anymore so he said he would refer me to someone if he thought we would be better off than with just the insurance company.

I’m being charged with domestic violence injury to property. my current lawyer doesn’t advise to go to trial, reasons being that in the police report I told them I put a hole in the wall, and this is the only evidence. And there’s no witness.
My question what is the possibility to get the case dismissed?
(The DA has offered an 1 year deferred judgement with 36 hour anger management, and this offer is exactly the same the 1st time when I went to the public hearing by my self).
