I live in CA. I was injured at work and have not been able to go back for two months now. I am almost a month late on my rent and am now facing eviction. My employer is making life hell by not giving me my needed Workers Comp and I’ve had to get lawyers involved because of this. I had to borrow money for last month’s rent. Do I have any legal protection? How can I avoid eviction?







I am a 43 yr old person that has a job requiring me to drive 5-8 hrs a day, and have been doing so for the past 5 yrs. I have never had any physical trauma or any spine related problems. I have recently been diagnosed through MRI and X-ray that I have a cervical bulging disc and in an adjacent disc, cervical spondylosis. The nuero surgeon said the bulging disc is the main cause of my severe radicular pain and I am now on short term disability (2 weeks). My onset of pain slowly began about 3 months ago but have only been out of work for 2 weeks. My surgeon thinks the disc may repair itself and so we are waiting but surgery may be inevitable. He said that fusion is 99% sucessful if we end up going that route.My short term disability pays me 100% for 6 months then 85% for the next 6 mos if the problem persists. Can someone please tell me what I would gain by filing for workers comp and some further advice?

I had a claim today the member lives in a no fault state for auto insurance. A medical claim was submitted and it was a work related auto accident (mail carrier), workers comp has denied the claim, will the no fault automobile insurance pick this up? Even if it’s a work related auto injury?

I work for the person’s health insurance company, and we’re trying to investigate third party liability. The member is the subscriber/insured of our plan. She is a mail carrier and was injured in a car accident while delivering mail. Workers comp denied their claim for whatever reason, but now we’re being told we need to investigate if their auto insurance will pay as they live in a no fault state. If you live in a no fault state when you’re in an accident your auto insurance pays for your damages regardless of who’s at fault. The other drivers insurance pays for their on damages as well. So I’m asking if her auto insurance will pay for her damages/medical expenses if she’s injured in a work related car accident. Or will her auto insurance pay regardless of whether it’s a work related injury or not?

Do you think we should do more investigation as to why workers comp denied the claim?







For some reason I thought if you had a work related injury, hospitals had to bill the workers comp and it was illegal for them to bill any private medical insurance. I know auto insurance has a cap, like 0,000 personal injury and once that runs out the medical insurance starts being billed but for some reason I thought it was different with work comp claims. Was I wrong?







The police were notified promptly, I was taken to the E.R and initially diagnosed with whiplash, after going to a chiropractor he told me I had a grade 3 cervical strain/sprain with some pretty bad damage to my right shoulder and upper spine. I was working when this happened, we go house to house cleaning and it happened while we were going to another site. I did file workers comp and got a lawyer right away. After almost a month after it happened I am still having alot of problems with pain, it is affecting my performance at work. How much money can I get from this accident with a lawyer and how long will it take to actually see any money from this?
